PRIVATE PR�ISES INTO THE SEW�RS IN SEWER DIS-
TRICT NTJ�[BER SIX AND PROVIDING A PENALTY

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
i�k�,nEAU, �iISSOURI , THAT
SECTION 1; From and after the effective date of
thie ordinance it shall be unlawful for any person, firm, asaocia-
tion, co-partnership or corporation owning, leasing, renting or .
bein� in, os�esaion of any property, within the limits of Sewer
District � 6 of Cax�e Girardeau, l�issouri , to empty or discharge intq
the sanitary seWer system now and hereafter existing in said Sewer
Distriet �6, any rain, surface or storm water including the rua-eff
from rcoPs of bui-lding$ and paved surfaces so owned, leased, rented
or possessed by said pereons, firms, associations, co-partnershipra
and corporatione.
SECTION 2; It shall be unlm�f ul for any person,
firm, association, co-par tner�hip or corporation hereaftier con-
structing, erecting, re-mo�eling or repairing any building within
the limits of said Sewer Di$trict �6 to so arrange the $ame that
the surface water falling and collecting on the roof of such build-
ing or buildings shall drain �nd empty into the sanitary sewer in
said Sewer District �6,
SECTI�N 3; Any person, firm, association, co-
partnershin or corporation violating any of the proviaions of this
ordinance shall be deemed uilty aY a misdemeanor and punished by a

�$100.00) dollarra or by imprisonment in the city jail for not less
than five (5) days or more th�n three (3) months or by both such
fine and imprisorunarst.
��� 5ECTION 4; It shall be the duty of ariy person in
_ charge of any premisee v�ithin said Sewer District #6, upon being
notified in writing by the �epartment of Streeta and Sewera , to
immediately correct the condition of the premises in his posseeaion
so as to prevent the draining, and emptying of aurface or etorm
water into the said system of sanitary sewers. On the failure of
said pers on to so c orrec t the c ondi tions wi thin f ive (5) daya af ter
being notified aa herein provided, said conditions shall be deemed
a nuisance and eubject to bein� abated as provided in the ordin�nces
of thia city relative to nuisa.nce�. Failure to correct such condi-
tion within a period oP five (5) days after such notiee, $hall con-
etitute a separate offense punishable aa in the next prece3in� �ec-
tion provided.
' SL*CTION 5; Thie ordinance ehall take effeet and be
in fa���.-�en ( 10) days after its passsge.
