and repealin� 4rd3.nances Nos. 954 and 972.

I
There is hereby created the office of City Cl�rk. The City Clerk i
shall be elected by a majority vote of the City Council and hold �
his office during the will or pleasure of the Council and sha11 j
hold his office untiZ his successor shall be duly appointed and
qualified, and who shall discharge such dut3es as are hereinafter
prescribed, and shall be under the direct supervision of tho Super- �s
�
intendent of Accounts and Finances. i
SECTION 2. c�UALTFICATICNS . `�
No �erson shall be appo3.nted to the office of Cit3r C�Prk who does �
not possess the qualifications requ3.red for officers of the City
and who has not resided within the Gity for one year next preced- `i
ing his appointment.
SECTION 3. OATH OF OFFIC� AND BOND.
Before enterix�g upon the discharge of thQ duties of his office he
shall take and subscribe the oath requir�d to be tal�en and subscribed
by City officers and sr�ll execute a bond to the Citg of CapQ Gir-
ardeau, in the penal sum of Two Thousand �o�Iars with two good and
sufficient sureties or a bonding or trust 'campang as required for
bonds of City Officers. ;i

Said bond �ith the Mayor' s approval endorsed thereon, - .�
shall be filed in the office of the City Collect,or, �ho shall pre-

serve and safely ke�p the same.
SECTION 4. I3I5 LU'i'IES.

The City Clerk shall un�er the direction of tha S�.perintendent of
Accounts and F3.nances be the �enerAl accountant �of the City and

the keeper of all public account books, accounts, original ordin- ;

ances or resolutions , vouchers, documents, bonds and coupona, paid ;�
or redeemed and all papers relatin� to accounts and contracts of
the City and its revenue, debt and f3saal affairs, not required
by law or ordinance �o be �Zaced in 9ome other office or kept by
some otr�er �erson. �

accurate accounts between the City and all off icors charge� �ith I
�' the collection, custody or disbursement of public moneys and shall �j
enter thereon all receipts and payments, from �hat sources derived `�

and on �hat account paid. �

He shall. keep a complete record of all branches of the ;�
City Revenue, opening an account �ith every appropriation or fund �

�hich, by la� or ordinance, is made a separate fund, crediting the �
same v�ith all moneys paid into the Citg Treasury on account thereo�, '�
ar appropriated th�refor, and charging said appropriation or fund `!

He shall keep a register of all warrants drawn upon the
City Treasurer, specifyin� the number, date, to �hom paya.ble , on �
wha.t fund or a ro riation draarn and the amount of sach �rarrant. i

He sha11 keeb a record of all bonds and obligations of
' the cit�, date of issue, for what purpose issued, ra.te of interest,
time �rhen principal and interest become due, amount ot principal to '�
v�hom payable and the registored number o�' each bond and coupon.
He shall draw all warrants upon the treasurer and shall 'i
express in the body of every v�arrant, the particul�r ftzn.d out of �

which the sa.*ne is to be paid. �
He shall give information, in writing, to the Mayor and �

Counc3l. �henever required upon any sub�ect relating to the fiscal
affairs of the Cit� or touching any duties o� his office, and shall
perform all such other duties as ma.y be rea,uired of h3.r� by the la�s
of the State of Missouri, or by the ordinances of this City.

He shall �.�ave the custody of and safel.y keep the common `j
� seal of the c3ty, the public records, the ori�inal. ordinances and

� resalu�ions of the City* Council, and such other records, documents

and papers of a public nature as may be delivered into his custvdg.
He shall afFix the corr�non seal oP the City to all pubiic -
instrvment� and official acts of the 2�ayor euh3.ch by ia�v ar ordinanc� �'
arQ requirad �o be so attested, and countersign the samse, and affix `�

the corcmion seal to and certify to any racord, documerlt, capies of �
papers or ordinances that may be requirad for evidence in any Court `'�
of' this Stata or of the United States by any individual or that may ��

be requircd for tr�e use of any officar of the City and shall furnish
to the City Attorne� or City Counsellor any record or document i.n
'�
his office neces�ry to be uged in any proceQding in Court to which �
tho City is a party,�rhen ordered to do so by the Council. ��

He sha11 attend all meetin�s of the City Council, and
keep a correct �ournal of its proceedin�s.

