There is hereby created the Office of i:ity 'rreasurer. F
� The City �ouncil shall, whenever a vacancy exi.•ts in the office
of �ity Treasurer, select a City Treasurer, who sh�l]_ hold his �
office at the pleasure of the Git�T :: ouncil and until his suc-

cessor is elected, commis�ioned and qualified. H� shall enter
upon the discharge of hiL duties when qu�,liiied and when his
bond has besn affirrr�ed by the City �ouncil and at such time `
as specified by th� �ity ::ouncil either �y motion, resolution
or ordinance. `i

,;ithin seven days after his election or -�,ppointment, and
befoxe entering upon the di:chaxge of the duties o� his office,
the �ity rreasurer :hall execute to the City of �ape Girarde�,u,
%TiU�ouri, a bond in the swn of Twenty Thous�,nd Dollars (�20, �':3��J.
;;� j , v�:ith �.t leati�t �ive good and sufficient sureties, or a �ux�ut;;
bond o�' :.z �ur�t;� ;��:�nany authoxized to do bu::iness in the State
of I�;issouri, sai3 bond to be conditioned that he a�7i11 faithful-
ly perform all the d�.ties of 'his office as required by the l�.ws
of this State governin� cities of the Third Class, and ordinance�
of the City of Cape Girarde�,u, and that h� will account and prompt-
ly pay over all moneys comin� into his possession that belon�; to
tho cit�, at the time and in the m�,nner provided by lava.
The �uretie� on the personal bv�1d shall be worth in unin-
�
cumbered real estate , after payment of all debts and liabilities
for which they s,re leg�.11y respon�ible , and over and above his
homestead int�xe:,ts and exempti�ns, at least double the amount
of said bond. VVhen properly executed, said bond with the 1ui�,yor' s
approval thereon, sh�ll be filed in the office of the i;ity �lerk,
who shall record, pre;erve and safely keep the same. The i:ity
Counc�l may, at any time they deem it necessary, rec�uire the City
Treasurer to give a new bond and other secuxity which shall be
conditioned, approved, filed and recorded in the s�ne manner
as is rer�uired of the original bond.
If the �ity Treasurer shall fail or refuse to give tha bond re-
quired in this section within the time mentioned, or to give a new
bond �,vnerl required by the Gity �ouncil, within 1;ne time by thern
prescribed, his offi�a shall bs deemed vacant.

fying the date of receipt and disburs,ement, from whom received,
to whom disbursed and on what account received and disbursed. '
iie sh:�ll keep a separate account o�' each func� and appropri-
ation and the debts and aredits belon�in� thereto. He shall keep
a register of all warra;lts paid by the rreasurer, desrcibing such
warrants by their date , name of payee , and amount, specif�Ting
the time of reaeipt thereof, from whom raceived, and on what ac-
e�unt. He t�hall c�ncel all bonds, coupons and warrants and other �
evidences of debts against the city whenever paid b y him, by wri- e
ting or stamping across the face thereof "Paid by the �ity Treas-
uxer" with the date of payment v�ritten or sta.mped thereon.
He shall issue du,olicate receipts for a11 sums of money which
m�,y be paid into the treasury, specifying in said receipt� the date
o� payment and upon v��hat account paid. One of theue receipts shall
be given to the per�>on m;�kin;� the payment and the othex he shall
file with the City C lerk who thereon sh311 credit the person named
in the receipt with the amount of his payment and charge the
�.�rea�urer with the payment.
On the lgst week day of each mo:nth re shall file in the o�fice
of the �ity �lerk, a written statement showin� the balance in the
treasury at th� be;inning of the month, the a.mountreceived durin�
the month, orl what account disbur�ed, anc� the amount remainin� to

moneys paid to him by the City �ollector, Port Warden, or other
offic fal of the C i ty and apportion the sa.me to its pxoper fund and

the time being, then in a bank or b�nking institution in the said
City of Cape Girardeau, in his ov�n name as �ity Treasurex, to
the credit of said city, until such depository shall be selected

It shall be th� duty of the �ity Treasurer, upon the preU- ' '
entation to him of any warra.nts drawn by the �v�ayor and attested
by the �ity Clerk, if there shall be �nou:yh money in the depo.itory
belonging to the fund upon which said vu�rrant is drawn, and out
of which the same is pa;��able , to draw hiU check as �ity �reas-
urer upon thz city depository in favor of the legal hol3er of said
warrant, and take up sa,id warrant and charge the same to the
fund on whi��h it is drawn, but in no case shall the City Treas-
urer draw an�r cheek upon any fund in th� city depository unless ;

trans�er a s��fficient sum of monPy to the place where such bonds,
coupons or other indebtedness shall be pa�yable at the time of their
maturity, to meet the same .
SECTIOIV 6. APPROFRIATIITG 1�I�JN:�Y; DUTI�'S OF COUNL'I� AND

CITY TREASURER. �
Every ordinance th�,t contemplates tha payment of mone�r �r the
ap�ropriation thereof, shall, upon a second readin� be referred
to the Treasurer for his indorsement to the effect that a suffi-
Qient sum stands to the credit of the City unappropriated for th'e
fund governed by such ordinance to meet the re�i�.irernents of such
ordinance ; and it shall be a misdemeanor for any councilmen to
vote for the passage of any ordin€�.nce apprapriating money without
the aforesaid endorsement of the Treasurer thereon, and on con-
viction thereof, he or they so votin�, shall be fined not less <`�
than v�c���"� :Jo llars.

regular meeting in July of each year, thQ amount of receipts

The City `.Preasurer shall s�ttle monthly with the City and if
he regisn, or be removed from office , or die, his executor or
adrninistrator �n�.11 immediately make such settlement and deliver
to hi; �u��,;e:,��r :�11 book�;, papers and �'iles belon�ing to his of-
fi�e, together with all money belongin�; to the �ity.

�t the fir.t regular meeting of the City �ouncil held in �,-
pril, an3 on the 30th day of June , of each year, and at the close �
of his term of office , the treasurer shall pro:ent to the iulayox
and C:ouncil, f'or settlement, a general statement of his a:�oun�s
for the pa.st year; such statement shall sho�v the amount of all
receipts mnto the treasury and of all payments made b� him
d�aring such term, the condition of the tressury on th� sec�nd
Ivlonda� of ��pril, �,nd on the 30th day of June , of each year,
the balance remaining on that date to the credit of each fund,
and �uch settlement vJhen made and approved by ths Council shall

The `['reasurer and „ ity ;:lerk shall have free a.ccess to each
others offices for the inspection of all books, accounts and pa-
pers which they respectively contain, and free access to all other
offices of this City for the inspection of ::uch books, aacounts

If the Trea�urer shall wilfull� negleet �� refuse to perform
any of tha duties en�oined upon him by ordinance or by resolution
of the Courlcil, or Lhall be guilty of any oppression or egtortion
in the discharge of his of�icial duties, or shall by color of
his office do any act not authorized by law or ordinance , he sha11
be deerned guilty of a misdemeanor, and, upon convietion thereof,
shall be fined not les� than �'ive nor more than Une Hundred i�ol-
lars.
�he compensation of the City �2reasurer shall be fixed by
