INSP�C�POR OF �`�'EI�H TS A.N� '�I�ASURES. There is hereby created in the City oz" Cape Girardeau, the of�ice of Inspector of `��ei�hts and �Ieasures. The du�ies relatin� �� such oz"fice as provided in this ordinance shall be performed by the Superintendent of Public Safety or under his direction. ; SEC TION 2. . PO'�TRS OF 'I'�IE INSPEC TOR. The Inspector of �Neights and I�Zeasures shall possess �urisdictim ; ; and have power within the i%ity of Cape Girardeau; (a ) To inspect and t est the accuracy of all measu��es oi every kind and tools and applicances connected therewith, used or em�loye3 within the City in determining the v�ei�ht, siz�, pressure, quantity or other dimea- , sions of any liquids, solids, gasses, or ocher articles of�ered for sale , or for hire or award. (b ) T.o reweigh or measure any package put up ready for sale or � deliver,y, or any amo�nt of any commodity whatsoever, o��'�ered for sale, or soH by wei�ht or measure. (c ) To enter vrithout formal, warrant any stand or place, build- ing or premises, or to stop any vehicle or conveyanee in or upon which any measure or m�asures or wei�h�ed or measured packa�es or arnounts of commodity ; % are kept or maintained or carried, �or the purpose of testing, inspecting, correcting and sealing or condemning such measure or measures, or revreighing r or remeasuring such packages or amounts o� commodity, either upon his own initiative or at the request of the I�ayor of said city, or upon the �iling by any person of a repuest in the office of the Inspector of �,veights an,d �� measures. S TANDARD OF '.�lEI GHTS AND TJLASU�ES. < The standard of weights and measures sha�l be those presc�ibed �; by the state o� ��4issouri, in Article 1, Chapter 125, R.S. 1909 and any amendments thereto, and the standards of «rei�h�s and measures as establish- � ed by the national bureau of the Department of Commerce of the U. S . SEC'nION 4. QU.'�N l I TY TO B E AS K�PRESEI�I TED. It shall be unlawz"ul to sell or offer for sale any commodity or article of inerchandise of any kind whatsoever, whether sold 'oy dr� ; measurement, liquid measurement, linear measu��ement, superficial measurement, solid measurement, or by wei�ht or by any unit of enumeration used in determining or measuring auantity, including wa�er and gas meters, in quantities of less wei�ht or measure or enumeration than the wei_rht or measu� or enumeration represented by the vendor or his agent or employe upon sueh sale , or of�er for eale, or to sell or offer for sale any commodity in any receptacle containin� a less quantit;� than it is renrese:�ted a t the time of � such o�fer o� sale to contain or any article or commodity measured by any method herein enumerated, except as provided for in the next succeeding section. SEC?'ION 5. TOLE�ANCES: Tolerances shall be permitted under the provisions of this ordinance, and the toleran�es shall not exceed 30 of the weight or measure so used. � SECTIQN 6. Any person, �irm or corporation whose business ' is to sell to the pu�lic, any commodity article or thing which said com- ' modity, article or thing is sold by wei�ht or measure or is to be paid �or ` by wei�ht o�^ measure at a certain vrice per unit o� urei;ht or measu�^e and who gives short vrei�ht or measure to said eustorner, shall be de�=med guilty :� of a misdemeanor and upon conviction thereof shall be fined not less than ; �5.00 nor more than `�100.00 for each such offense . � � SEC�ION 7. TERM ';�'�,'IGHTS AND P.ZEASIT°ES TO INCLU�E "JhAT. By the term weights and measures as used in this ordinance, shall be taken to mean and include any means or me thod o-0 weighin�; or measuring any oommodity, dry, liquid or gasses, and shall include seales, beams, meters, vreights and measures of any and every kind or description, and by any name by whieh they may be knov�m and used for ouaging pressure or as- certainin� volume in either liquid or dry commodities. SEC TION 9 . ICE; SALE AT RETAIL REGULATE�. Any person, firm or corporation, agent or employee, selling ice at retail in said city by delivery wagin, must sell by �reight and shall attach to e�ch wagan, scales of standard quali �y, in perfect condition, to furnish correct weight, and shall ��aei�h the ice before deliverin:,, and shall in�orm the eustomers of the correct and �rue weijilt thereof, which shall not � be less �han the money or ticket collected the�°efor. SECIION 10. ICE :'ICKET; COUPOPIS . l�n�r such person delivering ice upon ticket or eoupon, shall � ur��w � have the number o� pounds said cour�on enti�les the custamer to, printe�n plain figures or letters thereon, and it shall be unlawful for any such person to take such ticket or coupon in the co�arse of �rade ior less number o� pounds o� ice than said coupon calls for. . ; SECTION 11. COAL TO BE SOLD BY ;`IEIGHT. + It shall be unla�vful to sell or offer 1;o sell any coal , coke o� chareoal in any other manner than by weight , and a City �Jeigher' s ticket � ; �ri th � shall be �urnisiled/each ton or part of ton so sold and delivered. 