ITS PASSAGE �P�D l�PPROVAL. ) BE IT 0_r-r.DAINr.`� BY THE CQUi1CIL OF THE CITY OF C�PE GIRARDEl�U, MISSOURI, AS FOLT,OWS: SECTION 1. Five sections of the ordinances of �he City of Cape Girardeau, �dissouri are hereby enacted, to be known as Sections A, B, C, D, and E of the ord�nances of the City of Cape Girardeau, ;dissouri, and to read in words an�' fi,�ures as follows: Section A. It is hereby declared to be the policy and purpose of the �ity of Cape Girardeau, hrii.ssouri, to extend, at the earliest date, to all eligible employees and officials of said City who are not excluded by law or by this ordinance, and whether employed in connection with a �overnmental. or prcpr�etUry funct;or. of said City, the benefits of the system of �ederal Old-Age and Survivors Insurance as author- i.zed by the Social Security Act Kmendrnents of 1950, and by Senate Comwittee Substitute for Senate Bill P1o. 3 of the 66th General �ssembly of the State of i�.i.ssouri and amend- ments thereof, as the same may be now and hereafter in effect. Se�-tion B. The �ia.yor and City Clerk of the �ity of Cape Girardeau, �dissouri, are hereby authorized and directed, on behalf of this �ity, to prepare, execute and submit to the Division of Budget and Comptroller of the State of Ivlissouri, as State Agency of the State of 2dLissouri, a �lan and agreemen� ior extending sai3 benefits to said eligible employees and officials of the City of Cape Girardeau, l�.issouri, in the form prepared by the State :��ency and hereby approved and adopted by the City Council of this City, whic� plan and agreement are to become efiective u�on approval thereof b�r the State Agenc;�, and are further authorized a:�d directed to execute agreements and rnodi�icatior�s and amendments thereof with said State �gency, providing for thE extension of said benefits to said employees and officials as set fort}�in said plan and agreement, as provided fo: in Section A hereof, said plan and agreement to provide that said ex- tension of benefits is to be e�'fective on January l, 1951. Section C. Co�nenc:i.ng on the first day of the month following the date of the approval of the plan and aoreer�ent of this City by the State 4�`ency, there shall be deducted from the wa,-es of al1 employees and officials of the City of Cape Girardeau, l�i.ssouri, to �fhom the benefits of said system of Federal Old-Age and Survivors Insurance are extended, by virtue of the plan and abreement hereinbefore provyded for, the amount of each of said employees ' and officials' contributions as determined by the applicable -1- � ��r � � ' - = State and Federal laws and by said plan and agreement, the aggregate amount of said deductions to be paid into the Contributions Fund created by Senate Comraittee Substi- tute for Senate Bi11 No. 3 of the 6bth General Assembly of the State of iviissouri; provide, however, that from the first payment of wa�es t�de to each of said employees and officials after the benefits of said system have been extended to such employees and officials, there shall be deducted a stun equal to the amount which would have been due and payable from each of said employees and officials had said extension of benefits been �rovided arid effective on January 1, 1951. S�e�ion D. Com�~�encing on the first day of the month following the date of the approval of the plan and agreement of this Cit�T by the State Agenci�, there is hereby authorized to be appropriated from the General I�evenue rund of the C1ty of Cape Girar�eau, �issoUri, and there is, and shall be, appropriated, the suru or sums of money necessary to pay the contributions of the City of Cape Girardeau, IVfissouri, which shall be due and payable by v�xtue of the extension of the benefits of the Federal Old-Age and Survivors Insurar.ce Systern to the eligible emplo,yees and ofi'icials of said City, said s�.m or sums of money to be paid into the Contribut-ions Fund created by Senate Committee Substitute for Senate Bill I�Io. 3 of the 66th General Assembly of the State of Missouri, prov�.ded, hotivever, that in making the f.irst payment to said Contributions Fund, after the benefits of said s�stem have been extended to such employees and officials, said first payment shall include a sum equal to the amount which would have been due and pa,yable had said extension of benefits been provided and effective on January 1, 1951. The Fund from which said appropriation is made wil1, at all times, be suf.ticient to pay the contributions of the Citf by this Section directed to be paid to said Contributions Fund. Se�tion E. 2'he City of Cape Girar3eau, .�lissouri, from and after the approval of the plan and agreement of this �.ity by the State &gency, shall fully comply with, and shall keep such records, make such reports and provide such methods of administration of said plan and at;reer�ent as rr.ay be required by all applicable State and Federal laws� rules and regulations, now and hereafter in effect with respect to the extension of the benefits of the Federa.l 81d-�ge and Survivors Insura-.ce aJsten to t�e employaes and officials of this Citf. �'or the purpose of aciministering said plan and agreement, the Cit;� Clerl: of this �ity st�all oe tne ofricial w:�o shall make all required reports, keep all records, and be respons�ble for the ddlninistration of said plan and a��reement on behalf of this �ity, and any and all notices and communications from the State �gency to this City with respect to said plan and agreement shall be addressed to "City of Cape Girardeau, �.issouri.". SF�CTION 2. AI1 ordinsnces or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION 3. It being necessary for the immediate preservation of the public peace, health and safety of the employees, offic-als and citizens of the City of Cape Girardeau, Missouri, that the prov�sions of this ordinance shall take effect at once, an emergency is hereby delcared to exist and this ordinance shall be in full force and effect from and after its passage and approval.
