essary to improve that part of �or;an Oak Street from the west
property line ot Sprigg Street to the east curb line o� pa'cii'ic Street
by gradin�, cuzbing, and constructing thereon a concre�;e pavement,
alang w't7icn the property z"eet sub ject to assessment �totals t332 �'eet�
That the said work of improvement shall be done by contract, and
ihat as �here is no sufficient iund in the General Revenue out ot' whieh
to pay for saici work; Special Tax Bi11s shall be issued in p�yment
thereior as is provided for by l�w and �ommission Form Ordinance No.
50, approved June 1.6th, 191� , and tne plans and speci�ications and
the estimate o�' the City Engineer made and filed with the City Clerk% .

SECTION �� The Council finds and declares that s�.id resoiution
has been puolished tor seven consecutive issues in the Cdpe Girardeau
Southeast ��iissourian, a newspaper published in the City of Ca;;.e Gir�.rdeau
and doin� �he city printin� ior s� ici city, and that more than ten. days ;�
hd�e el�psed since the las� pubiicd�ion thereof, and tna-c tne property
hc�lciers dia not appear befare the council or protest a��znst the improve-
ment to oe mac�e, and �he eouncil being ot tne opinion that tize necessity
still exis��s for the inprovemen�, as set out in the resoluzior., hereby
re-afiir�ns its action of Februar;� 16th, 19�0/` �

SECTION 3. �hat the Council havin� complied with all requirelnents
imposed by laV� and ordinance and having acquired authority so -to do, it
is hereby ordered �,nd directed �hat Morgan Oak Street tram the v�est
p roperty iine oz Sprig� Street t� the Adst cu rb line of Pacif�c Street
be imp roved by orading and placing a concreie pdvement thereon accord-
ing to the plans and specit'ications provided tnere�'or.
SECTION 4. That said work on said ?�Io-r�a,n Qak Stireet shall be
done by contract and in �a1Z respects eomply v��ith tne �stimate, plans
anct specifications theretor filecl by �he Gity E�ineer on the lEith
c�ay o� February, 1�20, and approved by the Council on the said 1eLh
day o�' February, 1�20, and on file in the ot'�ice o�` tne City Clerk and
ti Cnm�nission Form Ordinance No. 50, p�ssed and approved June 16th, 1919,
� and this ordin�r�ce; and na conir��ct for said �vork shall be made and en-
tered into in excess o�' the estimate ot' the casts of tne whole m��.de
by the City En�ineer and on file in the office ot' the City Clerk as
atoresaid, t�s is �1sQ providecl in Section 1.

SECTION 6. The City Clerk is her�by �,ut;horized anci instructed to
advertise for bids in the netivspaper doing the Ci,ty Printing tor the con-
struction of said inprovemer��, according to the estimate , plans ana
speei�ica�ions , and in accordanee Gvith Com�nission Form Ordinance No,
50, �.�oresaicf, and advisin� bidaers of' tne cieposit and bond to be �;iven
and that the contract will noi; be �warded the successlul bidcier unless
he stipula�es in nis proposal tnat ne wili accept Specia.L Tax Bilis
to be issued ag�ainst the abutting property in payment �'or the work,
and he will in no event hnlci the Ci'�y liaoie tor tne c�si, o� the �;:�r>rk:
or any p�rt i;hereot' arTd vrill on compietion ot the worx, pay the
cost o� -�ne ^ngineer's serv�ices or an�other c�si:s accruing in ful-