He shall prepare all certificates of election, commissions, �
appointments and other official dacurients required by ordinanco to �
be issued, or �hich the I�ayor i� the discharge of his duty is raquired
to issue, and �r.all countersign and affix the common seal thereto, �

and keep a record of all such certificates of elections, commissions, �
appointments and documents. �
He shall prepara blank licenses for all purpa�es for �hich
licenses are to be issued, and when rea,�uired shall cause the samo to �
be issued, si�nin� his name and affixing the seal of the City thereto,

and sha11 keep an account with. the City �ollactor for such licenses �

and the amount of the license tax thereon. .�
He sYzall file the official bonds of all City Officers exzd '�
the bonas of all other persons executed to the City and placas in �
his custody.

resolutions of tYie City Council, such other vouchers, papers, rQcords
and other docwnents as maq be delivered into his custody.
He shall carefully and promptly execute ever� official
duty that may be required of him by the laws of R�issouri, and �he �
�
O�dinances of the City.
He shall oxtend the tax on the assessm��nt book and the tax
book as provided in tho Ordinance concerrin� revenue. �hen the
ta�es have become delinquent, and after settlemer.t �rith the Mayor
and Council by the Collector, he shall transcribe the same into the
back tax book, as provided in the ordinance concerr�ing revenue.
He shall not permit any record or original instrument of
v�riting o�' which he is the legal custodian to be removed from his
office unless ordered to do so by the Council; nor shall he permit
any record or instrument of �riting to be defaced or altered or in
anyv�ise mutil�ted. Provided, ho�ever, that original papers may be
delivered by the City Clerk to the City Attorney or City Counsellor
and Gity Engineer, who shall sign a receipt therefor.
He shall during the months of January, April, July and
October, of each ; ear, prepare and cause to be printed in D8211pY11.�'t
form a detailed itemied statement of all rQceirits and exnenses of
the City and a summary of its proceedir_�s durin� the precedin�
three months, and fu.rnish prirlted copies tn�reof to the City Library, ,

the daily and weekly ne�spapers of the City and to persons �rho shall
ap�ly therefor at the office of the Cit� Clerl:, and at the end of
each year publish the result of the full anc'� complete examination
of aIl the books and accounts of' the City a�hich examir_�.tion has been
made by competent accountants . Such publication shall be made in
� the manner above provided for publ.i�¢ation of quarterly exper_ditv.res.
The City Clerk shall porf'orm all such duties as are re-
quired of him by tho la�vs of the atate of Missouri and tt�.e Ordinances
of the City and such duties as may from time to time be required b�

Si,CTION 5. TEMPOt�ARY CLi.RK; APPUIhTl'I1�IF;NT OF .
Whenever, for �ny reason, the City Clerk is �;nable to p�rform the
duties of his of.fice, the City Council may bg res�lution apnoint a
temvora.rST clerk, �ho shall have all the po�rer and perform all the
' dut3es of the rcgular clerk and shall receive �he same salary for R
�
� the time 3�.e so �cts, but in no event shall both the r��ular and tem-
porary clerk r�ceive pay at tho same time nor shall the re�ular clerk
receive any pay for the time he fails to perform the duties of' h.isof-
fice as herein providQd. The City Clerk, th.e temporar�T Clerk or
�eputy Clerk sha11. be under the supervision of the Su�erintenc�ent of
Accounts and Finances.
SECTION 6. COMPENSATION OF CL�:RK.
The Citg Clerk srall receive as Pull compensation for his services
as City Clerk and Secretary oF the Board of Health such salary
as the City Council shall fix b� ordir�.ance, to be paid in monthlg
installments.

If at any time the amount of vcork required of the City Clerk is more
tr�an he can properly attend t o, the Cour_cil ma;�, if it deems it neces-
sary, by motion or resolution, authorize the i�,Iayor to appoint an as-
sista��t City Cl�rk, w�a shall serve for such time and for such salary
as the Council may provide .

� The off3.ce hours of the City Clerk shall be from Qight o'clock in
�' t?�.e forenoon until t�elve o'clock noon and from on.e o'clock in t�ie
aft.ernoon until fivo o ' clock in tha afternoon each day exe�pt
