SECTION 3. The Council �nrther finds that all requirements
, imposed by 18w and ordinance f'or said improvement have been co�plied
with, and that it has thereby aequired authority �or ordering said im-
provement, and it does now hereby order and direct that that part of
E11is Street from the center line of detferson Avegue to the north prop-
erty line of �ollege Street, be improeed., by grading same to the estab-
� Iished grade, by removing tne old curbg and gutters, and by construct-
ing thereon new conerete curbs and gutters and a coaerete pavement sia
inches thick between gutters, sa that said improvement, when co�pleted,
wi11 be forty feet wide between curbs, and so as to conneet up with two
psved streets, in accordance with the provisions of said resolution of
gpril 25, 1929, with the plans and specification� therefor, on Pile
in the office of the City �lerk, and in aecordance with Commission
Form Ordinance DTo. 328, passed and approved on the 8th day of �ay, 1925.
SECTION 4. The �ouncil further orders and directs that said
Work of improvement on that part of Ellis Street hereinbefore describ-
ed be done by contract and that it be done so that it will in all re-
'" spects compl with the plans, specifications and estimate therefor, til-
ed with the �ity �lerk and approved by the �ity �ouncil, and that said
improvement be don� in such Ray as to comply with the provisioas oY
said Gommission For� Ord.inance No. 328, and �ith this ordinanee, ax�d
t�iat no contract for sai�i improvement shall be entered into whereby said
improvement shall cost an amount in ezcess of the estimate of the cost
of the Whole improvement ma.de by the �ity Engineer and now on file in
the office of the City Clerk.
SECTIOAT 5. The �i�ty �lerk is hereby suthorized and direct-
ed to advertise for bids, in the ne�rspaper doing the city printing,
f'or the construction of said improvemeat according to the plans and ,
� specificatioas and the estimate ther�for, and in accordance with said
Commission Form Ordinance �o. 328, and �ith this ordiaance, and the
Clerk, in advertising for bids, shall advise bidders of the depo�it and
bond required to be given, and shall further advise bidders that the
eontract will not be awarded the suecessFul bidder unless he stipulates
in his proposal that he will accept special tax bills to be issued
against the property abutting on the improvement in payment Por the i�-
provement� and that he will in no event hold the city liable for the
cost of the work, or sny part thereo�, and will, on complstion o� the
work, pay the eost of th e engineer's services aad anp other �osts ac-
cruing in fulfilling his contract.
SECTI01� 6. The �ayor is hereby suthorized and directed to
enter into a eoutract for the �ity with the contractor who shall here-
after be awarded. the contract for said improvement in accordance with
the law and the ordinances of the city, snd said contract shall pro-
vide that said improvement be done ia accordance with the plans, speci-
fications and estimate therefor and in accordance with said Commission
Form Ordiaance No. 328, and �ith this ordinance.

SECTION 7. �hen said work of improve�nent on that part oY
E].lis Street hereiabefore mentioned has been completed according to
the plans, specifications, estimate and contract therefor, and has been
approved by the �ity Engineer and approved and accepted by the City
Council, special tax bills in #'avor of the contractor who did the work
and against the l�ts and tracts at land fronting and abutting on that
part of Ellis Street improved, along the distance mentioned, ia propor- -
� �ion to the number of abutting or front feet, shall be issued, all in
aecordance with said Commiss�on Forn Ordina.nce No. �28, in f'ull pay�nent
for said improvement.
