WHE.REAS, on the 1't�th day of Te�a,y, 1951, the City Council of the City of
Cape Girardeau, i+dissoiari, rx�.ssed and anproved Commission Form Ordinance No.
�3�,�', declarinry it a public necessity to open and extend William Street from
the "U�Jest line of Louisiana kvenue to the East line of Ivlinnesota Avenue in the
City of Cape Girardeau, i�iissouri, same being a right-of-way 70 feet wide and as
shown on the Plat of VTest �nd Place 5econd Xddition to the City of Cape Girardeau,
i�'ris s our i; and
WH�r�:t�i5, the persons who claimed an interest in said right-of way have
now agreed to settle said cause and to take as damages for the ta.king o:�� their
pre.mises an� agreement from the City of Cape uirardeau, �,Gissouri, that when
said Street is o�ed the City will pay f'or concrete pavement up to 22 feet in
width at no expense to the propert;;r owners; and
�JHEttEA.S, the property owners have each presented to the City of Cape
Girardeau, :v�.i.ssouri, a �;uit Claim Deed to any interest that the,� mi�ht have in
the said ri�nt-of-waf.

Section 1. ihat Comraission Form Urdinance No. �, passed and approved bv the
City of CaNe C;irardeau, ::::issouri, on the 7�th cia,y of i�:ay, 1y51, be and the same
is hereby r�pealed.
Section 2. The Cit,y Council ot the City of Cape Girardeau, i�?sssouri, hereb�r
establishes, opens and extends u�illiam Street from the :`'lest line oi' Louisiana
.Avenue to the Ea.st line oi '_i�iinnesota xvenue in the City of Cape Girardeau�
�lfissouri, the sa:ne bein� a right-of way 70 f eet wide, as shovim on the Plat of
Vlfest ?'nd Ylace Second Addition to the City of Cape Cirardeau, lv�ssouri, as the
extension of l^l111iam Street betvreen F3locks 9 and 2� and Rlocks 10 and 23 in
said kddition, becau.se of nublic convenience and necessity.

Section 3. That there is hereby accepted by the City right-of-w�ay to s aid
Street as above described of a unif'orm width of 70 feet from �lbert Kempe and
Alma Kempe, husband and -.vif e; Alf_red i. Hirsch and Rub?r Iiirsch, husband and
wife; Arthur ���ohr and iul.ildred ��ohr, husband and wife; and Helen yVithers, Edward
Withers and Vivian V�ithers, his wife, Onal Leslie and Earl Leslie, her husband,
Vualdo �;�osthers and Ruth 6'c�ithers, his w-�.fe, ��rrtle Bohnsack and Fritz Bohnsack,
her husband, and r�dam �;�ithers, which deeds the City Clerk of the City of Cape
Girardeau, i,-issouri, is hereby directed to file of' record in the Gifice of the
Recorder of Deeds of' Cape Girardeau County, l��ssouri.
Sect_on 4. The City of Cape Girardeau, �is o� ' ,�oes hereb,y agree to pay out
oi the General N,evenue Fund of said C�tyn`�, the above named property owners,
Albert Kempe and klma Kerape, husband and wife, Alf red G. Hirsch anci ftu'�y Hirsch,
husband and wife, krthur paiohr and r,iildred ��ohr, husband and wife, and Helen
:'uithers, Edward tiYithers and Vivian 'r'�ithers, his wife, Qpal Leslie and Earl
Zeslie, her husband, i�aldo '�uithers and Ruth Withers, his wife, i�yrtle Bohnsack
and Fritz Rorinsack, her husband,and �1dam Withers, as damages f'or tivhatever in-
terest they had or �rii.ght have in said right-of-way, a portland cement street up
to 22 feet in width, y�rhich shall be placed on tine ri�~h�-of-���a:,� oi lN"illiain Street
as descaibed in this Ordinance.
Section �. �1'hat the ri:ayor of the saiu Cit;�, �:alter I�. ��ord, is hereby directed
to execu�;e an agreement tivitr� the Uropertf owners above named evidencing the
City's obligation toPpr,ve said portion of said `�'uilliam Street u� to �2 feet in
width in consideration of their (�uit �laim Deecls to said ri�ht-of-�.vay.
Section 5. `�his Ordinance sha11 be in full l'orce and ef�'ect i'rorn and a�'�ter its
passage and approval.
