That the Council of the City of Cape Girardeau Missouri , has , by a resolution in writing duly adopted at a meeting of said Coun- cil on the f7�:� day of °-`'�'TT= 19 �r , found and declared it to be necessary to improve that part of , --=-,:�T,. ..---,;T described in the title and in Section 3 of this ordlnance, t e total length of said improvement being approximately - ':�. � feet , and along which property subject to assessment or sai improvement totuls approx- ima�ely ;��� feet. Said Resolution further provided that said work of improvement be done by contract let in the manner provided by law and ordinance and further provided that special tax bills would be issued in payment therefor. SECTION 2. The Council finds and declares that said Rasolution has been published in the Southeast Missourian, a newspaper printed and published in the City of CApe Girardeau Missouri , and doing the City Printing, for seven eonseeutive issues , and that more than ten days have el�psed since the last publication thereof in said paper , and that a majority of the resident owners of the lands liable for the cost of said improvement at the date of passa�e of sa3d Resolution, and who alsc own a ma j ority of the front feet ad j oining said improvement did not within ten days after said last d�te of publication of said Resolution, filc with the City C1Gr1� their protest against the improvement as re- quired by law and the ordinances of the City. The Council being of the opinion that the necessity still exists for the improvement of �=�-�T-, -�� proposed in said Resolution hereby reaff i�'rms its previous act on in deelaring said improvement necessary. SECTION 3 . SECTION �.. The C ouncil further orders and directs th€z� sAid work of improvement on that part of -T --,�,,-�T above de- scribed be done by contract, �n t t t e one so thAt it will in all respects comply with said Plans and Specifications therefor, and that it will not exceed the Estimates of C ost f ar s�id work prepared by the City Engineer and on file in the office of the City Clerk and previous- ly approved by �he Couneil , and that said work of improvement be done in such manner as to comply with the terms and provisions of said Commission Form Ordinance Numoer 328 and with this Ordinance . No con- tract shall be entered into under authority of this ordinance that ex- ceeds the estimate of the whole cost of this improvement previously w .. +r -.. � � � � . made by the �ity Engineer and above referred to. The Council further finds and dec.lares that in its judgment the condition of the General Revenue Fund of the City is such that no pflrt of the cost of said im- provement shall be paid therefrom. SECTION 5 . The City Clerk is hereby authorized and directed to advertise for bids in the newspaper doing the City printing, for the cflnstruction of said improvement according t.:; the �lans., Specifications and �stimates of Cost theref or and in accordance with said Commission Form Ordinance Number 32$ and this Ordinance �nd the Clerk, in adver- tising for such bids sha11 advise bidders of the deposit and bond re- quired by law to be given and further advise bidders that no contract wi11 be awarded the successful bidder uniess he stipulate in his pr o- pos�l that he will accept special tax bills to be issued against the pr operty abutting on said impr ovement in payment theref or and that he will in no event hold the City liable for the cost of the work or any part thereof, and will further, upon completion of the werk pay the cost of the Engineerts services and any other ccst accrueing in com- pleting his contract . SECTION 6. The i!�iayor of the C ity is hereby authari�ed and directed to enter into a eontract for the City with the Contractor who shall hereafter be awardad the contract f or such improv2ment in accordance with the law and ordinances of the City and said contr�.c� shall pr ovide that such work ef improvement be done in accordan�e with said Plans , Specifications, Estimates of Cost, Commission Form Ordinance Number 32$ and this Ordinance . SECTION 7. V�Ihen said wcrk of improvemcnt has been comp�eted as here- in provided and has f urther been approved by the City Engineer in a written report thereof, and when said report has been approved �nd adopted by the Council, Special Tax Bills in favor of the C�ntractor who did the work and against the lots and parc�;ls of land fronting and abutting on said improvement along the distance mentioned in pr oportion to the number of abutting front feet shall be issued in accordance wi�i the law and said Commission Form Ordinance Number 328 and delivered to said Contractor in payment for said work of improvement . SECTION 8. This ordinance shall take effect and be in f orce after the expiration of ten days from the date of final passage or adoption there of.
