AN ORDINANCE LEVYING A LICPNSE TAX UPON C�RTAIN
AMCTSEMEIJTS IN TI�'E CITY OF CAPE GIRARDEAU, MISSOURI
�` BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF Ckl'E GIRARD:i.tiAil,
� MISSOURI, AS FOLLOWS:
SECTIQN 1: The City Council of the City of Cape Girardeau,
Missouri hereby declares that the following are, for the purposes of
this Ordinance, decl�.red to be amusement�;
(a) Pin ball machines, which are defined as being any
machine which is operated by placing any piece of money,
coin, token, slug, or instrumentality of any kind into said
p� machine v�hereupon a ball or balls are released which ba11s
can then be pro�eeted or propelled by the operator or player
of sueh machine.
(b) Music machines or boxes, whicY� are defined as being
any phono�raph machine or any other machine into which can
be placed any piece of money, coin, token, slu� or instrur�en-
tality of any kind, and which upon the placing of any piece
of money, coin, token, slug or instrumPntality of any kind,
said machine plays a piece of music, whether accompaniec3 with
pictures or not, �rhich music c�n be heard by one or more per-
` sons, irrespective of whether persons dance to said music or
not.
(c) Any maehine of any kind or description set up by
any person, which machine can be played or operated by plae-
ing therein any pi�ce of money, coin, token, slug, or
instrumentality, and which nach3ne is set up in any place
for the public generally to use upon ir�serting therein any
piece of money, coin, token, slug or instrumentality for
the amusement or en�oyment of the person playing or using
� said machine.
�: SECTION �: There is hereby levied an annual lieense tax on - t
each of the amusements defined above the sum of TEN DOLLARS ($10.00)
per year for each such machine.
SECTION 3: The owner, lessor, renter, and each and every
person having any vf the machines def�:ned above, shall be liable �ointly
and severally for the lieense tax herein imposed for each such machine.
� SECTION !�: Said license tax shall be paid to the City Clerk�,r�.�`"
�' of the City of Cape Girardeau, and upon the payment of said license ; ;��'�
tax the City Clerk shall issue to the person paying said license tax ' �� �
a sticker upon which shall be printed a receipt showing the payment of ; `
said licen�e tax and the date of the expiration ther�of. ��'�•••=—^?�=_-�_

same sha11 be firmly affixed on the amusement so that the face of said
receipt shall be plainly visible.

SECTION 5: Said receipt shall �e be transferable i'rom ' « �
one m�.chine �o another, provided, however, that if the maehine is �� F;-F �
moved from plaae to place, the receipt shall go with the machine, �
and no additional license shall be required for said machine until
the expiration date of said receipt.
SECTION 6: The expiration date on said receipt shall be
filled in by the City Clerk or his authorized deputies, and by no
other person, and it shall be unlawful for any other person to mark
in any way the face of said receipt. ,
SECTION 7: It shall be unlawful for any person to have
any such machine on his premises capable of being used by any other
person without having affixed thereto the license tax provided for
herein, and any machine capable of being used by any person which
does not have affi�eed thereto the license receip� provided for here-
in may be confiscated and held by the Police Department of the City
of Cape Girardeau until the lic�nse tax is paid th�reon and all costs
incident to its confiscation are paid and all fines and costs which
may be assessed by the Police Judge of the City of Cape Girardeau
� against the own�r or the person upon whose premises the machine was
located are paid.
SECTION 8: The violation of any of the provisions of this
Ordinance shall be deemed a misdemeanor, and alI persons violating
the terms hereof sha11 be deemed guilty of a misdemeanor ar_d shall
be fined not less than Five Dollars (�5.OJ) nor more than One Hundred
Dollars (�100.�0) , and each day that any of the provisions of this
Ordinance are violated, sha11 constitute a separate and distinct
offense or misdemeanor.
