An Ordinance providing for a license taxing� regulating and governing the
erection and maintaining of billboards and signbo�.rde and authorizing a "
perrnit and fixin� tne penalty for its violat�on and t� enact in l�eu '
thereof two new sections to be numbered Sections 7 and 12. `
;ECTI�N 7 :- RIGHT OF 7_'HOPERTY Oi19NF,RS TO FILE R�,FO�,TS2RANCE; Any
perso�z, firm or corporation desirin� ta erect or construct any billbo�,rd
or si;�nboard in ariy "block on any public street in ��ich one-half of t:ne
buildin�s in said bloc:� are used exclusively for residence purposes, the
owner of sach billboard or signboard shall �na,ke �,pplication fox a perniit
to ereet the same dnd file said applicati�n with the �ity Clerk. Follow-
in� the filin,�', of such application, the person, firm or corporation shall
cause n�tice to be pu-blished in some newspaper published in the City of �
Cape Gix�rdeau callin� attention to the lot or tract on which it is de- _'
�; �ired to erect such -billboard �r signboard t3iving such inio rmati��n as to
� apprise property owners and shall conspiciously post a not�.ce on the '
tract of land. Such notice shall be published at least twice in the
paper selected �.nd shall not be r�ore than three days apart , for a majority
of the pr��perty holders in the block, �rithin five days , after the last �
publicati.an of the notice, file their proteet in writing against such `
billboard or signboard. `l'he City �ouncil shall not authorize a per:�lit �
for its erecti��n or construction.
SECTI�N 1?.,;- It is hereby decl�,red to be unlawful for any person�
fixm or corporati��n, within the corporate limits of the City of C�p�
Gir�.rdeau� i3�issouri , to paint, post� put up , or display in any public
place or any wall, billboard, fence, post, tree, bu�lding or other ;
place, �nhen tne obtiect of such advertisemerlt ia to derive profit or �ain �
fr�:� the space s� used and rented� u�-�less such person or per$on� sY�all °
h�.ve been duly licensed �,s nrovided for �n Section 49 of Commisei�n Form '
Ordin�nce No. 25, which requires a license fee of 'Thirty ( �30.00) Dollare
for each six months . p�.yable in advance, provided that nothing herein
shall be so conetrued a� to apply to any church, chartiable or ed.ucati��r.al E
soci�ty or inetitution� or to any political p�rty, nor to include any
ro tice or any adverti�ement prescri'bed or required by la�.p in any c�,se,
nor to any �zotice poeted by an,Y officer, �rnich he is by law �irected _�
to post, no� shall it be construed to include a party �r other person ,
�ho is en�;��ed �ny the ��wner or lessee of the propert;�, to pai.nt such
sign for him and for which he is paid for doing suc:�i vvork, and not as
'the o�.vner or�rente�.-out) of the ap�,ce, the purpose bein� to charge a licen-
se fee for the vocation.
