BE IT ORDAINED BY '1'H� CITY COUPJCIL OF THE CITY OF C�P; GIR��RDEAU,
�ISSUURI, A� FGLLOVIS:
SECTION 1. That commission form ordinance No. 1020 passed and
approved by the city council of the City of Cape Girardeau, Missouri,
on the lOth c�ay of �uly, 1945, be and the sarne is hereby in all thin�s
repealed.
SECTION 2. That from anc� after the effective date of this
ordinance it si1a.11 be unlawful for any person, firr�, association or
partriership to sell, distribute or give away within the City of Cape
Girardeau, P�iissouri, any firecrackers, fireworks or similar explosives.
SECTION 3 . That from and after the effective date of this
ordinance it shall be unlawful f or any person, persons or group to
set off or dischar�e vsrithin the city limits of theCity of Cape
Girardeau aforesaid, any firecrackers or fireti�rorks. Provided, how-
ever, that the prohibition in this section contained shall not apply
to public demonstrations held and operated by public organizations
under competent supervision, but all such public demonstrations and
or�anized discharge of firevrorks shall be held only after obtaining
a permit from tne police departrner.t of the citv and furnishing to
su.cri police departrnent satisfactory eviderice that the discnarge of
sucn. fireworks will be conducted under conlpetent supervision and with
proper protection for the safety of persons and pro�erty.
SECTIOi� 4. Any person who shall violate any of the provisions of
this ordinance shall be deemed guilty of a misdemeanor, and upon con-
viction thereof, s'r�all be punishecl by ,a fine of not less than (v"P1.00)
Dollar and not more than One Hundred (��100.00j Dollars, together with
t'rie costs of prosecution� .
SLCTIUN 5. �ecause of the immediate and great danger to the person,
property, life, limb, health and safety of tY�e people and vehicles of
t�ze City of Cape Girard.eau, I�lissouri, an emergency is hereby declared to
exist and this ordinance shall be in full force and effect from and
after its passage and approval.
