AN ORDINANCE PROVIDING FOR THE FiEPAII3ING A1�ID RESURFACING OF TH'r�il S STREET
FftOM THE WEST LIN�, UF �dEST END BUULEVARD T� THE .EAST LINE OF LOUISIANA AV'r',NUE
AND PROVIDING FOR THE ISSUAAICE OF SPECIAL TAX BILLS IN THE PA�tENT OF TI-� COST OF SAME.
BE IT ORDAINID BY TIiE COUNCIL OF THE CITY OF CAFE GIRARDEAU, MISSOUftI, AS FOLIAWS:
5ECTION l. That portion of Themis Street in the City of Cape Girard�au,
Missouri, from the west line of West F;nd Boulevard , to the east line of Louisiana Avenue,
, the same bei.r�g rrlthin District No. 2 in the City of Cape
Girardeau, Missouri, as laid out and designated by C�mmission Form Ordinance No. 800,
passed and approved on the 23rd day of July, 1937, shall be repaired and resurfaced
in accordance with said Co�ni.ssion Form Ordinance No. $00, and is hereby designated
as Pro3ect No. 3-1�9 in said District AJo. 2.
SECTION 2. The following work shall be done: The existing concrete gutters shall be
repaired where necessary with asphaltic concrete, and any low places in the existin�
surface of the street shall be brought to the proper grade with asphaltic concrete,
the eatire surface of the existing asphaltic concrete pa.ve�►ent shall then be given tvro
(2) applications of approved asphalt or cut-back asphalt, each application not to exceed
0.3 gallons per square ya rd, and each application covered with approved crushed stone,
and rolled, stone applied not to exceed twenty�-five (25) pounds per square yard� per
application.
SECTION 3. Said repairing and resurfacing of said street shall be done by the Department
of Streets of the City of Cape Girardeau, Missouri, under the direction and supervision
of the City Engineer, so that the cost of such repairing and resurfacing shall not exceed
an amount equal to b0 cents per front foot of property fronting and abutting on said
partion of said street so improved.
S�CTIUN !�. An accurate account shall. be kept by the City r,ngineer of the cogt of said work,
including pay�nent at contract prices for any portiona thereof done by contract, and such
cost shall be defrayed by a special tax to be assessed in favor of the City of Cape
Girardeau, Missouri, against the property fronti.ng arbd abutting on said portion of said
�treet in the p�roportion that the linear feet of each lot or tract fronting and abutting
on said portion of said street bears to the total number of linear feet of all the
property fronting and abutting on that portion of said street so repaired and resurfaced.
SECTION 5. Upon the completion of said work the said City Engineer shall report to the
Council the total cost of said repairing and resurfacing of said portion oB said street,
the total nunaber of linear fee�t of property fronting and abutting thereon, and the
proportionate share of such total cost chargeable against each lot, tract, and parcel
of land fronting and abutting on sai.d portion of said street, in accordanca with the
provisions of this ordinance.
SECTION 6. Upon the filing of such report by the City Engineer, the City Council shall
examine the same, and if said report be found correct, and the total cost of said repair-
ing and resurfacing does not exceed 60 centa per front foot on a11 of the property
fronting and abutting upon the said portion of said street, the Cosancil shall levy and
assess a special tax against said property in accortlance with sai.d report.
SECTION 7. All ordinances and parts of ordinanees in conflict with the provisions
hereof are hereby repealed.
SECTION 8. This ordinance sha11 take effect and be in force from and after ten days
after its passage and approval.
