OF-WAY OF PERRYVILLE ROAD AND AUTHCRIZING THE B3iiAAY�R
TO EXECUTE AND DEI�I VER A QUIT CIrAI� DEED TO TYE
I,,AND THUS VACATED.
�REAS, the Perry�€ille Road in the City df Cape Gir�rde�.0
has existed for many years , but there �as been considerable doubt
as �o the legal dedicy tion tk�ereof; and
�tiHEREAS, a certain portion of said road has recently been re-
located �nd the ovsners of the abutting property have r eretofore
executed and delivered their deed to the City of Cape Girardeau
for such new right-of-way which definitely established the right-
of-w�ay and limits of said Perryville Road at such points, but vchich
omits and eliminates a portion of the right-of-�ray Pormerly used
for such Perryville Road; and
�h'HLREAS, it is desired by all parties :concerned that the
rights of the abutting property owner$ should without question
extend to the limits of said Perryville Road as now located and
established; and
�I3EEREAS , within the abandoned portion of such right-of-w�,y
there is novr located a v�ater main and possibly other utilities
lines of the �dissouri Utilities Company which all parties agree
may remain as they now are. NO�N THEREFORE
BE I T CR]�iAII�'ED BY THE C ITY C CUNC IZ OF THE C ITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLC74'�Ss
�CTIGN 1. That portion of the old and former right�af-way
of the Perryville Road in O�tt Lot 74 of U . S. P. S. No . 2199, lying
east of the east x�ight-of-way line of the right-of-vray conveyed
to the City of Cape Girardeau, �+tissouri by David Shaltupsky and
wiPe by deed d ated �une 12, 1941 and recorded in Book 45 at page
627 of the dee� records of Cape Girardeau County, �iis�ouri , shall
be and is hereby vacated as a public street.
SECTION 4. �e �ayor of the City of Cape Girardeau ie
bereby authorized to execute�:and deliver to Joe Grant and wife a
quit claim deea for the land vacated by Section 1 of this Ordinance,
reserving by such deed the easement or pri�riiege for �aintaining
the v�ater main over and across said tract.

SECTION 3. �his E}rdin�nce shall take effect and be in force
from and after its passage. �
