thereof, at the entrance to which vehicular traffic from intersectinp

(o) PCILIC�, OFFIC��. - Every officer of the i�:unicipal Police
Department or any officer authorized to direct or reQula�e traffic or
to ma.ke arrests for violations of traffic re�ulations:

included within the connections of the l�,teral lines of the 5idewalks on
opposite sides of the street or hi�hway measured from the curbs, or in
the absence of curbs, from the edges of the traversable ro�dway.

S�TION 2 - It is unlawful, and, unless other��rise declared in this
Ordinance with respect to narticular offenses, it is a mis�emeanor for
any person to do any act forbidden, or fail to perform any act rec,uired
in this bill or Ordinance. -
SLCTION 3 - It shall be the duty of the officers of the Police Department,
or such officers as are assi�ned by the Chief of Police or City Niarshall,
to enfnrce all street traffic laws of this Teiunicipa.lity and all of Lhe
State vehicle laws anplieable to street traffic in this city.
S�CTION t� - No person shall willfully fail or refuse or comnly z�rith a_ny
lawful order or direction of any po)_ice officer invested by law T.�rith
authority to direct, control, or regulate traffic.
Sr.CTIOPd 5 - The provisions of this Ordinance shall apply to the driver of
any vehicie owned by or used in the service of the United States
Government, this State, County, or �,unicibality, or any other driver of
a vehicle, and it shall be unlatarful for any said driver to violate any of
the provisions of this Ordinance, excer�t as otherwise percc�itted in this
Ordinance, or b?- State statute.
SECTIOPd 6 - Speed Limits:
(a) Every person operating a vehicle on Kingshighway ma,rked
U. 5. Highway N o. 61 as it now exists arithin the cornorate limits of
said City as established in 1947, in the l�iunicipality of Cape Girardeau,

Cape Girardeau Connty, N�issouri; shall be so controlled as, under the
conditions and hwvin� re�ard to the actual and rea.sonable for�seeable
hazards existin�; at the time and place sr,all be (1) reasonable, careful
and prudent, ancl (2) necessary so as not to endan;;er any person,
propert�r, life or limb.
(b) �ny speed of a vehicla in excess of the folloti�rinR {which
shall never be conclusive nor have the effect of shiftin; the burden of
proof) shall be considered as pri�iia facie evidence of drivina at a rate
of speed which is not careful, prudent and lawful:
(1) Thirty Five (35) miles per hour on Kingshighway
marked U.S. Highway �iot 61 as said Highway now exists within the
corporate limits of said City as established in lgt�'], whereon State of
Federal route markers, sions andfor official traffic control devices
have been nlaced or erected and traffic routed as a St�.te or Federal
H i;hway.
(2) Twent�,r fzve (25} miles pen c��ur on or over alI the
public streets, alieys, sta,te ri.�h�aa.�,s iv-ithin �he corpo�ate limits of
the I�iunicipality of the City of i;ap� �:�irard��;.u, ;•:;ssouri, except as
provi.ded in para�;ra�h (��) ��QV�.

SECTION 7. - By tt:is act U.S. Hi�hway No. 61 from the corporate limi.ts of
said City to the northwest and to the corporate limit� of said city to the
Southeast, and marked U.S, Highway No. 61 and know as Kingshiohway is
hereby declared a throu�hway and all traffic operating in the 1��unicipality
of Cape Girardeau, i�.issouri, shall coMe to a con�nlete stop before
operatin:? onto, or across said throuahway.
S�;CTION 8. - The driver of everf vehicl� shal3, consistent with the
req�zirements of Section 6-, drive at �;.n a�propriate reduced speed wt�en
approachin�; and crossing an intersection or railway �rade crossine;, when
approachin,7 and going around a curve, when apnroachin�; a hill crest, when
travelin� upon an,y narraw or winding roadvray, and wh�n sp�cial hazards
exist �,�rith respect to pedestrians or other traffic or by reason of w�ather
or Highway and street conditions.
SECTION 9. - The ;�tate Hi�hway Department is hereb�� authorized to deterir�i.ne
tI-iose portions of any State Hi�-hs.�ay �zthin the corpor�ut� ?imits of the
Niunicipality of Cape Girardeau, wher� overtaking and pa,ssin� or driving to
the left of th� roadway would be especially hazardous a.nd ma,y, by
ap-�ropriate si�ns or n�rkin�s, indic�.t� the beainning �nd end of "P;0
P��SING ZON1:;�", a,rid when such si�,*ns anc? markzn�s are in nlace and clearly
visible to an ordinaxirily observant person, every driver of a vehicle shall
obey the ctirections theraof.
SECTION 10. - No vehicle shall be turned so as to proceed in the opnosite
direction upon any curve, or upon the apnroach to, ar near the crest of
a grade, where such vehicle cannot be seer. by the driver of any other
vehicle approachin? fror.i either direction �,rithin 500 feet.
Si,CTION 11. - Na �erson shall start a vahicle which is sto�ped, standin�;,
or parked unless and until such rnov�r.icnt can be made wi�h reasonable safety.
S�CTION 12. - (a) No person shall turn a vehicle frorn a direct course upon
a Highway or public street unless and until sueh movement can be ma.de with
reasonable safetv and then only after oivinfl a cle:�rlv audi'ole si?nal by
sounding th�� horn if anf nedestrian may be aff�cted by such movement �r
after givin�; an apnropriate si�nal in the statutory manner in th� event anJ

