District r�o . 5, Cape Girarde�u, Missouri, �' macle by E. L. Sailer, City
Engineer, of the City o� Cape Gi-rardeau, and filec� in the ozfice of the
Cizy C1erk of Cape Girardeau, Missouri, on the lotn day of February,
19�0, be, and tne same are hereby approved and adopted by the City
Counci 1.
SECTION 2. That the esti�nate of the cost o� constructing a `
; sys�:�em oi se�riers in said Sewar Dis+ric't D1o. 5, with said plans and
speci�ieatiars, filed in t}�e olfice of the City Cierk on �'e'oruary 16,

provided, however, that the total cost of said e �nstruction sha11 not ex- �

pipe, brici., ce�ent, conerete and other materials, and o� t'r.e form,
dimensior�s , locations, descriptions and clzaracter, as is ahown ar�d des-
cribed particularly in said plans, speeifications, profile maps and
form of c��ntra,ct neretofo;e made a par� o� this ordinance .

authorized and directed �� soon as this ordinanee shall. have been duly
passed and approved, to advertise �ortY�with by publication in not less
than two �n�ineering and Contracting journ�ls published outside of the
City of Cdpe Girardeau, also for t�vo c�>nsecutive weeks, �y public� tion
in the )JU��IBaSt tr2issaurian, published in the City o� Cape Gir�.rdeau,
�41issouri , ��lhich paper is doing the city printin�;, for �-ealed bids �or tne
construccion of the sewers herein provided for, inciuding ali �artis and
� appurtenanees covered by said pidns and specifications . A.1 bids shall be
made on prin�ed or �rritten. for�s, and. the City C�erk is hereby ir�:�tructed
to furnish a�l pe�sons wishing to bid, with sueh forms, to ~Pth� _r with
copies of this ordinance, and with instructions to bidders to be at�ached
t"�ereto . Anyone desiring a copy of the plans a�nd specifications shal.l
procure same fr��m the City Clerk upon making a deposit o� ;;50.00 therefor,
Said deposit to be refunded by the said City Clerk upon return of said
set of plans and specifications, form o� contract, drawings and estima.tes.
The City l�lerk shaii also pl�ce on �i"le in t7is office not less than three
copies of all the ul�ns , drawings, and specific�,tions prepared for said
sewers, for the inspection by prospective bidders .
Proposal.s shall be enclosed in sedled en�elope addressed to the

�.�C�l�OI� 9 . The contractior or contr�.ctiors �u c�:�c,:�: ��:e :�r�r:� shali
be awarded, shall, at his or their ��wn cost, and� expense, provide lights, �
guards, fences and other pnoper rneans to �rotect persons and property
from injury and aamag� on account of said �vork, �rom the comrneneement
�\' to the e�mpletion thereof, and shaLl indemnify the said City aeainst any
�� or all �oss by r�ason of dny violation o�' this or any other requirer�ei�t
of this Ordindnce .
�-: SECTION 10. No contract nor uward for the construction of said
�eR�ers shall be binding on said City, until tt�e persons or �erson to whom
� such contrdet may be aw�arded, sha11 enter into r� written contraci with
said city, specifying materials to be iurnished and the work to be done,
prices, to be paid tnerefor, e�ntaining agreements and stlpuldtion on
�: the part of the contractor to furnisn said materials and clo and completie
the work of constructing said sewer in tne manner and within tne time or ;
times provided for in ��his Ordinance, in dccordance with ^���.d plans and ,
speeifications therewith, and sha.li execute a bond �vith good and satis-
, factory surety to be approved by the �1i�.yor of said City, pdyable to the

' Citiy of Cape Gir�rdeau, ior one-third of the amounti of said c ;ntrac�t,
�= conditioned that the contractor vdill �ully guarantee and indemnify sa,id

ma.y in aMy wise result from the connection �f said city tivi th said con-
tractor by re�:.son of said cont�act or b,y reason of his fdilure to f"ully

SECTIO�T 11. The delivery of the material for said seti-rers shall

lution, and snall be c�rried on c�ntinuously and uninterrup�edly at such ;
rates �s will insure the compleiion of said work of eonstructing said
sec,ers waithin � ve months there�fter. Should the work, however, ne de-
layed dn�. interr�ted by tne Cit,y C�uncil ( ur officers oz" the City of
Cape Girardeauj or by �he aeti ot God, or �y any other cause entireiy
', beyond the control of tneca tractor, the time of such delay :�nd intPrruption
snall be added to said '��ve months; but this delay snr�ll n�t coi��'titute
- a claim oy the cc�ntiractor agdinst the City or City Council or against�

tlon that tne respective areas of the lots o: tracts oi ldnd in said Dis-

hignU�ays, s�reets and alleys and shall, by suclz o�dinance , cause to be
issue�, made out and certified, in favor of the c�ntractor to be pdid for

SECTIOFT 1'1 . Ail speeial tax bills so issued as dforesaid, shall

in accordance with l�w and with the Statutes of �?�,sso�ri, and shall so
expressly sta.te on their face, and eversT suct� certified tax bill, in any
suit thereon, shall, in accordance v��ith ?�ac��, be prima facie evid.ence of'
the validi ty of' the bi11, and of the doing of tt�e v�ork, of the fu�^nishin�
of the material charged for, and of the liability of the land to tae
� ch�arge stated in the -bill, a.i� said special tax bills s'��.,11 be p�'im�.

tax bills delivered to the contractor, as aforesai�., shall be assign-

and the lien thereof foreclosed in accordance with the Statutes of the
St�.te of �Iissouri for such cases made dnd provided. ;

SEC'"IQN 18. A�ter the deliver;� of said certified tax bills
to the contractor in payment for the construc�cion of said sewers in
Se�,�er District No . 5, the CitSr of C�pe Girardeau, shall, in no event, hor ,
in any manner whatiever, b e liable for, or on account of, the cost of the
work done in constructing said seti��ers, nor lia'�le for the cos�s tnat may
accrue in any action thereafter brought on account of said special tax
bills by the owner or holder thereof. 3
SECTION 19 . ?�hen the said special tax �il:Ls are issued under �
this ordinance �s aforesaid, the City �tgineer shall, in accordance with
la��r, ca�a�e �aid tax bills to be registered in a b:,ok to be pravided ���r t:le
purpose, and snall deliver said book to tne Cit;� Clerk= o� said Ci;,y.

VVhenever any special tax bill issued under this ordinance snall
be assi�,ned, such assign��nent shall be noted on suc« special tax bill,
and tne assionee shall exhibit same to the City Cierk who shall there-
upon, on the m�.rgin o� such special tax bill book, make an apprapriate
� note of such assignment .
The amount of any such speci�,l tax bill and the accrued interest �
may oe paid to sucn C?ty Cierk for the oFvner or holder thereof at any
time, v�ho stiall then, or upon presentation to hi� o� any such ta,x oiLi ,
receipted as paid, note the payment on the reai�try thereof, and such
entry shall be evidence o� the payment of the tax bill as tnerein stated .
