AN ORDINANCE TO PROHIBIT THE PARKING OF CONVEYANCES
TRANSPORTING LIVE STOCK UPON THE PUBLIC STREETS OR
UPON PROP�RTY ABUTTING THEREON OF THE CITY OF CAPE
GIR��RDEAU, �HISSOURI
� BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLO�uS:
SECTION l: It shall be unlawful for any person, firm, associa-
tion, coop�er�tive marketing unit of any kind, or corporation to park,
stop or cause to be parked or stopped upon the public streets of Cape
Girardeau, Missouri or upon any prop�rty abutting thereon, any vehicle,
whether it be a motor vehicle or otherwise, which is then carrying or
transporting any live stock of any number or description.
SECTION �: Provided, however, that such vehicle may be stopped
for the purpose of refueling, such stop, however, not to exceed a
period of �� (�) minutes.

SECTION 3: Provided further, that an exception shall be made
in the event any such vehicle is stopped on account of the unavoidable
disability of such vehicle to proceed because of inechanical or motive
power defects. Hotirrever, the operator of any such vehicle stopped for
the reasons set out in this section shdll use reasonable diligence to
secure the imrnediate repair of such defect.
SECTION !�: Any person, firm, association, cooperative marketing
unit, or corporation violating the provisions of this Ordinance shall
be deemed guilty of a misdemeanor and, upon conviction, shall be fined
not less than Five Dollars {�5.00� nor more than One Hundred Dollars
(�100.00) .
SECTION 5: The City Council deems and hereby declares that an
emergency exists, and that the enactment of this Ordinanee is necessary
for the imraediate preservation of the public peace, health and welfare
of the City of Cape Girardeau, Missouri, and said Ordinance shall be-
come effective immediately upon its passage and approv�.l, as is provided
for by the Statutes of Missouri.