{b) �': signal of intention to turn ri�ht or laft shall be �iven
continuously durin� not 2ess than tha last 100 feet traveled by a vehicle
before turning.
(c) No person shall stop or suddenly decrease the speed of a
vehicle without first r�iving an appropriate signal to the driver of any
vehicle immediately to the rear when there is ppnortunity to �ive such
signal.
Sr;CTIUN 12. - The driver of a vehicle shall stop as rea,uired by this
Ordinace at the entrance to a throu�h highway and shall yield the right
of way to other vehicle:s which have entered the intersectian from said
through highway or which are a�proaching so closely on said through
highway as to constitute an immediate hazard, but said driver having so
yielded may proceed and the drivers of all other vehicles approaching
the intersection on said through highV�ay shall yield the ri�ht of way
�o the vehicle so proceedin� into or across the throuFh hiPhwag.
(b) The drive� of a vehicle shall likewisa stop in obedience
to a Stop sign as reouired herein at an intersection t�rhere Stob signs are
erected at one or more entrances th,,reto, althou�h not a pa.rt of a
through hi�hway and shall proceed cautiousl„v, yieldin� to vehicles not so
obliged to stop which are ��rithin the ir.tersection or apnroachinp so closely as to
constitute an irrr,ediate hazard, but m�.�r then �roceed.
SiCTION 13. - (a) l�ny oerson who drives any veh.icle in w-i.11ful_ or wanton
disre�ard for the safety of persons or nroperty is guilty� of reckless
drivin�.
(b) Lvery person convicted of reckless drivZna sha11 be
punished upon a first conviction by imprisonment for a pe:riod of not less
tt.an 5 days nor Yzore than 3Q days, or by fine of not less tran �25 or
more than (;j100), or both such fine and imprisonment.
SECTION 14. - Pedestrians shall be subject to traffic control signs,
sipnals, markings and d�vices at all intarsec�ions, as heretofore declared
in this ordinance, but at all other places pedestrians shall be accorded
the privileges and shall be subject to the rastrictions stated in this
ordinance.
SiCTION 15. � (a) �,very pedestrian c:ossinQ a roadway, at any poi,nt other
than within a marked cross walk or �,rithin an ur�na,rked cross walk at an
inters�ction shall yield the ri�ht of way to all vehicles upon the roadway.
(b) Pedestrians shall not cross a nublic street or highway
at any placa except in a marked crosswalk o� a� markec� or uivnarked crosswalk
at an intersection: � .
The City Council •does hereby establish a crosswalk far pedestrian
traffic runnin� East and !�Jest on I�iain Street, which cross�r�.lk shall �e
located Two Hundrzd Twent y Five Feet North of the North Line of Independence
Street, and a cross walk running North and South on Good Hope Street at
the alley running North and South betw�en J�T'1Qa Straet and Frederick Street
in the City of Cape Girardeau, �.issouri.
Sr;CTION 15. - (a) 'idhere sidewalks are Provided it sha13 be unlawful for any

Sr,CTION 17. - Notwiths�anc3ing the foreaoin� �rovisions of this ordinance,
every driver of a vehicle shall exercisa due cara to avoid colliding with any
ped�strian unon any roadway and shall �ivc warning by sounding the horn when
necessary and shall exereise proper precaution upon obs�rving any child or any
`ged, confused or incapacztated person u?�on or crossin.�; z. roadway.

S�;CTIQN 1$. - Upon ar�y hi�hway outside of a business or residence district,
no person shall sto�a, park or leave standinb any vehicle, wheth2r attent�d
or unattended, upon the paved or i..ain traveled �x.rt of the hi?h:�ajT �,rhen it
is practical to stop, ,r�rk or so leave such vehicla off such p�rts of said
highway, but in every avent an unobstructed V,ri.dth of the lzi�hw�y- op;;osite

a cl�ar view of such stopped vellicle sha21 be available froz�� a distance of
200 feet in each direction upon such hi�?hway.
SLCTIUN 19. - (a) No person shail sto�, stand or park a vehicl�:, �ccept
