SECTION 1. QUALIFICI�TIONS OF OFFICERS.

zans of the United States, or malo persons of for:�a.��. birth �rho
have declared t�ieir intention to becom;; citize��.s of the United
utut�s accoraing to la� r_ot less than one ( 1) year nor rlore thr�.n
five {5) ;�ears bafore their election or appointment, and sha.11 be
over the age of tt�ent;�-one (21) yoars and shall be qualified voters
under the l�v�� and Constitution of tho State of Missouri and the
Ore3ii3anc�s of ti�e City oP Cape Girardeau, and shall ha.ve resided
in tha Cit� of Cape Girardeau not less than onQ ( 1) year noxt
preceding their elect3on or appointmont, and, except the City

, SECTI01�1 3. BUND.

If any person el�cted or appointed to any o�'fi1�e s:�all fail to
take and subscribe such oath or affirn�.tion or to give bond as 1
hersin required, his office shall be deemed vacant, For any breach �
of condition of such bond, suit may be instituted thc;reon by tne
Cit�, or by any person in the name of the Cit;� for tha use of sucn
person..
All officors ' bonds shall be approved by the Mayor and

a.ny duty required of th� principal, nor of any chan�e or alter-

or by any ordinance of the city, although the same may be made �
af'ter the execution of said bonds .

The City Council sha11 from time to ti.me ex�mine the

bonds of all City Officers and ke:p its�lf advised as to the con- �
dition of the sureties thereon, and ma.y, at any time it deems �

necessary, demand a new bond, and if the porson of whom a new `'
bond sha11' bs required shall fail to �ivo such bond �ithin seven �
days after he s?�all be required to do so, his office shall be ,�

Tho suretlea on any bond given in pursuance of this ordi��ance may �,
at any time after the execution of said bond, if tney, or either
of therz, have �ood reason to believe tnat the aff?cer in said �

, with the City Clerk a notice, in �vriting, verified under oath by �
the person asking to be discharged, setting forth the facts in �

the c�se, and asking to be rel�ased from any further liabilit,;� ;�

on said band; �rhereupan the cl�rk with �hom such notice shall �

be filQd shalZ not3.fy the said officer to �ive additional socuritg, :a

equ�l to the security about to be released by the City Council;

which notice may be served by the saic� Clerk or by an�r person ap- �

of its departments with an annual or monthly salary, or for a
definite term of office.

SECTION 7. DELINw,II:�'ivTT �:�FICER; N�YOr� TO PROCEED AGAINST. �
If any officer of the City appointed or elected by tho Cityr Council

sha11 fail to perform in e�rolc� or in part faithfui]_� the �uui��, �
obli�ations and labors enjo3.ned upon h3m under the ordinances of �

the City, he shall be at once rsmovod by a ma3ority vots of �he ;�
mambers of the Council, as provided by Section 8, page 523 0�' the .�
Lar•�s of Missouri, 1913. . �
And if an�r officer shall be guilty o£ any v�illful or ��

` corrupt misconduet or ne�lect in the dis�harge of �,ny of the du- '
ties, obligations or labors required to be by him performad by
an�r ordinance of tho City, or if he shal]. become ar be intoxicated

gu3.lty of a misder;ieanor, and u�on con�iction thereof sha11 be pun-

Any fail�are on the part of any City Offi4;er to pay into ��
tne treasury of thQ City the balanee retiorted to be due from him

forfeiture of his ofz"3ce, and such balance sha11 boar interest at ��
the rate of ten per cent per annum from the time it should havo
been aecounted for until it shall have been paid into the treasury; i1

SEC^lION 8. MAYOR AND COL�?CILP+�}'N P?.AY BE R�T�OVE+'D.
The holder of any electivQ office may be rernoved at any time by the
elect,ors qvalified to vote for a successar of such incumbent, and
the rul�s and procedure to effect such removal of any incumberzt
of a.n elective of'f ice shall be governad by Section 19 pages 528

SECTTON 9. CURRUPT ALLOsr�ANCE OF CLAIM; IiOVi� PUNISHEn.
Any member of the Counc3.1 or officer of the City who shall, in
official capacitg, or under color of his of'f'ice, knowingly, wil-
fully or corruptly vote or assent to, or ro�aort in fr�.vor oF, or
aZlor� or cert:ify for a11or•�ancQ, any c�aim oz� dernan� ayain�t ��3 ;
City, which claim or aeriand shall be on acca�a.nt of or color of ''
a contract or agreemont not authorized by law and the ordinances
of the City, sha11. be deemed guilty of a misdemeanor, and s11a11
upon conviction thereof be punished by imprisonment 3.n the Gity
Jail for not more than one ( 1) year, or by a fine oP not less
than five ( 5) nor more than five hundred dollars (`"'500.00) , or b ��

both such fine and imprisonment. °
SECTION 10. OFFICER PFtO�iIr;T`:.'ED FROPJ: BEI�:G I�'T��R'r:;STED

If any City officer snall be diroctly or indirectly interested in
� any contract under the City, or in any work done by the Citg or
in furnishing supplies far the City, or any of its institutions, �
he shall be deemed guilty- of a misdomeanor, and upon conviction �

thereof, shall be punished by a fine not less than five nor ex- ��
cQ�ding turo hun3red dollars (�200.00) , or by i.raprisonment in the
City Jail not oxcaeding �ix months, or by both such fine and i.m- ;,

prisonment; and upon the City Council, or any memb�r thereof, �
becoming satisfied that anp officer of the City is so interested,
the Council shall, as soon as practicable, be convened to hear !

and determine the same, and, if upon i.nvestigation, such officar
be found so interested by a ma3ority of all the mambers elected i

to the Cour�cil, he shall be i:mnodiatel� dismissed from office. �

Every officer or person holding any trust or appointment who shall
be convicted of any wi].lful misconduct, misderr�eanor, malfeasance,
misfeasance or nonfeasance in office, where no s�ecial pro�rision
