There is hereby established a Division of the Health i�epartment cf the City of Cape Girardeau� I�Iissouri, �rhich shall be known as the Division of Tvleat Inspection. Sucn Division shall include a Chief Inspector, who shall be a qualified veterin- a'rian� and tWo (2) Assistant Inspectors, who shall devote all of their time to their positions, and such other Inspectors as may frcm time to time be appointed. The officers and employees of such Division sriall be appoin�ed by the City Council and shall serve at the pleasure of the City Council. �-- - � , SECTION 2. TYie Chief Inspector shall train and supervise the ��\ Assistant Ir�specters of the Division. He shall supervise the work � oi the Division ancl he and the said Assistants shall be responsible �' for the anf'orcement of this Ordinance. The Chief Ins�oector shall be available at all tir�es to inspect any carcasses suspected or ques�ioned by the Assistalzt Inspectors and retained for final in- spection. �lhe CY�ief Inspector shall be on a fee basis, and shall receive � ��° f or eacn inspection of a suspected or questioned carcass. �ach of the ,�ssistant Inspectors shall receive �� /s'o `�_ per r�onth� payable in equal semi-monthly payments. Each of the �� Assistant Inspectors shall prepare a monthly report to the City Council of tne work of the Division� including tiie nutnber and kind of animals and carcasses inspected ; the number and kind thereof condemned ; and the fees earned and collected by t�e Division. The report of each �ssistant Inspector shall be approved by the Chief Inspector before being for�rarded to the City Council. SECTION 3. No person shall sell� or offer for sale 1'or human f ood� the flesh or meat food products of any cattle � calves � sheep� swine, or goats, unless the same shall have been slaughtered or processed under the supervision of a United States Government In- spector in accordance with the regulations of the �Tnited States Department of Agriculture � or under the supervision of the Division of PJieat Inspection of the City Healtn Department� as pravided in this Ordinance. SECTION 4. No person shall sell� or oifer f or sale f or human food� Zvithin the City of Cape Girardeau� the flesh or meat food products of any cattle � calves� sh�ep� sc�iile� goats� or other animals� unless there has first been placed on each primal thereof, or on the package or container tr,ereof� under trie supervision o� an Inspector of' �Lhe Unii;ed States i;epartment of Agricalture � a mark� stamp, label or brand shovrir�g that the same has been inspected and passed f or food purposes by the United States Department of Agri- culture� or under the supervision of an Inspector of the Division of t.�eat Ins�ection of tl�e City Iiealth Department, a mark� stamp� label or brand shovling that the same has been inspected anct passed for food purposes by the Division of P.�eat Inspection� together �Tith the number of the Inspector who passed the sarr,e. � . . . . SECTION 5. The proprietor or operator of each abattoir� slaughtering, packing, meat canning, rendering� or other establish- ment engaged in the slaughtering of cattle, calves, sheep, swine, goats , or other ani�als, or in packing, canriing or other process- ing or preparation of any f ood products into �vhich meat or meat products of any of said anirnals enter f or human f ood to be con�umed in the City of Cape Girardeau� ;,�issouri� shall make application in writing to the City Clerk for a permit to operate or engage in such business or occupation. Such application shall state the location of sucri establishment, the name and adress of the owner, and if such be a non-resident of the City� the name and address of �he local rnanager or agent of such ovrner? the kind of animals slaughtered� the days and hours of slaughtering, an estimate of the number of animals slaugY�tered per day� the character, quantity and proposed use or disposition of tYie products of said establishment� and such other infornlation as the City Clerk may� at the direction of the Division of 11�eat Inspection� require. Upon the filing of such application� the Division of Meat Inspection shall inspect such establishment, and if the same shall be found to comply with the provisions of this Ordinance relative to construction� equipment and cleanliness� a permit shall be issued authorizing the operation of such establishment. Such permit shall expire on the 31st day of Deceniber next following the date of issue, and may be renewed annually� if approved by the Division of �Zeat Inspe�tion. This Section shall not be construed to prevent producers from butchering at home� stock raised by them as provided in �ection 6 of this Ordinance. SECTIGN 6. Carcasses of animals �ahich are the product of? and have been raised � cared f or and fed by the producer, and killed upon the f arm of the producer� outside the City� f or the purpose of being sold for human food withir� the City� shall be ofiered for in- spection at such place as shall be designated by the Division of n!ieat Inspection, v�ith the head� heart, liver and lungs attached, or properly iaentified. Persons desiring such inspection shall notify the Chief Inspector so that adequate opportunity nay be had to inspect such carcasses by daylight. If , upon sucYi inspection, suci� carcasses shall be found to be free fro� disease� arid other- v��ise sound and fit for human food, i�hey shall be �:assed and so stamped or labeled. All carcasses offered for sale during �pril� ;I�ay, June, July� August or September shall be refrigerated at least twelve hours before being so offered f or sale. SECTION �. An ante-nortem