LINE OF V�TEST END BOUL�V�RD, AND LEVYING A SPECIAL TAX IN
PAYl11�E+NT THERFFOR
V11�3EREAS, by Commission Form Ordinance No. 900 , passed and approv-
ed on the 17th day of October, 1940 , the roadway of that portion of
Bloomfield Street from the edge of the pavement on the west side of
Pacific Street to the east edge of West End Boulevard was by the City
Council ordered repaired and resurfaced by repairing the present
concrete base by removing rotten or broken concret� where necessary
and replacing the same with ne��v concret� or with crushed stone , and
constructing on said base a two-inch (2") thick asphaltic concrete
navement extending the entire width of the street , except at inter-
sections where the width was extended at the direction of the City
En�;ineer, and
VVHEREAS, said work has been done by the Street Department of
the City of Cape Girardeau, Missouri under the direction and super-
vision of John R. G"dalther, City Engineer, with assistance obtained
from the Cape Girardeau Special Road District, and
iREA.S, the said J'ohn R. ��alalther has heretofore �iled his re-
port showing the total cost of repairin� and resurfaeing said portion
of said street to be �1 2�p 9T_'; the total number o� linear
feet fronting and abutting thereon to be 2934.9 feet, and the cost
per front foot to be sixty cents ( 60�'� , and shovring the proportionate
share of such total cost chargeabl.e against each lot , tract and
parcel of land fronting and abutting on said portion of said street ,
and
yVI�REAS, said report has been examined by the City Council and
found to be in proper form, and the Council finds that the total
cost to the City of Cape Girardeau of said ra�airin�� and resurfacing
does not exceed 60¢ per front foot on all the pro�erty fronting and
abutting on saiu portion o� said street ,
NOW, THEREFORE, BE IT ORDAIiVED BY THt+, CITY C OUNCIL OF TH� CITY
OF CAPE GIRAR.DLAU, MISSOURI , AS F4LLOti�S:
SECTION 1: That the report of John R. �Nalther, City Engineer,
eovering the repairing and resurfacin� of that portion of Bloomfield
Street irom the west edge of the pavement on Pacific Street to the
east edge of West End Boulevard be and the same is hereby accepted
and approved, and ordered filed.
SECTION 2: That the Council finds said re�ort to be correct,
and further f'inds that the total cost to the City of Cape Girardeau of
re�airing and resurfacin$ said portion of Bluomfield Street does not
exceed 60¢ per front foot on the property fronting and abutting on
said portion of said street .
SECTION 3: A special tax is hereby levied and assessed against
all of the property fronting and abutting on said portion of said
street in a sum equal to 60� per front foot .
The names of the owner�, the description of the
property, number of front feet thereof , and amount of special tax
against each particular lot , tract and parcel of land frontin� and
abutting on said portion of said street , is as follows:

SECTION 4: Special tax bills in the ainounts set forth in the preceding
section shall be issued by the City Clerk against said lots, tracts and parcels
of land respec�ively, s:��hich said s�ecial tax bills shall bear interest at the
rate of eightpercent (8�j per annum from their date and shall constitute a first
lien upon the property therein described, and shall continue in f orce f'or a
period of five ( 5) years af'ter their date unless sooner paid, and in the event

suit is brought to enforce such lien, then said tax bills shall continue
in force until the expiration of such litigation. Said special tax bills
shall be issued in favor of the Citv oP Cape Girardeau an� may be assigned
by said City. The City, or owner or holder by assignment of such special
tax bills, may enforce the collection thereof by action in. any court of
competent jurisdiction. The action shall be brou�ht in the name of and by
the City for itself or in the name of the City at the relation and to the
use of the otivner or holder by assi�nment of any such special tax bills .
SECTION 5: Said special tax bills shall be offered for sale at not
less than their f ace value , and the City Clerk is hereby authorized and
directed to indorse and deliver said tax bi11s or any of them to any person
or �ersons or corporation who will purchase the same f'or not less than the
face value thereof.
SECTION 6: This Ordinance shall take effect and be in f'orce after
the expiration o� ten (10) days from the day of its passa�e or adoption.
