4 AN ORDINANCE DECLARII�G THE NEED FOR A
HOUSING AUTHORI2'Y AS DEFINED BY THE STATUTES
OF THE STATE OF MISSOURI IN THE CITY OF CAPE
GIRARDEAU� MISS�IIRI; AUTHORIZING THE APPOIIVT-
�ENT BY THE �AYOR OF THE COMMISSIONERS OF SAID
AUTHORITY; AIdD AUTHORIZING SAID HOUSING AUTHOR-
ITY TO FUNCTION IN THE CITY OF CAPE GIRA.RDEAU,
MISSOURI
�VFiEREAS, Sect3.ons 7853 to 7�75 af the Revised Statutes of
I�issouri, 1939, provide for the creation and establishment of a
municipal corporation to be �own as a Housing Authority in cities
and counties of certain sizes in the State of Missouri by the City
Council or County Court of such citi�s and counties; and
YVHEREAS, the Siaty-first General Assembly of Yissouri passecl,
approved and adopted Senate Bill No. 111, which bill contained an
emergency clause, a�d has been signed by the Governor of the State
of Missouri, whereupon. said bill beca.me effective immediately; and
WHEREAS, said Senate Bill No. 111 amend�d Article 36 of Re-
vised Stat�.tes of MiSsouri, 1g39 so as to make Sections 7g53 to
7$75 inclu�ive thereof applicable to cities having a population in
excess of 5,000; and
� ^ � WHEREAS, Section 7g56 of Revised Statutes of �[i�souri, 193y
provides that upon petition of fifty (�'r6) taxpayers of the city ask-
ing for a Housing Authority, the City Council shall determine Whether
there is a need for a Housing Authority in said city; and
` wFiEREAS, there has been presented to the City Couneil of the
� � City of Cape Girardeau a petition signed by fifty (50) taxpayer� of
A the City of Cape Girardeau, asking for the creation of a Housing
Authority; and
1N�REAS, Article ��, aeetions 7553 to 7�75 inclusive, Revised
Statutes af Missouri, 1939, now are applicable to the City of Cape
Girardeau by reason of the enactment of the Sixty-first General
Assembly of Senate Bill No. 111, it being a city in exeess of 5��00
g��.ulation,

OF CAPE GSRARDEAII,-MISSOtJRI, AS FOLLOWS:
SECTTON 1: �hat insanitary and unsafe inhabited dwelling
accommodations exist in the City of Cape Girardeau; that there is a
�hortage of safe and sanitary dwelling accommodations in said City
available to persons� of loW income at rentals which they can afford;
that there existsin the City of Cape Girardeau a condition of over-
crawding in population to the land coverage; that the light, air,
space and access available to the inhabitants of insanitary and
unsafe inhabited dwellings is insufficient; that the size and arrange-
ment of the rooms and sanitary facilities of many dwellings of persong
of low income are inadequate, and that conditions exist in such dwe11-
i.ngs which endanger life and property fire or other causes�, .�__

to serve for terms of one �3�', two �j", and thre� (� years respective7.y
from the date of their appointment, and,�two (�'f of the sa� Commissioners
shall be designated to serve for terms,�four (..1� years from the dat� of
their appointment. Thereafter said Commissioners shall be appointed
as a,foresaid for a term of four �'j years except that all vacancies
sha11 be filled for• �i� unexpired term. �-�

they shall thereafter be 1�o�m as the Commissioners of the Housing
Authority of the City of Cape Girardeau, and there is hereby created
a municipal corporation known as the Housing Authority of the City
of Cape Girardeau, which corporation shall function -

Yissouri as aforesaid and amendments thereto.