inspection shall be made of a11 cattle� calves� sheep� swine� goats� and other animals intended for slaughter� except �hose mentioned in Section 6 of this Ordinance� at a well-lighted pen or place accessible to the slaughtering establishr�ent . TJo such animal shall be slaughtered which is not passed at such inspection� and all animals showirlg symptoms of any disease or condition �vhich would probably cause their condemnation for human use when slau�htered, shall be marked by the Inspector as "Suspect" � and all such animals shall be slaugYiterEd separately. SECTION 8. A post-mortem inspection shall be made of all anim�als mentioned in this Ordinance at the ti�e of slaughter. The head� tongue� tail� thymus gland� viscera� and alI parts and blood used in the preparation of f ood or medicinal prociucts , shall be retained in such manner as to preserve their identity until in- spected. Suitable racks, or metal receptacles, shall be provided f or retaining such parts. If such carcasses shall be found to be free frnm diseasei and otherwise sound and fit for human consurnp- tion� same shall be passed and so stampeu or labeled. Any lesion� - disease, or other condition f ound� shall be judged in accordance with the regulations of the United utates Department of AgriculturE. Carcasses and parts thereof held for final inspection shall be marked or labeled by placing on such carcasses, or parts thereof� a tag bearing the v�ords "Inspectsd �ut Retained" . No persons other than an authorized ir.spector of the Divis�on of lu2eat inspection shall rerilove such tag. SECTIOid 9. No animal shall be a?�proved as suitable f or human food when it is suffering fro� any disease or injury ��hich causes a feverish conaition� or when it is badly bruised or injured� or shovrs tumors� abscesses, or supperating sores, or when it is emaciated or too weuk to produce wholesome food� or the carcass of any unborrl animal, or any calf v�eighing less than f ifty pounds when dressed� or any carcass of any animal �rhich aiter killing shows a greenish yellovr discoloration� or i,he carcass of any anir�al which died from accident or disease, or tivhich has not been properly killed and bled. SECTION 10. Pdo person shall sell� cr cffer for salF� for human food any cattle� calves � svaine, sheep or goats, or any part the'reof� which has been condemned by the Division of P.Ieat Inspection� or by the United S�ates Department of Agriculture. S�CTION 11. The slaughtering of all animals in establishments operated under the provisions of this article� shall be conciucted on week-days betvJeen the hours of 6 :30 a.m. arid 5:00 p.m. � except in cases of emergency� when permission to slaughter may be granted by the Division of T�ea� Inspection� or in case of injury or other extraordinary cases when it is necessary to kill ani��als outside established hours . In such cases the carcasses of all sucn animals� with the viscera attached, and all other parts identifiable� shall be kept and held for inspection. SECTION 12. Any perso�z holdir.�; a perinit under this Ordinar,ce, and desiring to slau�hter any cattle� sheep, goats � stivine, or other animals to be solu for human food in the Cit� of Cape Girardeau, shall give notice thereof to the Division of T,�eat Inspection� or an authorized inspector thereof � at least 24 hours beiore such slaughter- ing is to take place. ine person in charge of the slaughtering at suc�i establishment shall notify the Division of 1dleat Inspection� or an inspector thereof, at tfie close of each day at what time on the following day tne �vork of slaughtering will be comraenced. If no slaughtering is to be done on the following day, then notice snall be given at what time the vaork of slaughtering will be resumed. SFCTIOi� 13. 1�11 meat� or meat food products� sold� or offered f or sale for human food in the City of Cape Girardeau� shall be subject to reinspection at any time by the Inspector of the Division of ireat Inspection. AIl fees so collected shall be paid to trie City Collector. The Chief Inspector of the Division shall make, or cause to Ue made! a record of all fees collected� which snall show the name of each party f or whom the inspection was �ade, the kind of ineat inspected� the amount collected, ana whether the �eat �ras rejected or approved in each case . A copy of such record shall be includEd ir. the �onthly report of the Division filed w�th the Cit;y Council. S�CTI0�1 15. No permi� shall be issued under trie provisions of Section 5 of this Grdinance , unless the establishment for which said perinit is issued has a killing room, a chill room� or cold storage and refrigeration room, or both� a reduction plant and pens� complying with the following requirements : (a) The k:illing room shall be adequate in size. The iloor shall be of concrete not less than 4 inches thick� so constructed as to aff ord perfect drainage, atzd connected with a 8ewer with such connection sealec� by means of deep seal 'oack v�a�er traps. It shall be provided with hot ancl cold water� a tank for scalding animals, to- gether with ample hose� runways and r^rinalasses by which animals slaugYitered can be raised and lotivered. It shall be amply equippEd with buckets� tubs and other utensils ana devices into vThich the blood, off al and refuse shall be placed and removed to the reduction plant imriediately f ollowing inspection. The walls� ceilings and parti- tions shall be of material which can easily be kept clean and sanitary. All apparatus� tools� knmves and cleavers shall be ke��t perfectly clean. The killing room shall '�e provid.ed witYi cuspidors, lavatories, and