1'rovided that the quan�ity not to exceed two-hundred (200) pounds of any such pro- ! ducts may be sold by measure. It shall be unlawful for any driver or any o�her person to di- ` minish or cause or permit to be diminished the quantity or wei;ht of any � � article or commodity after �x�ei=;hing and be*'ore the delivery of the same � � to the purchaser thereof, and the �+Iayor or any Commissioner or any Police � Officer or the Inspec�or of ':;eights and T�Ieasures is hereby empoivered to stop any vehicle conveying for delivery to a gurchaser any commodity weighed ° wei hed � on street or vJagon scales, and to order same to be%p�� over the City scales, for which there shall be no charge. It shall be unlawful for any person, firm or corporation, or � employee or manager thereof, �o offer for sa1e , or keept in any �ercantile or i ; other es�ablishment selling joods to the public, any scale or measure known i to such person to oe incorrect, or �o use same after being condemned before � oein� readjusted, or to use a scale designed i'or one v�ei�ht or measure in weighin�; or measuring merchandise whicl� should be measured by another scale or standard, or to have on the counters or shelvin�, or offer far sale, any article, in any packa�;e which misrepresents b� printing o3 othe�yvise, its true �veight or quality. It must be free from amonia, and must not contain more su7.phur �;han v�rill turn a piece of paper, which has been dipped in lead acetate a light brovm, when burning at L-he rate of one cubic loot per hour, in a fish �;ail burner. It must in �.11 o�her respects comply wit�h the rules and tests �or quality as fixed by the R1lissouri f'ublic Service Co�nmission. (a ) A s�andard heating value of 600 British thermal units gross per cubic foot must be furnished, Provided tha,t a de�iciency of 50 Btu. on any day m�y be allo�rrecl wi thout penz.l ty. All gas furnished must mee� the requiremenL-s of the I12issouri Pu.blic Service Commission, when tested by the 3�f�`J�t'� hydrogen sulphide tes�er, designa�ed, "S tandard Flppara tus", and mus t no t contain �ore t'r.an 30 �rains of amonia per 100 cubic feet. The Inspector of ;'�'eights and T�Zeasures may at anytime test, or have tested, either water or �as meters, and upon tne written request o� �' a resident user o� gas or water, he shall test or eause to be �ested � either the vTater or gas meter furnished such resident user. I� upon the ' � testing of said meter �wi. it is found short or defective, and registering more than it shouldi the City shall pay the cost of the inspection, but if �'ound correct, the resident user, making the Prritten request shall pay �o this City the sum of •„1.50 to be placed in the General Revenue �'und. SEC TION 18. DU`I'Y OF C I TY CZ�RK. • � �� Upon receipt of such records�the City Clerk shall promptly noti�y any person, firm or corporation whose recard of service pressure is thus tiled, o� the �act of such tiling, and of the number of days of delinquent pressure for such period, as req��ired by Section 16 ; and sueh person, iirm or corporation shall compute and base its service pills � against its several eonsumers in each district respectively in accordanee with said record in such district, by making reductions in proportion to the reduction of pressure furnished consumer. SECTION 19 . TO BE FINED �OR CO?ZECTING ��IGH� RATE, ETC . Any person, firm or coz•poration engaged in the publie servicse of supplying gas- vJithout making the connec tions Por determining pressure, or who shall char�e, exact, collect or attempt to collect a hi�her price ; than the service calls for under tnis ordinance or any person who as superintender�t, manager or person in charge ot', or ior such person, firm o� eorporation who shall so offend, contrary to the provisions of this F ordinance, shall be deemed �uilty of a ��sde:�e�nor and upon conviction shall be punished by fine oz' �:o i, less '�han ::;�5.00 nor more than �100.00 . SEC�`ION 20. �.�'E�'�'ED VIO�ATIOTIS. I� upon a third inspecticn, any scale, weight or measure, is found to be short; or upon a tnird violation, of any of the provisions of ' this ord_inance; and �vherein the attention of the ot'fender has been called ; � ' and s�:id offender has and does not i�nmediately correct tlie sdme, he s�all 6 � � , \� - i 3- � � be deemed gu.ilty of a misdemeanor and upon ccnvic�ion thereof be �ined not less than �5.00 nor More than �100.00. SECTION 21. PUNISHIt�ETdT. Any person who sha.Il violate any provision of this ordinance where a specific penalty is not pres�ribed, shall be o ilty of an of�ense _ against the ordinances o� said city and shall be punished by a fine o� � no� le s s tY�an �'en (;�10.00 ) Dollars, no r more than one-hundred (<�100.00) � Dollars.
