. `r°JT.-�REAS� The Council has long c�nsidered the Dro�alem of im- �
prov��nents to the �Tater P1aMt gnti UistributiQn syst�m of the �i��oua ,,�
Utilities Company in the City oi Cape Girardeau IUlissouri, and , the
�lectric Plant and distribution system and, the Strest Zi$hting �
syatem of said company as well as al]. plans heretofor=aubinitted `
for the improve:nent of said plants and distribution systems, and
all reports, opinions, or recomendations filed concexning said
plans, and, �
; �;�HEREAS, it appears from the attitude of the State Board of �
Health of the State of ]�issouri as expressed in their letters, ;
; reports, and recomendations previously filed witn the Council, that �
any construction or improve�ent at the site of the present plant =i
of the Company in said City of Cape Girardeau would not be �
permittsd , and , �
`+J���S, The Couneil, aeting upon the assumption that the
State Board of Health has eliminated from furtl�er considexation
any construction or improve�nent a� said present site of said plant '
of said Tvti.ssouri Utilities Company, and, `

WH:'r.�EAS, Ordinance No. 1043 of the City of Cape Girardeau
�I.issouri prohibits said Tdissouri Utilities Co�pany f�om Qonstr�acting -;
or er,x�ectin� any plant, distribution system, filter, or improvement
at any other site than the site of the present plant of said �
Company in said City, without the consent, first obtained, of the �
City, and ,

�NHII�AS, The City is willing to grant its oonsent to said '•
, M�ssouri Utilities Company to eonstruct and ePect at the site known
as tze Cape Rock Site � the new plant, filter, intake and distrib-
ution system described in detail in what ��is kno�vn as Plan No . 1. s
on file in the office of the City Clerk anc� submitted to the voters
of the City of Cape Girardeau on �ecember 16th 1930 by Commi.ssion `
Form �rdinance No. 608, providing, and upon condition, that the
provi�ions of said �rdina.nce No. 1043 entitling said �Iis�ouri
�,✓ Utilities Company to an increase in rates upon such construction
J do not apply, and said provision in said �rdinance 1043 shal]. be
expressly �raived by said �issouri Utilities Company, and, �

}tJ�i�EAS, said Missouri Utilitiea Company has expressed a i
�rillingness to con�truct a new tivater works and distribution system �
at said Cape Rock Site, togeti�er with a new �txeet Zighting and �
distribution system , all substantially as set forth in Commission ;
� Form �rdinance No. 608 and also expxessed a �rillingness to do and

construct all and sir�gular said improvemente waiving any righ�
� to apply for rate increas�o public or private �onsumers in said ;,;
City under said Urdinance o. 1043, and has expressed a ��villingnesa �
to agree to f1arnish the Ci�ty with water, and to furnish or supply �
fire hydrants and public fountains and supply the white way system

BE IT ORDAIN� BY THE CITY Q�UNCII� OF 'rHt; CITY OF CAPF GIRARDEAU

SECTION l. The City of Cape Girardeau �issouri hereby grants
to the �`issouri Utilities Company the right to construct at the site 3
knoti�n as the Cape Rock Site a new water ��orks system and distributim
Mystem as set forth and particularly described in what is known as '
Plan No. 1 ", on file in the office of the City Clerk and refered �
to in Commission Form Ordinance No. 608 submitted to the voters of
the City on :�ecember 16ta, 1930, and the right to con�truct and
, erect the improve�nents to the present ;�hite way systsm and other '
�_ street lighting systQm also described in detail in sai�3 "Plax� No. 1': �

SECTION 2. Tha,t upon the complet�on of said i�provements and
ttze acceptance of said work in the manner provided in said Commission
�+'orm �rdinance No. 608, all agreements as to rates and char es �
by said Qommiss� on :r�orm "rdiAance No. 608 shall be placed into im-��d�
mediate effect.
SECTION �. That tE�e City shall, upon the completion of said
improvements and their aeceptance as provided , as soon thereafter as �
_ the same may be legal].� done resubmit by ordinance to the qua�ified
voters of the Cit;� of Cape Girardeau for ratification or rejection
as provided by law, Commissiorl Form Ordinance No. 608 granting to
saicl T1ra.ssouri Utilities Company statutory franchises to maintain
and operate water and electrie plants and distributions systems as
set forth in said Commission Form Ordin�nce No. 608 which said
ordina.nce is entitled " An ordinance in �elatian to the eor.struction
of a new intake, filter plant, storage �ank, �ettling basins and oth�
improvements to the present aVater Works System and to the maintainance
� and extensien of the present �vater works system, and business a,nd
k ri�hts of the Miseouri Utilities Company, the present owners of
the vrater works sys�em at Cape Gir�rdeau �Zissouri; Renewing ot grantig
- to said �issouri Utilities Compsny its succ�ssors or assigns tk�e righ.t
,�_ to cons�ruet maintain and operate a z�ea�er works system for supplyin�
the City of Cape Girardeau ar.d the inhabitants thereof, with water,
giving said company the ri�ht to use the streets, alleys, avenues
and pu�lic places within t�.e limits of said city as now established
and as reay hereafter be extended ; and contracting with qaid company
for supplying said city �rith water for fire protecticn, flushir�g sew-
ers, public fountains, water troughs , polic� court, city hall and
other purposes ; also providing for the rehabilitationaQ-�d extension of
the street lig�iting system, and maintenance of the preser�t electric
system, extertsion of and improverr,er�ts tc the preser�t electric sy�tem
a.nd business and rights of i�issouri Utilities Co�nr,any, the preser,t
ov:ners of tne electric systern in said Gity of Cape Giraxdeau; and
renewing ox� granting to �:issouri Utilities Compang, its successors
and assigns, the right to construc�, maintain and operate an electric
li�ht ar,d power system for supplyin� the �ity of Cape Girardeau ard
th� inha�itants tb.ereof, and the �icinity of sa.id city with electric
- e��er�y for li�;!�t , power, heat and other purposes; giving said company
thE right to use the st�eets, alleys, avenues and public placee witt�-
in th.e limits of said eity as now established and as may hereafter
be e�tended ; and contracting with s ai� company for street lighting s��
vice and electric er.ergy for other pruposes; a nd fixing the rates and
char�es for service in compli��_nce with the laws of Mi�soura. authoriz-
i::g the fixing rates and charges by a greement of parties for trial
{' �eriod� with the a�proval of the public service com�riission. "

S�CTI�1�T 4. That th.e lir�.ssouxi Utilities Company shall have �
thirty days after th.e effective date of this ordinance to file witb �
t�e City Clerk, its acceptarce in writin.g of the terns and f
of this ordi��.�nce and when so accepted the s�me shall eonstitutesthes
the contract between the City and said �issouri Utilities Conzpany in
respect to the� matters and thin�s herein set out.
