Girardeau� s�ecific lic�nse tax, as herein provided and given the here-

date issued, and be based on the assessed valuation of � he stock�

and shall pay a license tax of $15.00 per annum.
Provided that merchant� just commencing business and not h�ving
made a statement shall be classed accordir� to the value of the stock at
the time commencin� business, and for that purpose shall furnish a
sv�rorn statement of the value ther�of at the time of makir,g appl.ication
for licen�e which shall also be rated on a 40°6 assessment valuation� as
otr:er property is valued and assessed.

SECTION 6: LICENSE, HOV'� PROCURED. It sha.7.l be tY�e �uty of every appli-
cant for a license to pay to the City Clerk the amount required by tr.is
ordinance to �e paid therefor� takir� his receipt therefar� which re- j

in the provisions of this orainance shall pay an advalorem tax equal to
that, which is levied upon real estate� on the highest amount of all
goods � wal es and merchandise `vhich they have in the�r possession and
under their control� whether o�med by them or consigned to them for sale�
at any time between the first Monday in March anci �'irst Sunday in June ;
provided th�t no cornmission merchant �hall be required to pay any ac�-
valorem tax on any manufacturer article , the grov��th or groduce of
this or any ot �er state � which� a E been consi�ned to him fcr �ale,
and in �:�hich he has no ownership or interest other than commis�ion.

facturer liable to any tax under �his ordinance� when agplying for a

City of Cape �irardeau� ��ith two or more good and suifici�nt sureties

June in each year� it shal�_ be the duty of every merchant doing business
within the City to fur•nish to the assessor of the City a sworn statement
of the greatest amount of' goods� wares and merchandise �hich he may
have had on hand at any one time between the first �Ioney in 1Gla�ch and
the fir•st N�onday in June next preceeding� and said statemer�R shall in-
clude goods� wares and merchandi�e owned by such merchan t� or consignecl
to him for sale by other parties.

of the aggregate amount of all goods� wares and merchanciise taxable by

After the County Board af �qualization shall �a�e completed
the equalization of such sta�emen ts� the valuatior as fixed b� the
� Board of Equalization on the County �lssessar's Merchants and ffianufac-
turers Tax Book shall be entered by the City �ssessor on the Ctty
Merchants and R��anufacturers Tax Book in red� ink� �.d returne d to the �
City Co�:�cil.
�n3 �he Council shnl 1 levy taxes on the valuation� as fixed
by the County Board ai '��qualization at the same rate as �.s��essed for
the time on real estate � and the City Cl�rk shall extend on such book
al� proper taxes at such ?'ate � and shall� on or befo re the first
d�.y of October make out the tax book. And the sum of the valuations
of the � t��tements as equal�zed b�- the County Board of Equalization
shall be included in and made a part of the to�tal valuation of proper-
ty taxable f or c i ty purpo se s.
SECTIO�T 17; BOTJD DLLiv�D FORFEITED. ���IEN, Every m�.,�chant. o� r��.n.ufac-
turer to .vhom a license shall have been granted under th�.s ordinan_e �
and ssJh�� shall fail to file his statement at the time and in the manner
requir•ed herein� or who �as filed a correct st�atement and failed to �
pay the amount of revenue so owing to the City Clerk � shall be deemed
to have forfeited the bond given by him� an� judgment sh�17_ be rendered
for the plain�iff city in dar�ages for doubl� the amount of su�h re�'enue
and costs. And eve_ry merch�nt or manufacturer v�ino sha.11 �'ile or
sui E'Er t,a b� #'iled a false stater�nt shall. be deemdd to have forfeited
the b�rid given7�him under this ordinance� and judgment shall z�e render-
ed for the pl,aintiff city in dama;;es for three times the amount of
revPnue founc� to be due for the year� and costs.
SECTI�IV' 18. PROCEEDINGS �N FGRFEITUT-�Ea. Upon the forfeiture of any
bond as provided� it sh�ll l�e the duty of the City Clerk to institu$e
suit �^rithout delay� by the City Counsellor az� b thP City kttorney� if
ther2 be no City Counsell�r� upon the bond forfeited� against �he
� principal �nd all suz'Pt1P..S� jointly or s�verall,y� asrnay �e deemed ad-
visable .
SECTION 13, EVIDrfi�CE Or� �P.�O;.?NT OF T�:. In all suits upon such books a
certified copy of the statement� hereinbefore required to be filed in
the office of the City Clerk under his seal of ofric�� shall be evidence
of the amaunt of taxe� due from such merchant or manufa�turer� so filing
the same ; bu�, the City Clerk or Attorney iorosecutin�; the suit may sho�v
by competent testimony that such statem�nt does not contain the full
amo �nt of taxable property reauirea to be returned� and �:rhen no s tate-
ment has been filed� he may show by such testimony the amount of taxablv
property that should have been returned.
SECTIOAp 20: LICENSE FOI�'EITED. ';a�EN, Any rr�rch�.nt or manufac ture r
licensed under this ordinance T ��,Tho shall. knowir�ly file or su=:�er to be
fileci a ia���; �t�i�em����;� of the ���;gregate arnount of go�ds� �vares and �ter-
chandise� or ra��r material and f�.nished product�� tools� ma.chinery� and
appliances � required to be filed� shal_l� upon conviction� forfeit his
_ license� and be deemed guilty of a misdemeanor� and upon convicti�n
thereof� shall be punished by a fine of not less tha,n twenty-five dollars
($25.00) and n.ot more than one hundred dollars ($1cJ0.00) or by imprison-
ment in the �C�ty J�il for a p�riod not exceeding three (3) months.

