AN ORDINANCE PRUVIDING FOR THE RFPAIRING xND �y�SURFtiCING OF
JEFFEc�.S0A1 AVENUE, FR�i TH�; EDGE OF THE CONCRETE P1�VF�;ENT AT THE
EAST SIDE OF FRIDERICK STREET TO THE CENTER LIN-E OF ASHER STR.EET.
AND PROVIDING FOR THE ISSU/aNCE OF SPDCItiL TaX BILLS IDt TI�; P�Y1��TST OF
THE COST OF SAME.
BE IT QRDAINID BY THE COUI�iCIL OF THE CITY OF CAPE GIRARDEAU, NiISSOUftI,
AS FOLIAWS:
SECTION l. That the portion of Jefferson Avenue
in the City of Cape Girardeau, Tiissouri, fro� the edge of the concrete
pavement at the east side of Frederick Street to the center line of
Asher Street,
the same being in District Pao.�t , , in the City of Cape Girardeau, i�iissouri,
as 14id out and desiF;na�ed b� Co�tuv.ssion For�n Ordi.�ance �]o. 800, passed and
approved on the 23rd day of Jul�T, 1y37, a.nd Comini_ssion Farr:� Ordinance P1o. 1253,
passed and apnrovecl. on the 2qth d�y of I`�i�y, 1950, shall be repaired Gnd
resurfaced in accordance with saici Comrr.ission Form Ordinance Nos. 800 and
1253, as Project No. 7-51 �, in said District tio. 4 .
S1+�CTION 2. ^1he followin�; work s.iali bc� done: Rer��ove and rep'a.ce the
b�.se where found necessarq, remove and repJ_�,ce the e�sting asphalt surfacing
or bring existing low nl�:.ces in the surf.ace to the ��roper grade and contour
w.i.th new �.spha3_tic concrete or aspha�t penetration co�irse, where found
necessary, �nd pl��.ce a seal coat consisi;ing of er:�ulsified or cut-back
asphalt and crushed stone or other suitable aggiegate, s�.id seal co�,.t to
be in one or more applications ar.d of �. quant�ty a�id qu�lity as specified
by the City Engineer,
SECTION 3. Said repairing and resurfacin� said street shall be done h�r
the t�epartrient of Public Works of the City of Cape Girardeau, I�iissouri,
under the directa.on and supervision of the Cit,y En�ineer, so that �he cost
of such repairing and resurfacinp shall not exceed un �ar�ount eaual to
sixty (60) cents per front foot of pro�erty frontin� and �.butting on said
portion of said street so imj�rovec�.
SECTION 4. An accurate wccour.t shall be kept by the City �n�ineer of the
cost of said work, including ;�:.��nent at contract prices for any portions
thereof done by eontract, and such cost s;iall be defrayed by �:. s�ecial tax
to be assessed in favor of the City of Cape Girardeau, Niissol_iri, agai�zst
the property fronting ar_d abuttina on said ?�ortion oi said street in the
proportion that the linear feet of each Iot or tract frontin�� and abuttin�
on said portion o.f s�id street beGrs to the total number of linear feet of
all the property fronting and abutting on th�t portion of said street so
rep-sired and resurfaced.
S�TION 5. Upon the comnletion of s��ic� wor?{ the said City �,ngineer shall
report to the co�ancil the to�al cost of said rep�,irinQ and resurfacing of
said portion of s�.id stree�, the total nurnber of linear feet of nroperty
frontin4 and abutting thereon, and the pro�ortionate share of such total
cost chargeable against each lot, tract, and parcel of land fronting and
abutting on said portion of s�.id street, ir. accordance with the provisions
of this ordinance.
SECTIOPd 6. Upon the filing of such repor�t by the City �ngineer, the City
Council shall examine the same, r:nd if said renort be found correct, and the
total cost of said repairing and resu..rfacin� does not exceed 6Q cents per
front foot on all of the property irontin�; and abu�ting upon the said portion
of said street, the Council sh�.11 levy a,nd assess �t special tax 2.gainst saa.d
property in accordance with said rexx�xt. Said tax bills shall be sold for
not less than their face value, and assigned by the City Clerk to any
purch�.ser or purchasers thereof.

SECTION 7. All ordinances <�..rid p:lrts of ord�n�nces ir� conilict �r_tn the
provisions hereof are Yiei eby repealed.
SECTIOPJ 8. This ord�n=�nce shail take et'fect and be in fo:ce from and
after ten days after its passage 2nd �,p�roval.
