AN ORDINANCE AMF�NDING COMMISSION FORTJI ORDINANCE
N0. 5�6, PASSED AND APPROVED QN THE �5th DAY OF
APRIL, 1929, BY AMENDI�G SECTION 10, SU�SECTIOPt
ENTIT_LLD �'FRONT YARD���O�ARAGRAPH NUM.BERED (1)
WHEREAS, the City Council of the City of Cape Girardeau, Missouri
did, on the 25th day of April, I.9�9, pass and approve Commission Form
Ordinance No. 566, which ordinance is commonly �own as the Zoning
Ordinance of said City; and
WHEREAS, said Commission Form Ordinance Ido. 566, by Section �3
thereof, do�s provide that the City Council from time to time, of its
ov�n motion, after giving at least fifteen (15) days notice and a pub-
lic hearing, may amend, supplement, change, modify, or repeal said
ordinance; and
WHEREAS, the City Council did, through the City Clerk, cause
notice of a hearing to be published, signifying the intention of the
City Council to amend Section 10, Subsection entitled �Front Yard�
and Paragraph numbered (1) thereof; and
UVHEREAS, proof of publication of said notice has been duly made
to the City Council, approved by it, and filcd v�ith the City Clerk;
and
WHEREAS, a public hearing �as held by the City Council on the
�9th day of September, 19�1 at �:3� P•M• in the Council Room at the
City Hall in said City; and
YVHEREAS, no protest was filed or made, as is provided for by
Section Z3 of said Commission Form Ordinance No. 566,

SECTION 1: That Section 10, Subsection entitled
��Front Yardr and Paragraph nurnbered (1) thereof of Commission
Form Ordinance No. 566, passed and approved on the 25th day of
April, 1929, be amended so that said paragraph shall read as
follo�s:
�(1) Where lots comprising forty percent
(�0�) or nore of the frontage are developed with
buildings, which buildings establish a building
line �ith a variation of not more than six (6)
feet in said line, no building hereafter erected
or structurally altered sh�l1 project beyond the
building line so established when extended, pro-
vided, further, that this regulation shall not
be so interpreted as to require a front yard of
more than one hundred (100) feet.�
SECTION :�: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
PASSED AND APPROVED this �9th day of September,
1941.
