VPHII�EAS, The City of Cape Giraxdeau, by its City Council� on the 5th
day of June� 1922, adopted a resolution declaring it neces�ary to im��rove
th;,t part of Broadway Street froui the east curb I�ne of 3[ain Stxeet to the
west cu�b line of Water Street, as set out in the title hereof, and.
�VHF�REAS, By rzrtue of the authority of Commission Form Ordinance h•o.
150, passed and approved on the 27th day of June � 1922, the Council de-
clared $aid improveraent to be necessary and directed the City Clerk to ad-
vertise for bids for said vaork, and,
�IEREAS� F. W. Kel.ler �as a�var�3ed the contract to improve that part of
Broadway Street from the east curb line of I�ain Street to the west curb line
of Water Street by reeurfaci.ng with a reinfarced conerete pavement, accord-
ing to the plans and specifications of the City En�ineer, ancl Por the price
and sum set forth in his propoaal and contract toaccept in payment therefor,
Special Tax Bills to be issued by the City of Cape Girardeau in his favor as
contractor as provided for by Commission Form �rdinance �;o. 50 and Coramission
Form 4rdinance �To. 150, and�
WHEREAS, Said F. W. Ke11er entered into contract and bond for the faith-
ful performance of his contract for the improve��ent of said street as provided
in aaid resolution and C�mmis�ion Form Ordinance �o. ].50 , and the plans and
apecifications, and said worY having been complELed, accepted and approved�
and, - :

of s�aid etreet after same had l�en co�pleted amounting to �917.f0, now, there-

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDF�AU, �ISSOURI �

53��'CTIOI�T 1;- That to� the purpose of paying said F. W. Keller said amount
of �917.6Q e�pended by him aecording to his contract z�a by refcurfacing with
a reinforaed concrete pavement that part of Broadway Street from the east curb
line of ]dain Street to tY:e west curb line of�ater Street b.y resurfacing
with a reinforced cor�crete pavement, in the City of Cape Girarde��u, �isaouri ,
which su�n is lxritl�.in tne estimate of cost �ade l�y the City En�ineer, said sum
of $917 ,�i� is hereby levied, apportioned� asaessed and taxed a3 follorvs
a�;ainst the lots� fronting and abuttin� on that I�art of Broad�vay Street as
hereinbefore get aut. The $treet herein �entioned was constructed u�der and
by virtus of the authority therefor as is provided for in Corruniseion Form
Ordinance �To. 54 and Cor�znieaion �orm �rdinance �o. 150. Said property lots�
paxts of lots� piecea and parcels of graund lyin� and bein� situated in the
City �f Cape Girardeau, County af Cape Girardeau and State of �dissouri, are
described as hereinbefore eet out� to-wit;-

Keller, c�ntractor, for resurfacin� wit�z a reinforced concrete pavenient that '
part of Broadway Stree� from the east curb line of lBain Street ta the west
� curb Zine of VQater Street and against all the lots� parts of lots� piecee
and parcels of land fr�nting or abuttin,�, on Broadway Street, betweer� the poxnta -
menti oned herein� and assessed and taxed as required by law and the Ordinancea
of thie city. All of �►hich Speci�,l Tax Bi l, g a,uthorized to be issued herein
ahall be a lien on said lots, parts of lots, pieces and parcels of land and
shall bear interst at the r�e of' eight ( 8�) per cent per annu�i after thirty
� 30) days from the date of issuance thereof until paid and eaid Special Taac
Bi lLs shall sa expresely state. Said Special Tax Bille so iseu�d shh�..11 be de..
livered to F. W. Keller, contractor, and for said �rork ot �esurfacing with a
reinforced concrete pavement on Broadway as herein aet out and shall be sub-
stantially in the following form.
SECTION 3;- This Ordinance shall be in force from and after its paesage.
