SECTIONI. FIRE LIUIITS E�TI'�BLISHED. The following is �
hereby established and defined as the fire limits of the City of �

Cape Girardeau, Missouri. �

Be�inning at the intersection of the west bank of the �
,,
Mississippi River and the center line of Bellevue Street and �
Bellevue :-treet produced, thence run w est along the center line of �
�
Bel.levue Street and _�ellevue �treet praduced, to the center line of
Pacific Street, thence run south along the center line of Pacific �

Street to the center line of r��organ Oak Street, thence run east �
along the center line of Morgan vak Street and along the center �

line of Morgan Oak Street produced to the west bank of the P�ississ- -
ippi River, thenee run northwardly along the west b�nk of the

Mississippi River to the intersection of the west bank of the Mis- �
sissippi River and the eenter line of Be�levue :treet produced, the
place of beginning, comprising a11 territory within the following
boundary; Bellevue Street on the nor�h, Pacific �treet on the �
�est, Morgan Uak on the south and the west bank of the '�Iississippi
� i;iver on the east.
SECTION 2. It shall be unlawful �for any person to build,
� �
construct, or erect or cause to re built, constructed, or erected �
in the fire lf.mits of the City of Cape Girardeau, any ahed, house
or building;; unless the outer walls of same are built �rith stone, .�

brick, cement, or other noncombustible material, provided this �
�
ordinance shall not appiy to a wood-she d or coal-shed or other

buildirig when the same is le ss than ten ( 10) feet square and

�vhen such buildings are covered with metal or some fire-proof �

- material. '
SECTION 3. The roofs of sheds, houses, or buildings Which may
bs erected within the above described fire limits shall be of fire-

proof material; and if an;t shed, house or building now standing with-
� ,
� in said fire limits, shall be extended in any manner or made higher, ;
,�,- �
such extension shall be constructed of stone, brick, iron, cement, '
- or other noncombugtible material and cove�ed with fire-proof material. ;
SECTION 4. It shaZl be unlavuful for any person to move any ;
wooden shed, house or building into said fire limits. �nd no per- i
�
son shall remove any wood-shed, house or building situated in said
fire limit�s, from one lot therein to another, without first being 1

granted permissi�n so to do by ordinance, provided that nothing in �
this ordinance shall apply to a �ood or coal-shed or structures �
�; �rhere the same is less than ten feet square and when covered with i

metal or fire-proof substance or porches and other awnin�;s i��hen the �
� roofs are covered with metal or some fire-proof substanee. .�

� SECTT�N 5. It shall be unlawful for any person in this city �

to occupy or obstruct any streeL, square, avenue, alley or side-
walk without first obtaining written permission from the Ma�ror or �
the person acting as Ma�or, so to do. And such written permission i
shall sp�cify what portion oP the square , street, a11ey, avenue, or

side-walk uuhich shall be used and for what period of time it may be a
so used in ttle removal of the building. And it shall be unlawful
for any person or peisons to occupy or obstruct any portion of any
street, avenue, alley or side walk other then specified in such �
written permission for a longer time than therein granted, provided �

that for the removal of an� hous= or building from one lot within
the fire limits to anoLher iot within such limits, such permission �
shall be�;ranted only by ordinance.

SECTION 6. It is hereby made the duty of the City Marshal
i
and police force of the City of Cape Girardeau, to report any and
�
- all �violations of this ordinance to the City Police Judge, who �
�` shall thereupon issue a warrant against the person charged with
�a
�'' such violation and have him brought to trial. � �

� SECTION 7. It shall be unla�rful for any person to allow
� or permit any wooden shed, house or building, not at present con-
struc.ted, to remain standing within said fire limits, and each day
the same is allolved or permitted to stand within such limits shall
' constitute a separate offense, for whieh conviction may be had, �
�

provided, such building is less than Len ( 10) feet square and cov- '
ered with a metal roof. �

- SECTION 8. LIVER�, SALES OR FEED STABLES, MANUFACTURING �

PLANTS, OII� DEPOT�, SLAUGHTER HOUSES, PACKING uOIISES, ETC . , ALLO`rV- �
� ED, ':`:'L'_EN. No �erson shall hereu��.er erect, or cause to be erected +

or build any slaughter house, manufacturing plant, oil depot, miil, '
packing :nouse, livery stable, sales or feed stables or any building �

used for any purpose liable to !ecome offensive or annoying to the '

neighborhood, �aithin two hundred (200) feet of any residence, mer- �

cantile building. factory, or other occupisd building in the limits
of the city, unless two-t,hirds of the property owners of the block ?

in which said slau�hte r house, manufacturing plant, oil c3epot, mill,

packing house, livery, sales or feed stables, are proposed to be '

erected, shall first fiZe euith the City Clerk their consent, in �
writin�, to the erection of such building or buildings, and the �
� further approval of the City Council to such erecLion endorsed thereon. �

Any person who shall construct, build, or place or suffer any j

wooden buildin� to be constructed, built or placed within the fire �
limits of the City of Cape Girardeau, contrary to the provisions of �
this ordinance, or shall erect any building or improvements within
this City, without first having procured from the Building Committee

this ordinance, shall be deemed guilty of a misdemeanor, and,

upon conviction shall be fined not less than ten ( 10) nor more than s

one rundred dollars !

continue in the violation of the provisions of this ordinance. '

; Whenever it shall co�e to the knowledge of the �Ia��or that any :

_ building or part of any building, as aforesaid, is being erected,
or has been erected, or placed within said limits in this City in '

violation of this ordinance, iL sha11 be the duty of the Mayor, with-

out delay, to give notice in writing to the owner, or owners, thereof, '
as the case may be, to remove the same within five ( 5) days from �

the service of the notice.

the City Marshal and of any policeman to ascertain when any bnilding

�� store or other improveu�ents are being erected, to investigate and �
learn whether or not parties have eompl3ed with this ordinance and �

p p permit, and if not, then to report the game to

the City Attorney, uvhose duty it shall be to prosecute such a person.
An� if any building sha1.1 be ordered removed by the Mayor and shall
- not be removed within the time allowed, the City AHarsh�l sh�ll,
under the direction of the a�a�aor, remove the same , in whatever man-
; ndr he may deem best, and charge the cost and expense thereof to
the owner�.
SECTIOId 12. UNLA��1F'UL TO PLACE OR MAINTAIN LUMBER YARI�S,
�1HERE. It sha11 be unlawful for any person hereafter (without first

obtaining permission of the City Council) to place or cause to be
placed or maintained any lumber yard in this city within the fire
limits defined b;T this ordinance, now shall any person firm or cor-
poration, pile, stack, store or keep an�r lumber within fifty ( 50)
feet of any public or priv�te building in such quantities as to en-
danger any of such buiiding from probable fire or from falling
stacks of such lumber, so as to affect its value or convenisnce

� SECTION 13. That ordinance No.565, approved �ecember,l6, �

1895, and all ordinances amendatory thereof and ordinance No.lp�g °
and all ordinances in conflict with this ordinance are hereby re-

pealed, and this ordinance shall take effect and be in force from �
and after its passage. i