individual towels . All outside openings shall be ade- quately screened. (b) The chillir�� room sha11 be of adequate size and connected with a sewer with tYie cor�nection trapned as provided in the foregoing paragraph� and constructed in such manner as to secure perfect drainage . The walls, partitions and ceiling shall be thoroughly insulated� and �quipped to condense vapors ana trip the sar:ie into the sewer. The construction and equipment shall '�e such as to pro- vide constant ter�peratures approximating not rnore than 40 degrees f ahrenheit. It shall be sufficiently high to permit all animals to be hung from trolleys, or other- wise hung clear of the floor. (c} Cold storage anci refrigerating rooms� if such are pro- vided separate from and in addition to the chilling room� shall be of adequate size, and connected with a sev�er as provided in the preceding paragraph oi tnis section. T�iey shall be auequately lighted. Trle walls� partitions and ceilings shall be thoroughly insulated and constructed in such mar�ner as to produce dry refrigeration� and said construction and equipment shall be such as to inaintain an average ternperature of not more than approximately 3$ degrees f ahrenheit. The walls, partitions arid floors • shall be kept perfectly clean. : � . . (d) The reduction plant shall be of adequate size� and equipped with pu�nps� engines and machinery of sui f icient size and capacity for ttie odorless disposal of all off al� blood and residue resulting frorn the slaughter- ing of animals. The rooms in which tankage and tallow are removed from the reduction plant shall be of ade- quate size, and the floors thereoi shall be constructed of concz°ete not less than 4 incnes thick� ana connected with a sewer by connections adequately trapped, and shall be supplied with water in such manner as to secure perf'ect drainage. The floors oi t'rie rooL� in which rEfuse is handled ana placed in the reduction plant shall be of concrete at least 4 incYies thick� and shal.l be kept clean arid in a sanitary condition. The products taken from such plant shall be only finished products . (e) Pens shall be adequate in size , and shall be kept in a clean and sanitary condition. SECTIOiV 16. The following rules shall be observed in tne operation of the establishment for rvhich a permit is issued under this Ordinance : (a) The handling of animals shall be as f ar as possible by mechanical means, and v�ith the r:�inimum of' contact with human hands . (b) Any meat which is lai�3� or shall fall on the floors� shall be conderaned� or soiled portions thereof shall be liberally removed by tri:r�aing, and such trim�:lings con- d emne d. (c) All off al and ref use from slaughtered animals shall be reduced within 12 hours of slaughtering� unless otherwise directed or required by trie Inspectors. (d) No animals intended f or slaughter shall remain in the plant� or ira��ediately adjacent thereto� more than 24 hours, without the permission cf the Inspector. (e) No calf less than six weeks old� no pig less t�^,an five weeks old� and no lamb less than eight weeks old shall be killed f or hunan f ood. (f) Employees wYio dress or riandle carcasses, or parts thereof� f oun� to be diseased� or which have been condernned� shall cleanse their hands thoroughly and imr�erse them, i� a prescribeci disinlectant and rinse them in clear �vater bef ore again dressing or handling carcasses� or parts thereof, intended f or human iood. Al1 tools, or imple- ments� used in dressing diseased carEasses� shall be sterilized eithei° in boiling water� or by iinmersion in disinfectant� f ollowed by rinsing in clear water before being used �n any carcasses� or parts thereof� intended f or human iood. All persons� and all tools ana equip- ment co�r�ing in contact �vith carcasses or r�c:at intended f or i�uman f ood , shall be rriQintained in a clean, sanitary condition at aIl times. (g) Carcasses s'riall not be inflated with breath from the �outh� or in anaT other manner than by mechanical means � . � . ; . - . . using air only. Carcasses shall rlot be dressed �vith irnplements that have been held in the mouth. Spitti-�g on whetstones or steels when sharpening knives is prohibited. (h} Only pure �vater from an approved supply shall be used in the prepar�ation of carcasses, or parts thereof . (i) Each carcass shall be kept in the chill and refrigera- ting rooms at least I2 hours before delivery to the owner� or before being offered f or sale. (j ) Vehicles in which meat is transported or delivered sllall be so constructed and covered that the contents shall be kept clean and fly and dust proof. (k) i�o dogs, or other similar animals , shall be allowed to enter any room or place where meat or meat f ood products are slaughtered� processed, riandled or stored. SECTION 17. Any establishment f ailing to observe the rules provided in Section 16 for the operation thereof after notice from the Inspector, or ottierwise violating the provisions of this Ordinance� may suffer revocation of the permit issued under tne provisions of triis Ordinance. SECTION 18. Any person violating� or failing to coniply with any provisions of this Ordinance� or def acing� or simulating� or counterfeiting any city label, mark or brand on ariy meat or meat products , shall be guilty of a misdemeanor, and upon conviction thereof shall be f ined r�ot inore than �100.00 f or each such off ense . SECT_IOIvT 19. Al1 ordinances and parts of ordinances in con- flict with the provisions hereof are hereby repealed. SECTION 20. This ordinance shall take effect and be in force from and after ten days after its passage and approval.
