SECTION_ 1._ Tha.t the Council of the City of Cape Girardeau, Mi�ssouxi ,
by a resolution, in ���ritin�;, duly ��dopted at �. regul�r mPeting thereof�
on the 20th d�y of Januaxy, 1913, found and decl�.red it to be necessary
to improve th�.t purt of Spri�;g street , from thA center line of Therr�is
street tn the North curb line of Good H6pe street , in said city, by ;
brin�ing said part of Sprigg street to the grade and improving s�me by ';
constructing therean a concrete pavement and gr�.nitoid curbs and gutter� � ;
except v�here such curbs and gutter3 �.re alre�dy in, on either side of '�.
said p�rt of Spri�g street; and th�.t sr-.id improvement be done by contract ;
,' and speci�l t�.x billa issued in p�.yment therefor � as provid�d by l�.w �
� and ordin��.nce No. 9�8, approved July 5th, 1911� the Council deeming it
n�cess�,ry and as a sin�le improvement. �

SECTICIN 2�. That the Council finc�.s and declares , that sa.id reeolution �
has �been published for seven con�ecutive insertzons , in the Da.ily
Republica.n, a da�ly n��•asp�tiper published in the City of C�pe Gir�rdeau, �
2�isscuri , and doing the city printin� for said city; and that more ';
than ten d�ys ha.ve elapsed since the la.st publication thereof, anS -�
. that �, mc�ority of the r�siczent o«ners of the l�.nds li2.b7_e to taxation ':;

�t the date of the p�ssage of the resolution for thP �ost of the improve- �
ment provided for in said resolutior�, who nlso o,:m a m�jority of front j
feet o�rned by r�sidents o�' the city �buttin� on saicl p�rt of s�,id ;.
Sprigg street to be improved, �ave not filed with the city clerk again�t 4
the improvement to be m�de , �.nd th���t no prot est whatever h�s been filed. �

SECTI�N 3. The Council havin� c�mplied with all requirements imposed
by ylaw %;.nd ordin�nce and thus having acquired authority so to do , it is F
hereby ordered and directed that Sprigg street from th� center line o2' ;
�hemis street to the North curb line of Good Hope street , be improved, �
by bringing same to the grade and constructing thereon for the distance ;
named, from gutter line to �utter line , a concrete pavement and on
eit.her side of said part of Sprigg street , where the s�.me are not
_ alre�.dy in, �r�nitoid curbs and �utters.
SECTION 4. Tha.t said work of �onstruction for the improvement of s�,id �
part�4of� Spri��; street , sh�11 be done by contr��ct �n" sh�:.11 in �.11 �
respects comply with the estim�f�.tes , pl�n� �..n:' snecific�tiar.s therefor, �
�.pproved by the Council on the 20th day of January, 1913, and on file
in the office of the City Clerk� and Ordinance No. 558 , a���ro�red July 5th
1911� �.nd this ordir�ance; and no contr�.ct for said improvement sh�.:ll
be made and intered into at a price in excess of the estim�te of the
cost of the vrhole work, m�.de by the city enginee� �nd on file in the �
office of the eity clerk, as afores�.id. �

SF.CTION 5. Tha.t �vhen s�_id work of impro�rement of s�,id p�.rt of Spri�g �
street ,� has been completed a.ccordin� to the pl��ns aizd specific�_tions ;
�.nd the contr2ct therefor, and accepted by the city engineer �.nd the ^
street �.nd wh�.rf committee �nd their severwl reports thereon appro��ed �
by the Council, then the city clerk is instructed and ordered to issue �

SFCTION 6. That the City Clerk is hereby authorized �,nd instructed `
to advertise for bids � in the ne�:��s��aper doin� the city printing� 3
for the construction of said improvement according to the estim�.tes , ;
_ plwns and specifica,tions �.nd in �ccord�nce with Ordin�nce Na. Q58,
� afores�id, and adv3sing bidders of tY�e deposit and bond required to �
6 be �iven, and tha.t the contr�et will not be awarded the successful
bidder unless he stipulates in his proposal, that he will accept
special tax bills to be issued against tlle �,buttin�r property, in
payment for the v�ork; and he V,ill in no event hold the city liab�� �
for the ccst of the work or �ny part thereof �.nd will p�y tiie cost of ;
the engin.�er' s services , or any other costs accruing in fulfillin� '
his contr�.ct , �n completion of the work. �
