PROVIDE FOR THE PUBLIC SAFETY OF THE INHI�F3IT�N25 OF

BE IT QRDAINED BY THE CITY�UNCIL OF THE CITY OF CI�PE
GIF�ARDFAU, �ISSOURI, AS FOLLOWS:
SECTION 1: Every house or building of any description whatsoever
constructed or erected within the territorial limits of the City of
Cape Girarcieau after the effect�ate of this ordinance shall have placed
thereon a roof of absolutely fireproof or non-combustible material.
SECTION �: For the purposes of this ordinance, the following
definitions shall be used:
By �absolutely fireproof or non-combustible� is meant any material
design�.ted or declared by the Mzssouri Inspection Bureau as being fire-
proof or non-combustible.
By t�building or house� is mea.nt buildings of all descriptions,
dwelling houses, sheds, lean-tos, outhouses of any kind or description,
stock pens for any type of live stock, stables, barns, or any erection
of any kind or description upon which it is necessary to place a roof
or covering.
SECTION 3: The intention of the City Council is to require all
erections in the City of Cape Gir�.rcieau, put up or constructed after
the effective date of this ordinance, requirir�g a roof or covering,
shall have thereon a roof or covering which is absolutely fireproof or
non-combustible.
SECTION �.: Every coverin.g or roof on any bu3.lding or house which
is repaired or replaced where said repair or replacement involves an
area of one hundred (100) square feet or more shall be repaired or re-
placed by an entirely new roof or covering on said building or house
in the manner provided for by this or�inanee. As an example, if any
roof or covering upon any building or house shall be damaged by fire,
flood, windstorm, or by any act of God or man, wh+ereby it becomes ne�-
essary to repair or replace an area of one hundred (100) sqttare feet
or more, the entire roof shall be replaced in accorda.nce with the terms
of this. ordinance. It is also provided that if any house or building
is remodeled or the roof or covering taken therefrom for any reason
whatsoever, providing the area of the roof affected is one hundred (100)
sguare feet or more, such roof or covex�. ng shall be constructed in
accordance with the provisions of this ordinance.

SECTIUN 5: It is hereby �rovided that this ordinance shall
apply only to the outside coverin� of said roof, and sha11 not apply
to the rafters or suk�-roof of said building, provided, however,
that every roof constructed, remodeled, or repaired on any building
or house in the City of Cape Girardeau shall be completed with an
outside covering, that is to say, �vith shingles or any other water-
proofing material. The intention of the Council bein� that the
covering placed upon any roof or covering of any building or house
for the purpose of turning the water falling on said roof shall be
of fireproof or non-combustible material in the manner provided for
by this ordinance.
SECTION 6: Anv person, persons, firm, associ�.tion, partnership
or corporation, including the contr�.ctor, �vorl�nen, day laborers,
ov�ners or lessees, of any building or house, violating the provisions
of this ordinance shall be deemed guilty of a misdemeanor and shall be
fined not less than Five Dollars (�5.00) nor more than One Hundred
Dollars (�100.00) .
SECTION 7: For each and every day that any person, etc. enumerated
in the precedin� section violates the provisions of this ordinance, he
or it shall be gtiilty of a misdemeanor as provided for therein, and
e�ch and every day shall constitute a separate and distinet offense,
and such p�rson, etc. may be prosecuted for each and every day that he
or it violates the provisions of this ordinance.
SECTIGN g: It is provided, ho�ever, that all of the persons, etc.
mentioned in this ordinanee shall have a reasonable time in which to
construct, remodel, repair or repla.ce any roof or covering upon any
building or house, and provided further that this ordinance shall not
apply to any buildin� or house now under construction or now under
contract to be constructed.
SECTION �: All ordinances or parts of ordinances in conflict
hereu�ith are in all things repealed.
S�CTION 10: The City Council hereby deems and decl�.res an emergency
to exist, and this ordinance, being one for the protection of the public
health, welfare, safety and good, shall be effective immediately upon
its pass�ge and approval, as provided for by the Statutes of Adissouri.
