��CT�ON 1. That porti0n of Nvrth '�Vest End Boulevard in the City
of Cape Girardea.u, T�iss�uri, from the north end of the present con-
crete pavement near Rose Street northwardly to the south linP af
Scott Street , the same being within District No. � of the City of
Cape Gira.rdeau, T�isso�ari, as la.id out and designated by Commissi0n
Form Ordinance No. 800 passed and approved on the �3rd day of July,
1937, shall be repaired and re-surfaced in accordance with said
Commi�sion Form Ordina.nce No. 800, and i� hereby desi�na,ted as
Project No. �_ in said Di�trict No. �_.
SECTION 2. The r0adway of said street shall be rep�ired and
resurfaced �y bringing the present gravel ba.se to grade and repairing
the same, adding crushed stone where necessary so as to prc�vide a
finished base of not less than faur (4) inches of cru�hed stone and
gravel, and constructing and layin� thereon a eta,ndax d 2-course
asphaltic concrete pavernent or surfacing not less than one and one-
half (1�) inches in thickness, twenty-' feet wide, as directed by
the City Engineer.
SECTION 3. �aid repairing and resurfacin� shall be done by
the �treet Department of the City of Cape Girardeau, �iis�ouri, under
the direction and supervi�ion of t�e City Engineer, and all assis-
tance that can be obtained shall be obtained from the C ape Girardeau
5pecial Rmad I7istrict, so that the total cost of such repairin� and
resurfacing to the City of Cape Girardea,u, �issouri, and the abut-
ting property owners , shall not exceed an amount equal to sixty ( 60�Z)
cents per front foot af property fronting and abutting on said por-
tion of said street so improved.
SECTION 4. �n accura,�e accaunt sh all be kept by the City En;in-
eer of the cost of said work, exclusive of such donation by and from
tk�e C a�e Girardeau Special Road District, and such cost shall be de-
frayed by a special tax to be assessed in favor of t� e City of Cape
Girardeau, �iissouri, on the property fronting and a.buttin� on s aid
portion of said street in the preportion that the linear feet of each
lot or tract frontin� and abuttin� on said ;�ortion of said street
bears to the total number ef linear f eet of all tY�e property fronting
and abutting on the portion of said street so repaired ann resurfa,ced,
S�'CTION 5. Upon �he completion of said v�:ork, the City Engineer
shall report to the Council the total cost of said repairing an� re-
surfacing e�f sai%� portion of said street, the total numb�r of linear
feet of property frvntin� and abuttin� thereon, and the proportionate
share of such total cost cha.rgeable against each lot, tract and par-
cel of land fronting and abuttin� on said portion of �aid street in
accordance with the pravisian� of this Ordina.nce.
S�'CTION 6. tTpon the filing of such report by the City L'ngineer,
the C ity Councmi sha.11 examine the saxne, and if sa,id report be found
to be correct an� the total cost of said repairing and resurfa,cing
exclusive of donations as above specified, does not exceed sixty (60�;
cents per front foot on all of tre property frQnting and abuttin� on
said partion of said street, the Council shall levy and a.ssess a �pec�
ial tax. a�ainst sa,id property in accordance v�ith saic� report.

SECTION 7. till Ordin�.nces and parts of Ordinances in conf lict
with the provisions hereof are hereby repealed.
SECTION 8. This Crdinance sha.11 ta.ke effect a,nd be in force
from and after ten days after its passage.
