BE IT ORDAINID BY THE COUNCIL OF THE CITY OF CAPE GIRARD�.AU, NiISSOURI,
AS FOLLOWS:
SECTION 1. That the partion of Terrace Drive
in the City of Cr1pe Girardeau, l�lissouris iron the west curb line of
Sprigg Street to the east curb line of Alta Vista Drive,
the same being in District T�io. 2 _, in �he City of Cape Girardeau, i�iissouri,
as l�,id out and desi�;nat�ed by Co::u�.ission ;�orm Ordina.nce No. 800, passed and
approved on the 23rd day of Jul�r� 1937, and Coimru_ssion For� Ordinance Pdo. 1253,
passed and �.pnrovecl on tY:e 2qth d:�y of ��:�y, 1950, sh�.11 be repaired �.nd
resurfaced in accordance with said Cor�r:ission Fo•rm Urdinance Nos. 800 and
1253, as Pro ject No. 13Y51__._,, in said District ��o. 2 .
SI�TION 2. The followin�; work s1.a1J. be done: Rer��ove and replace the
base where found necessary, remove a.rid rep�_�ce the existi.ng asphalt surfacing
or b.ring existing low pl�;.ces in the s�.ir�ace to �he ��ro�er g�rade and contour
with new �.sphaltic concrete or aspha�t penetr�,tion co�irse, where found
necessary, and place a seal coat consisting oi ez:iulsif:ied or cut-back
asp.zalt a,nd crush�l stone or other suitab3e �.pgregate, s�id seal co��.t to
be iii one or more ann3ications ai�d of a quantity a.id qu�lity as specified
by the City Engineer.
SECTION 3. Said repairing and resurfacin� said street shall be done by
the Department of Public Works of the City of Ca.pe Girardeau, Aiissouri,
under the direction and supervision of the City En�ineer, so that ihe cost
of such repairing and resurfacin# sha11 not exceed �n �:::.ount ec�ua]_ to
siYty (60) cents per front foot of pro�erty fronting a.nd abutting on said
portion of said street so imi�roved.
SECTION /�._ An accurate �.ccour.t shall be kApt by th� City Engineer of the
cost of said worlt, 3.ncludin� pa�rmen� at contract prices for any portions
thereof done by contract, and such cost silall be defrayed by �, s�ecial t�.x
to be assessed in fa.vor of t:�e City of Cape Girardeau, rliss�uri, agai.ist
the property fronting and abu�ting on said �ortion o�' said street in the
proportion that the linear feet of each lot or tract fronting and abutting
on said portion of sa.id street be�rs to the total number of linear feet of
all the propert,y fronting and �butting on that portion of said street so
repa.ired and resurf�,ced.
SL,CTION 5. Upon the comnletion of s�.id wori� the said City �ngineer shall
re�ort to the co�ancil tY;e total cost of said repyirin� and resurfacin� of
said portion of said street, the total nw�:iber �f line�,r feet of property
frontin� and abutting tt-iere�n, and the c�ro�ortionate share of such total
cost chargeable against each lot, tr�.ct, a,nd parcel of Iand frontin� and
abutting on said portion oY said street, �n accordance w_'tth the provisions
of this ordi.nance.
S�,CTIOrt 6. Upon the filin� of such rer�ort by the City 'i,ngineer, the �ity
Council shall exarr�ine the same, �d if sa,i.d re?�ort be found correct, and the
total cost of said repairing and resurfacing does not exceed 60 cents per
front foot on a.11 �f the property iroiitin�; and abuttin� upon the said portion.

propert;� in a.ccord�ce vrith said rexx�rt. Said t�ix bills shall be sol.d for
not less than ttieir face value, and assigned b;� the City Clerk to an1

Sr,CTION 7. All ordinances arid ���rts of ordii��r�ces in conflict with the
provisions hereof axe hereby repealed.
