4'V�EREAS, by its contr�ct, duly authorized by ordinance, with
the City of Cape Girardeau, �issouri , W. P. Mct�eorge �c Company ag�eed �
to improve accordin� to the terms in said contract , Henderson Avenue
frorn Dunklin Street to the iVorth 13ne of Broadway in said city within
a specified time, which time is now about to �xpire, and
�;It'r;AS, owin� to excessive and cont3r�ua1 rain f�ll dur3.n�
a large part o f th.e t ime thrat,��h �ay �nd �une, 1924 and frequent
rains to this date durin� the month of �uly, 1924, said period being
the time within which the s�id i�. P. �ct�eor�e �c Cornpar�y hAd to so im- •
prove said street, and
V��AS, durin�; said rainy season the city engineer of said '
City of Cape Uirardeau, who had the superintendin� control over the
improve�ent of said atreet by said contra�ctor, was unwil].in� to take
the chsince of puttin�; down conc.:ete for a permanent street upon a
soft subeurface and was unv�illin� to cause to be lai.d a large amount
o� cancreta the hardenin� of �rhich �rould r�ecessarily be prevented and
interferred with by certain approaching rainfall� and
W�REAS, the said Y�. P. �ec�eox�e �c Company, eontraetor, h�.s,
because of such conditions beyond its control, been necess�,rily de-
layed in ca�rrying out its said contract with said city to 3mprove
that ,�art of said street as aforesaid, and has requested that the
Council grant it a�n extension of time for the performance of said con-
tract to improve said street.
BE IT ORDAIi�D BY TH� COUNCII, OF `1`HE CITY OF CAP� GIRARIIEAU,
MISSOUKI , AS FOLI,OWS:

d�y� within wfi.ich to complete ite contr�ct with the city for said 3�1- :
provement, i
SECTI�is 2: --lhis ordinance shall be in Parce and take effect
from and a,ft�r it$ passage.
Passed and approved on the 21st day of July, 1924.
