BE IT CIRDAINID BY TFi�E COUNCIL OF THE CITY OF CAPE GIRARDEAU, NiISSOURI,
AS FOLLOWS:
SECTION 1. That the portion of First Street,
in the City of C:.�e Girardeau, N�issouri, �rom the east curb line
of Main Street in Robertson and Gale Addition, west, to the west
side of �qai.n Street as same exists in �ot 110 in Ingram's Addition,
the s�ne being in District P�o. 1 � , in the City of Cape Gira.rdeau, �iissouri,
as l�.id out and desi�;nated bJ Co�.u=.ission I�or:n Ordi.zance iVo. $00, passed and
approved on the 23rd day of JultT, 1y37, a.nd Coi�uriission Forra Ordir�ance PJo. 1253,
passed and apnroved on the 29th d�.y of A�i�,y, 1950, shall be repaired a.nd
resurfaced in accordance w-i��h said Comrn.is�ion Form Ordina�ice Nos. g00 and
1253, as Project No. 15'S1.___`, ?n said District A�o. 1 .
S�CTION 2. The followinR wor� 5i111i be done: Rerr�ove and rep?ace the
base where found necessar�, remove ��,nd rep?_ace the e;usting asp�alt surfacing
or bring existina low pl�:.ces in the s�.3rt'ace to the �roper grade and coritour
with new �s�ha�_tic concrete or asrhait pen�tr�.tion co�L:se, where found
necessarvj a.nd pl��.ce a seal coat consistir.� ot e�:ralsif�ed or cu'���back
asphalt and crush�d stone or other sui�able �;g�e�a�ce, said seal ca�:.t to
be in one or rnr�re aoplications and of �. qu�.ntity �id qu�la_ty as specified
by the City �ngineer.
SECTION 3. Said repairi.ng a_nd resurfacin� said street shall be done by
the llepartment of Public Works of the City of Cape Girardeau, i�.issouri,
under the direction and supervision of the City r�n�ineer, so tha� �che cost
of such repairing and resurf1cing shall not exceed an ��anount ec:+,ual to
si�:ty (60} cents per front foot of pro�erty frontin� and �.butting on said
portion of said street so ini�roved.
SECTION 4. tln accurate �,ccour.t shal� be kept by the City r,ngineer of the
cost of sai.d work, including p�.;nnent a� contr�ct prices for anv portions
thereof done by contract, and such cost s.zall be defrayed by a s�ecial tax
to be assessed in f�.vor of the City of Cape Girarde�:.u, rlissouri, against
the property fronting �snd abutting on s�id �ortion oi said street in the
proportion that the linear feet of e�ch lot or tract fronti.n�� a,nd abutting
on said portion of s��id street Ueurs to the tot�.l nuriher of linear feet of
al3 the property frontin� and abutting on that portion of' said street so
repaired and restzrfa.ced.
S�t�TIOi�T 5. Upon the cor.lpletion of s�.id wor?c the said Cit;� �,ngineer sha11
rer�ort to the co�.zncil the total cost of said rep�.irin; and resurfacin� of
said portion of said street, tYie total number of linear feet of property
frontin� and abuttin, thereon, and i,he pro?�ori;ionate share of such total
cost chargeable against each 1ot, tra.et, a.nd parcel of land fronting and
abutting on said porti�n of' said street, ir� �.ccordance �rith the provisions
of this ordinance.
Sr,CTI0D1 b. Upon the filing of such report by the City �n�ineer, the City
Council shal.l exa.ar�:ine the same, _.nd if said re�ort be found correct, and the
total cost of said repairing and resurfacin� does not exceed 60 cents per
front foot on �.11 of the �ro�erty irontin� and abutting upon the said portion
of said street, the Council shail levy and assess a snecial tax 2.�ainst said
property iM accordance with said re�rt. Said tax bi1ls shall be sold for
not less than ttieir face value, and assi�ned by the Cit,y Clerk to any
purch�ser or purchasers thereof.
