Tha.t the Council of the City of Cape Girardeau, 2�is- aouri , has, by a Resolution in writin� duly adopted at a meeting of said Council held on the .,Q��`� day of J'une, 1925, found and declared i� to be necessary to im�rove that part of South Frederic� Street from the concrete paveraent at t�.e intersectiQn of Frederic� Street with the north gutter line of FVilliau� 5treet to the concxete pave�n.ent of Frederick Street at t��e in- tersectior� of tr.e north curb line of Good Hope Street with Frederick Street, by rerr�oving the macadara and the old curbs and gutters and by constructing in the same place new conerete curbs and gutters and a �ix-inch cencrete paverc.ent, the total dista.nce of said im�rovement being appro�iriia,tely �'O feet and along wh3cY� th property sub�ect to assessment for �aid improver��er�t totals approxi�ia.tel� feet. Said Resc�lution further provided that said �vark of improvesnex� e dane by contract let in the usua7. and ordinary way, as grov3,ded by la� and ordinance, and flzz�tY�er prov�.ded that special ta.� bilis �e issued in payrsent therefor, as grovided by law and the �rdinances af said city and accordin� to the plans, specifications and estimate for said wark, to be rr�.de by t�he City En�;ineer and filed ��ith the City Clerk, and which Resolution further directed that said City Engineer prepare plans, spec- ifications and eatimate of -Che cost of said improvernent and file same in the office of tY�e City Clerk, Said Resolution further provided that any o�rner of property abutting on eaid praposed i.mprovenent, desiring to pxotest against sasne, should appear before the Council at 2:30 P. M. on Monday, July 13th, 1925, at whicY� tirne a hearing would be 'r�eld on the �uestion of the necessity of the work sought to be done. SECTIQN 2. The Cauncil finds and declares that said Resolution has been published for seven conaecutive issues in the Southeast Missouria�., a newspaper published and �rinted in the City ox Cape Girardeau, �p.issauxi, and doi.ng the printing for saic't city, and fuxther finds and declares t,hat the City Engine�r has �repared plans , speeifa.cations and est3na.te of the cost of said improvement, which. are no�r on file in t11e office of the City C1erk. The Cauncal further finds and declares that it rnet at the Council Cha,mber in said city on July 13th, 1925, a� 2:30 P. �T. , for the purpose of hearin� protests by �.buttin� p roperty o�ners against such �roposed improvement, �nd that the Council has, by Resclution dated the � day of July, 1925, and adopted at a special meeting of the Council hela on the same day, duly declared the re�ult of said riearin� at 2;30 P. �t[. on July 13th, 1925, to be a reaffirmance af the nece�sity fax the doin� of the work on tY�at par1: of SoutY�� Frederick �-- Street hereinbefoxe described aa proposed in said Resolution of June �%�, 1925 . The Counc:i l, bein� of �he opinion tYaat the necessity sti11 exists for = the iraproveruent of t�:�at paxt of South Fredericx Street hereinbefore described, � hereby reaffirms its previous action a.n declaring said improvement necessary. . SECTIUN 3. The Council further finds t,�iat �1.1 rea,uirements imposed by laxr and ordinance for said impravement have been c omplied with and that it �ias thereby acquired authority for ordering said inproveraent, and it does now hereby order and direct that that part of South Frederick Street from the concrete pav�ment at tiie intersection of Frederick Street v�ith the north -1- ._._., .. . _ .«�, .:-. �-�.._,...,�. , . -�� � � gutter line of �lilliam Street to the concrete pavement on �'rederick Street at the intersecti.o�n of the north aurb line of Good Hope Street �rith �'red- erick Street, be improved, by removing the macaaam and the old curbs and gutters a,nd by constructing in the same p�.aee ne�r concrete cuxbs and gut- ters and a six-ir_ch concre�.e pave�ent between Tu,�ter�, in aecordance �itY� the provisiona of said Resolution of June �;—`1925. S�CTIUN 4. 2'he Council furt,Yler order� and directs that said �ror� of a.mprovement on t hat part of South Frederic� Street hereinbefore describ- ed be done by contract, and tha.t i�t be done so that it will in all respects com.ply �rith the plans, apecifications and estirnate tY�Erefor m.�a.de by the City Engineer and filed v�zth tYle City Clerk and approved by the City Council, and that said iffiprovement be done in such way as to comply v�ith the pro- visions of Commission Form Ordi.nance No. 328, passeci and approve� on the 8th day of 1�Say, 19�5, and wri.th this ordinance, and that no con�ract for said improver�ent be entered into whereb;� said i�prove�:zent shall cost an a.mount in �xcess of t7ie estimate of the cost of the whole imgrovenent made by the City En�3neer and now on file in the office of the City Clerk. SECTIQN 5. �Ahen sa.id �rork of irr�proverr�.ent on South Frederick Street bet�reen the points hereinbefore mentionea has been completed �ccording to the plans, specifications and t&e estimate therefor and in accordance with th2 pro�isions af the cantract for said iraprovenent, w hich contrac� the �ayor as here�� a�zt�orized to enter into for said city �ri�`�1 the contractor who sha11 hereafter be a�arded the c�ntract in accoxdance wit�l the law a.nd the ordin- a.nces of the city, and when said �rork of improvement has been approved by t'rle City Enggneer and approved and accepted by the C3�y Council, a.t is here- by ordered that special tax bills be issued to pay for the cost of said im- prUvement, which apecial tax bills shall be m.ade in favor of the contractor and against the lots a�nd tracts of la.r�d frontin.g and abutting on th.at part of South Frederick Street hereby ordEred impra�e�. Zt is further ordered t�lat said tax bi11s be issued against the property abut�ir�g on fi5�.1t1 improvement �lor�� the dietance of said improvement in proportion to the nwnb er of abutt- i.ng or front feet, all in accoxdance witb. the provigions of s�.d Conraiasion Form Ordinance No. 328, �.nd that said tax bil.ls shall be ia �'uIl payment for said improvement. S�CTION 6. The City Clerk i� hereby �,uthorized and directed to advertise for bicls, in the newspaper do�.ng the city printing, for the con- struction of said impro�Pxrient according to the plans and specifications and the estimate therefor and in accordance �vith said Co�mission Form Or�inanee i3o. 328 and �rith this ordinance, and it is furt��er ordered that the Clerk, in advertising for bids, advise bidders of the deposit and bond required to be gigen and further advise that the contract will not be awarded the success- ful ba.dder unless he stipulates in his proposal that he �r�.11 accept special t+�x bills to be issued agairst the property abuttin� on �the improvement in paymen�t for the improvernent and that he paill in no event hold the city liable for t7ie eost of the work, or any part tY�ereof, and �i21, on completian of the work, pay the cost of the en�ineer' s services and any other costs accru- in� in fulfillin� his contract.
