March, 1a51,, the City Council ordered repaired, resurfaced and improved that

follows:
Main street from the south line of Fourth Street to the north
line of Roberts Street
the same being �thin District No. 1, of the Cit,y of Cape Girardeau, Missouri
as laid out and designated by Commission Form Qrdinance No. 600, passed and
approved on the 23rd day of July 1937, and Commission Form Ordinance No. 1253,
passed arld approved on the 29th day of May, 1950,�b�� removing and replacing
the base where found necessary, removing and replacing the existin� asphalt
surfacing or bringing existing low places in the surface to the proper grade
and contour with new asphaltic concrete or asphalt penetration course, where
found necessary, and placing a seal coat consisting of emulsified asphalt and
crushed stone or other suitable aggregate, said seal coat to be in one or more
applications and of a quantity and qualitp as specified b,y the City �,hgineer,
and,
WHERAS, said John R. Walther has heretofore filed his report showing
the total cost of repairing, resurfacina and impro ving said portion 'of said
street to be � 1957•50, the total number of linear feet fronting and abutting
"� . thereon to be 3179.8 feet, and the cost per front to be forty-six
cents,. and showing the proportionate share of such total cost chargeable a-
gainst each lot, tract, and parcel of land fronting and abutting on said portion
of said street, and,

WHr�S, said Commission Form Ordinance No. 1304, authorizing and direct-
� said improvement to be done, provided that the City of Cape Girardeau, Missouri,
` r ma�� contract with any person, firm or corporation for the construction of said
improvement, and,
� WHERAS, the said City of Cape Girardeau did perform the work with the
�"u� . forces of the Department of Public WorksS with certai.n portions of the work
I being performed under contract with the Cape Asphalt Company of said City,

NOW THEREFORE, BE IT OftDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE
GIRA!�DEAU, MTSSOURI AS FOLIA�dS:
SECTION 1: That the report of John R. i++Talther, City�F,Yi�ineer, cover-
ing the repairing, resurfacing and the improvement of the afore-described streets
be� and the same is hereb3T� ordered filed, and is hereb� accepted and aprrove .
SECTION 2: That the City Council finds said report to be correct and
further fi.nds that the total cost to the City of Cape Girardeau for repairing,
resurfacing and ir�proving said street does not exceed 60¢ per front foot on the
property fronting and abutting on the portions of said street so improved.
SECTION 3: A special tax is hereby levied and assessed against all oP
the propert,� fronting and abuttin� on said portion of said street in a sum equal
� (` to 46 � per front foot; that the names of the owners� the descri�tion of the
property, the number of front feet thereof, the auwunt of special ta�c aPainst
each particular lot, tract or parcel of land fronting and abutting on said por-
tion of said street is as follaws:

SECTION 1�: Special tax bills in the aruounts set forth in the preceding
section shall be issued by the CitS Clerk against said lots, tracts or parcels
of land respectively, which said special tax bills ahall bear interest at the
rate of six per cent (6�) per annum from their date, and shall constitute a first
lien upon the property therein described, and shall continue in force for a per-
iod of five years after their date unless sooner paid, and in the event suit is
brought to enforce such lien then said tax bills shall continue in force until
the expiration of such litigation. Said tax bills shall be issued in favor of
the City of Cape Girardeau, Missouri, and any owner or holder by assignment of
such tax bills may enforce the collection thereof in any court of competent
jurisdiction.
SECTION 5: This ordinance shall take effect and be in force after the
expiration of ten (10) days from the day of its passage or adoption
