All officers elected oi� appointed to offic� unaer the city
� government of CaPe Gir..rdeau shall be male citizens of the United
States, oi� male persons of foreign birth �rho have declared their in-
terltion �o bocor�.e eitizens of the Uni-i.ed States according to la�v not
less than one ( 1) year nor �,�ore than five ( 5) years bexore their
election or ar�po3.ntment, and shall be o�rer the ��e o� t;r�enty-one ( 21) �
�.
years, and shall have resided in the Stµte of iriissouri. one ( 1j year
next preceding their election of a;�pointraQnt and during the last si�ty
( 60) days of time sha11 have resiu.ed in the City of Cape Gir.�rc�eau, and,
except the City Sexton, must be residents of �the Citf, and no person
sha11 be �ligible for election or a�pointrnent to office under the city
,
government who is a soldier o-r marine in the r�:.-gular army or navy
o� the united St�tes, or a_n inm.�a_te of any �oor house or asylum at
public expense, or confined in any jail, or �iho at the time of his
election or a_�poin�ment is in arrears for ary unp�ic� city taxes or

forfeiture or defalcation in office.

fore entering upox� the dischar�e of the duties of his office, give
bond to the city in such sum and ti°rith such surety as shail be desi�nat-
ed b5� ordinance, conditioned for the z'a.ithiul perforn�ance of his
duties, and that he vli:il pay over all moneys beionging to the citSr,
as provided by lavr, that may corae into his hands. If' any person
elected or appointed to any oifice shall fail to take and subscribe
�uch oath or affirmGtion or to give bond as herein rea,u�.red, his

bond, suit may be institu�ed thereon b,y the city, or by �ny person
in the name of the city for the use of such person.

corrupt misconduct or neglect in the discharge of any of the duties,

in the performance of any official duty, he sha?_1 �.�e deemed guilty
of a �r�isdemeanor, and upon conviction thereof shall be �uziished

Any f ailure on the pa rt of any City Gfficer to pay into

If a vacancy occur in any elective office, the i;iayor
or the person exercisin� the oyfice of i��ayor, shall cause a
snecial el�ction to be held to fili sueh vacancy, giving ten ( 10)
da�rs no�,ice thereof by proclamation pia.�lished in some ne�spaper
published in tho �ity; provided, ho�ever, v�hen any such vacancy
occurs c�it�zin six ( 6) months of a g�neral rnunicipal election,
no election shal� be called to fill _isuch vacancy, but the same
sha1�. be filled b�r the T�;iayor, of the person exercising the o_'�ice
i�.ayor, b�- appointm�nt; provided, iurther, that any vacancy in the
office of councilman ti�nich may occur within said six (6) months
shall :be iilled by a special election, held under the ordinance
governing elections o� city officers. If a vacancy occur in any
office not elective, the i�;iayor s.hall apnoint a suitable person
to dischGr�e the duties of the same until the ffrst r:_:gul�r meet-
in� of the Council thereafter, U_t �rhich time sucn vacanc�r :hall
be permanently fill�d.
