`�THEREAS by 4rdinance No . _�� passed and approved on the
„���� day of Au;ust , 1944, the roadway of that portion of
�:�uiszgna Street in the City of Cape Girardeau , �iss�uri., from
the enu of the existing asphaltic pavement at Cousin Street t�
the north line of Jeffer�a�n Street was ordered repaired and resur-
faced by reshapin� and grading +he existing �ravel base tnereon
and installing on the base so shaped and repaired, an asphaltic
conerete pavernent twenty feet in v��idth and not less than one and
one-ha lf inche s in th ickness ; and
u1H�REAS, saicl work has been done by the Street Department of
the City of Cape Girardeau, �:issouri under tne direction and
supervision of thc City �ngineer, and
`:','HE�4i:;AS, John R. �Valther , City Engineer , has heretofore filed
Y is report shov,iin� the total cost of repairing and resurfacin� said
portion of said street to be �371.70, the t�tal na�ber of linear
feet fronting and abutting thereon to be 61� .5 feet , and the cost
per front foot to be 60 cent�, and shov�ing the proporti�nate share
of such �otal cost char,�eable a�ainst each lot , tract and parc3el
of land fronti:�g and ,abutting on said oortion of said street ; and

found to be in proper form and the Council finds that the total
cost of said repairing and resurfacin� does not exceed sixty cent�

S�CTION �: That the Counc�.l finds �aid report to be �orrect
and furthPr finds th�t the total costs to the abutti.ng property
owners of the repairing and resurfacing of said �ortion of said
Loui3iana Street does not exceed sixty cents per front fcot on the
property fronting an� abutting on said portion of said street .
SECTION 3: A special tax is hereby levied and asses�ed a�ain�t
all of the property fronting and abuttin� on s�id ,�:ortion of said
street in a sum equal to eixty ;,°enta per front foot , the names of
the oti;ners , the description of tre properties , the num�er of front
feet t'r.ereof a.nd the amount of special tax levied a�ain�t each parti-
cular lot, tract and parcel of lancl fronting and abuttina on said
portion of said street being as follows:

SECTION 4: Specia.l tax bills in the amounts set forth in the
preceding section sh�l,.l be issued by the City Clerk again�t said lots
tracts and parcels of land respectively, which said special t ax bills
sh�ll bear interest at tre rate of 8� per annum from their date . and
shall. constitute a first lien upon the property therein described,
and shall continue in force for a period of five years after their
date unless sooner paid, and in the event suit i3 brought v�-ithin such
tir�e to en�orce such lien, then said tax bills shall continue in
force until the expiration of such litigation. Said special tax
bi11s shaZl be is�ued in favor of �e City of Cape Girardeau, ��issouri,
and :nay be �ssi�ned by said city, he city or the ow-ner ar holder by
as�i�nment of such special tax bills ma;� enforce the collection there-
of by action in any eourt of competent jurisdiction. Such action '
srall be brougbt in the name of and by the city for itself or in
the name of tre city at the relation and to the use of the ortiner or
holder by assi�nment of any auch special tax bills.