any merchant or manufacturer to engage in h�s business at more than one
plaLe within the City of Cape Girardeau , nor for a longer� period th�.n
twelve (12) months.
SECTIOT�; 22. CITY CLy::RK TO C:�LL rr'Oit LICr��SE. tid�N. It shal_L be the duty
oi the City Clerk to call at least as often as once in every three
months on all merchants or manufacturers who are required by this or-
dinance ta take lic�nse and to ofter to furnish such as have no lic�nse
� �rith a license, ancl the City Clerk shall repo��t to the City Attarney the
na.me s and localitie s of ala_ perso ns whd� refuse to tak2 out or renew '
their license at the proper time � as required by this ordina�c�.
SECTl��T� 23, B^I�D TO BE GIV�N AIv�D TAX TO BE PAID IN C�RT_aIN CA�::E�.
4i�'hen any merchant or manufac�urer sh�ll commence his business in this
� City after the iirst Monday in June in any year� he shall execute a bond
as provided ior in Sections 9 and 11 of th�_s ordinance � conditioned
that he �vill on the fi»st day of �ovember next succeedi� furnish to
the Assessor of the City a statement veri�'�ed as herein required of
the largest amount of goc�ds� wares or merchandise � or raw rraterial
ancl finished products� tools, machinery and appi?ances, which he had on '
hand c�r s�nbject to his control� whether owned by him or con5igned to
him for sal� � on the first day of a.ny month between the time when he
commenced business and the said first day of November ne�t succeeding?
upon which statern�nt he shall pay the samp rate of tax as other mer-
chants and manufacturers� to be estimated as the time from the day an
vahich he commenced business ta the first Mond�,y in June next succeedin`
shall be to one year.
SECTICN 24; PENALTY F OR VIOL:TI�N GF ORDII��IN��E. Any �erson' firm�
com�any or corporation violating any of the provisions of any section
of this ordina�ce where no penalty is prescribed by such section shall
be deemed guilty of a misdemeanor, and,upon conviction' shall be
fined not less than twenty-five nor more than one hundred ($100)dollars
or �y i.mprisor.!r�env in the City Jail not less th�Y. (10) ten d�ys , nor
more than three months � or by both such fine �.n��. im��rison+nent.

hand with which the applicant proposes �to commeneP business� or if in
business the total valuation of all stock received at his shop or
place of business during the six montlzs precedin� thA date of such

SECTION 5. D"JTIES OF CITY CLF,:E3K. After the filing of said application
� and statement� the City Clerk shall ascertain #�he amount, of advalc�rem '°
taxes ta be paid by such applicant, which� tagether with the license tax
and fees for issuing the license � shall be made ta the City Cler�c befos�e
such applicant shall be aut,��orized to transact business.
SECTIGIV 6. T� ON LICEN;"E. On each dramshop licen se thAre shall be paid
to .the City Cler�c before its delivery to the pe��son entitled thereto�
a license tax of $350.00 for every six months. In addition to said
license ta�: there shall. be levied and collected £or citv purposes an
advalorem tax oi the same amount as that paid the city by merchants upon
their merchan�ise.
SECTIt�iJ 7. INTO?�ICnlii� LI�UORS CONSTRUED. The term intoxi.cating
liquors " as used in this ordinance shall be construed to mean ferme�ut-
ed vinous and spiritous liquors or any composition of ��vhich fermented�

SECTION 10. PE�T�L'I`1' FOR N�JT t F�CUR�NG LICE_rSE. Any person who shal l
directiy or indirectiy� sell or offer for sale � intoxicating liquors
or shall do business as a dramshop keeoer, v�rithout f'irst having pro-
cured a license to keep a dramshop as in this ordinance provided� shall
be deem�d guilty of a misdemeanor and each and every such person so
offending� shall upon conviction be fined in a sum not less than forty
dol_lars nor more than one hundred dollars .

on deposi�E as a collateral security� or as a delive�y on sale ther-eof. �

of such property purchased or received on deposit as collat�ral security�
