�rCTION l. Th�.t the Council of tne City of Cape uirardeau, �:��issouri ,
has, by a Resolution in writin.�, duly adopted at a meeting oi said ;ouncil
held on tne 20t1z d�y of i.�ay, 1926, found and decl�red it to be necessary to
ir:��ro�re parts of Fountain, �ollege and Iuaple �trsets, by buildin,� a contin- �
uous concxete roadsvay six (6) inclzes in thickness and ei�nteen (18) feet in ;
width, on and a1on�� tne parts of said streets between a point on ��'ount;ain
Street 30 feet south of the south line produced of Lot �'ifteen (15) , of
�lock �even {7) , of :�iboney ��ouck' s Second aubdi�ision, said �oi�t being '•.
tivit'�in t'ae intersection of said �'ountain E�tree� i�vith �1u1 �treet, nort�vrardly `
on rountain Street and on a curve �.round the southvrest corner oi �'ountain
and �olle�e Streets, and nortnr�est•:�rardly and tvesttiNardly on �olle�e and ?�:�:aple '

m�,tely �D _�D feet, and along which the property su�bject to assess-
�ent to��.ls �.pY�rQni�ately ��v feet. Said Resolution furtner
provided that said �vork oi improveznent be done by contract �et in the usual
and ordi�zary way as provided by law and ordinance, and in accor�ance �vith
the plans, specifications and esti:�te of t_�ie cost thereof prepared by the
City �n�ineer, filed �vith the City Clerk, approved and adopted by the City
�ouncil and no��r on file in the offiee of the City �::lerk, and in accordance
with ��om�is si on r orm Ordinance I�o. 328, passed and approved on the 8t:i day
of �:�ay, 1925. Said Resolution furtner provided tnat the cost of said tvork
be paid for by sx�ecial tax 'r�ills issued against the property abuttiY�g on the
irnjorove�:.ent, as provided by law and ordinance.
SECTION 2. The Council finds and declares t�at said Hesolution has
been published for seven consecutive issues in the ��outheast ::�lssourian, a ;
nervs�aper printed and published in the City of Cape �irarde�.u, ��issouri, and °
doin; tri� printi��� for said city, and that more than ten days have elapsed
since t:�ie last publication tnereof in said paper, and that a majority of the '€
res:ident o��vners of tnelands liable for the costs of said improve�ent, at
z �ne date of tne passage of tne �tesolution and yrho also otian a majority of the
front feet o�Nned by residents of the city abuttin� on said streets proposed
ta be improved, did not within ten days after the date of the l�.st �ublica-
tion of said Hesolution file �vith the City i:lerk �heir pro�est against the
irl;,�rov�:::�e:.t �o be �r�a.de as desi�nated i�z said :=�esolution. r�nd tne Council,
bein� of the opinion that the �ecessity still exists for t:ie improvement
pru�osed in said '_=�esolution, here'�y reaffirms its previous action in declar-
in� said i�.prove:ilent necessary.

SFCTIOI�' 3. 1'he �ouncil further finds that all requireraents imposed
by la�v and ordi�zance for said improvement have been complied with and tnat
it has tnereby acquired authority ior orderin� said improve�lent, and it now :
hereby orders and directs that parts of �'ountain, Colle;e and �aple Streets :
be i�nproved by building a continuous concrete roaddvay six (6) inches in
thickness and ei�hteen (18) feet in �vidth, on and alonf� the parts of said
streets ��etween a point on s+ountain 5treet 30 feet sout:� of the south line �
produced of I,ot :r'if'teen (15) , of _�lock Seven (7) , of Giboney Houck' s Sec- �
ond �ubdivision, said point bein;; vvitni:� the intersection of said ��'oun�tain

SyCTIOi�t 4. i`he (:ouncil furtner orders and directs t�?iat s�id �vork of
irnp-r.ovetnent on the str�ets hereinbefore descri'�ed be done by contract, and '
that it be done so t�riat it tivill in all respects comply ��ith the plans,
sbecific�.tions and estiznate t:�iereior, on file witn the City �lerk, and ap-
protTed by �he City Council, anci that said improv�i.�ent be done in su�h way
as to com�aly with the provisions of �omr�ission �.yorm Orainance l�o. 328,
pass�d and approved on the 8th day of 1.Iay, 1925, and �r�ith this ordinance,
a.nd in accordance tirith the �rovisions of all the law and the ordin�.nces
ofi' said city relatin� to improv�r�ents of this nature. ri'he Council further
orders and directs that no contr�ct be entered into for said improve�lent
under which the improver�ent shall cost an ar:lount in excess of the estiraate
of the cost of the �vhole i�nprove:nent ,made by tne �ity yngineer, and which
esti:�ate is no�r on file in tne office of t:�e �ity �lerk. 'lhe Council here-
by fartner Finds �nd @eclares that, in its judE;ment, tne condition of' the
�eneral revenue funds of the city is such that no part o� the cost of this
wors shall be paid therefrom.
SECTI033 5. `�he City Clerk is l7ereby authorized and directed to adver-
ti�e for bids, in the newspaper doing the city printin�, f'or tne construc-
tion oi said improver�ent according to the plans and specif'ications and the
esti°nate therefor and in accordance �vi�;h said �ornrnission x'orra Ordinance ivo.
328, and l�vith this ordin�.nce, and it is further ordered that the c:lerk, in
advertisin� for bids, advise bidders of the deposit and bond required to be
given and further advise tilat tlze contract �will not be awarded tne success-
fu� bidder unless he sti�ulates in his pro�osal t:�t he will accept special
tax bills to be issued a�;ainst the property abutti�g on the improvement in
payment for the i�prove�ne�zt and that he will in no event hold t:�e city
li�,ble for the cost of tne tivork, or any part thereoi, and �rill, on coinple-
tion of the work, nay t�.ie cost of the engineer' s services and any other
costs accruin� in fulfilling lzis contract.

a contract for tne City with the contractor wno shall hereafter be awarded

SEC�.�ION 7. 'tlhen said work of improvement of said streets bet���een the '
points hereinbefore r:�entioned has �aeen completed accordin� to the plans, `
specifications and esti�na.te therefor and in accordance jrith said contract, '
and when sarne ha.s been a�proved by t�e City :�n�ineer and a�provea and ac- s
cepted by the City Council, it is iiere'r�y ordered that special tax bills be ��
