�HER�AS, the grade of that portion of �ain Street, Independence
Street, Spani�h Street and the al�ey between �ain and Spanish Streets
descri'oed in this ordinance, has never been establiehed by law or
ordinance, but such $treets and alley -hane been improned, msintained
and u�ed at the exi�tin� grade for many years, and .
'adHEREAS, the interested owners of abuttin� property have petitioned
the council to establish by ordinance a new grade for s�id portions of
said atreets and alley for the purpose of bringing such portion� of
said streets and alley above anticipated flood stages of the �ississi�pi
RiVer . NOW THEREFOR�,
BE IT OR�3AINED BY TH� C,ITY COUNCIL OF T� CITY 0� CAP� GI�RD�AtJ ,
�!'iISSOURI, AS FOLI�O�'aS:
SECTION 1. The grade as 3etermined by the f ollowing e lvat�dn
above Biloxi or �ie�,n t�ulf 39atum is hereby establiahed as the grade for
Main Street from the south li�e of Themis Street to a point 180 feet
south of the $outh line of Independence Street , Inde�endence Street from
the west pr�perty line of ���Vater Street to a point 130 feet west of the
west line of Spanish Street, Spanish Street from a point 169 feet sauth
mf the south line of In�.ependence Street to a point 15G feet north of
the north �ine of Inde�endence Street and the alley between Dr�ain and
Spani�h Strc=et� from a point c20 feet south �f the south line of Themis
Street southwardly to the end of said alley.
1. �pIN STRE�'T: Begin at an elevation of 348.35 �t
a poin� 69.7 feet south of the south line of Themis Street,
whieh is the elevation of the exi�ting curb; thence on a
descending grade of 0.251 per cent to an elevation of 347.35
at the north line of Independence Street, which elevation$
apply to the west �ide of the stxeet. Also, begin at a
point on the south line of Themis Street at an elevation
of 348.16, which is tre elevation of the exi�ting cura ;
thence aouth a distance of 69.7 feet to an elevation of
348.35 ; thence on a deecending grade of 0.�51 per cent, to
an elevation �f 347.35 at the north line of Independence
Street, which elevations apply to the east side of the
street. Also, begin at a point on the south line of Inde-
pendence Street, at an elevation of 347.1; thence �outh on
a descending grade of �.86 per cent a distance of 180 feet
to an elev�tion of 341.96 at the intersectxon with the ex-
isting curb, which elevations app].y to the west side of the
street . Al�o, b egin at an elevation of 344.85 at the south
�ine of Independence Street ; tYaence south wi th a descending
grade of 1.9� per cent, a distance of 148 feet to an eleva-
tion of 34� .0 which is the elevati on of the existino curb,
v�hich elevations appl;� to the east side of the 9treet.
� . INDEP�NDENCE STR�Tt Be�in at the u�est property
line of '�ater Street , with an elevation of 339 .52 at the
elevation of the existing cufrb; thence west with an ascend-
ing grade of 5 .66 per cent a distance of 1�5 feet to an
elevation of 346.60 ; thence with a vertical curve to an
elevation af 347.00 at the east line of �iain Street, which
elevations apply to the north si�e of th e street, Also,

begin at an elevation of 340 .12 at the existing curb at
th e �est property line of �ater Street ; th ence west with
an ascending �rade of 4.95 per cent , a distance of �4 feet
to an elevation of 344.�8 at the east property line of
Main Street, which elevations apply to the south side of
the street. Also, being at an elevation of 347.35 at tr e
west line of �ain Street ; thence west on a level �rade to
a� elevation of 347.35 at the east line of Spanis�! Street,
wrich elevations a:Nply to both sides of the etreet . Also,
begin at an elevation of 347.35 at the west line of Spanish
Street ; thence west on an ascending grade of 0. 5 per cent
a �istance of 110 feet to an elevation of 347. 90 ; thence
alang a vertical curve a di�tance cf' �0 feet to an eleva-
tion of 348.30 at the intersection v�ith the existing curb,
wrich elevations apply to both sides of the street.
3. :�PANIS�? STRE:�'T: Begin at an elevation of 347.�0
at the south line of Independence 3treet ; thence south on
a descending grade of 1.48 per cent a di�tance of 169 feet
to an elevation of 344. 70 at the existing curb, which
elevations a^ply to both sides of the street . Also, begin
at an elevation of 347.35 at the north line of Independence
Street, thence north on an ascending �rade of 0.78 per
cent to an elevation of 348.24 at a point 113 feet north of
the north line of Independence Street, at the intersection
with th e existing curb on the��we5t side of the 3treet, and
on an ascendin� grade of 06�6 per cent to an elevation of
348.35 at a point 150 feet nortr of the north line �f Inde-
pendence Stre:�t, at the intersection with the exi�ting curb
on the east side of the s treet.
4. ALIwY BET�N�'EN NIAIN AND SPANISH STRE'_"TS, FROP� TH�IS
ST�EET �0 A PCINT 100 F�,'ET NORTH OF THE �TORTH LINE CF INDE-
�END'EIvTCE STRE�'T: Begin at a point on the center line of
said alley, �20 feet south of the south line of Themia Street,
at an elevation of 347.0; thence south with a descending 5rade
of 0 .70 pe� cent, a distance of 143 feet to an elevation of
346.0 on the center of said e lley, at the end of sai � alley.
SECTION 4 . The Cit;� Attorney sha1� institute in the name of t��
City� appropriate proceedings under article �, Chapter 38, Revi$ed Statutea
of �dissouri 1939 , to ascertain the dama�es accn�zing to o�rners of property
as a result of the estab�.ishment of the grade hereinabove provided and
report to the City Council the amount of such damages prior to any altera-
tion in the exi�ting grade of such streets and alley, or any of them.
SECTION 3. Wh�n such damages have been determined accordin; to
law, if the petitioning property owner� shall pay the same or provide the
City with funds for such purpose, then such streets and alley shall be
improved by bringing the same to the grade herein established.
SECTION 4. No work shall be done to bring said portions of
said streets and alley to the grade hereby established until and unless
all damages accruing to any person therefrom 9h all be first ascertained
a nd paid.
B.ECTION 5. All ordinances and �art� of ordinances in c�nflict
witn tbe provisi�ns hereof are hereby repealed.
SECTION 6. This ordinance sh all take effect and be in force
from and after the expiration of ten days after its paseage.
