BE IT ORDEIIN.r.D BY THE CITY COUNCIL OF THE CITY OF CAPE GI:�D`�' U,
I�IISSOUNS, AS FULLOWS:
SE(:TION 1. rdH��AS, the Missouri Utilities Company is attempting
to im�ove and extend its electrical service in the western section of
the city, which wnrk will involve the construction of power lines along
Dunklin Street and Clark Avenue, east and south from the Dunklin Street -
C].a,rk Avenue intersection, and
S�CTION 2. WHEE�EAS, the City of Cape Girardeau, N;issouri, is
desireous of widening Clark Avenue, from New Madrid Street to Broadway,
and the i�iissouri Utilities Company, in consideration of a site for
the location of a transformer station, agr$es to re�wve all trees
on the right-of-way acquired by the city for the widening of Clark Avenue,
and to adjust the fences along said right-of-way to the satisfaction of
the adjoining owners,
SECTION 3. NOW, TH��b;FOrtE, the City Council does hereby authorize
the ma,yor to execute a quit-claim deed to thei�iissouri Utilities Company,
a corporation, fo� the following described real estate:
Part of Lot 17, of Niargaret �dalker�s Subdivision in Outlot 60, in
U. S. P. Survey No. 2199, described as follows:
Begin at a point on the south line of Dunklin Street, as said street
is shown on the plat of Foster-Col�belis First Subdivision, said point being
20 feet east of the eri�inal east line of Cla.rk Avenue; thence south parallel
to Clark Avenue 100 feet; thence east parallel to Dunklin Street 200 feet;
thence north parallel to Clark Avenue 100 feet to the south line of Dunklin
Street; thence west along the south line of Dunklin Street 200 feet to th e
point of beginning.
Provided always, that should the Missouri Utilities Company or its
assigns abandon the use of said property for the purposes aforementioned
same shall revert i.rr�ediately to the grantor.
SECTION 1�. This ordinance shall be in force and take effect from
and after its passage.
