AN ORDT�ANCE PROVIDING FOR THE GRADING A1QD CONSTRUCTIO�T OF SIDE�lALK5 AND
CIIRBING OAT PARTS OF bSAIN, FOU�TTAIr7, BROADVIAY AND THE&+..'�S STF�EETS IN THE
CITY OF CAPE GIRARDEAII, �ISSOIIRI.
Whereas, this Counc3l passed �n Ordinance (rIo. 650) amendatory
of Ordinanc� No. 494, designating the rnaterial of �hich sidetu�.lkB sha3.1 be
constructed on certain streets in the city, �h�.ch ordin.ance ves approved

on June 5, 1903, and is no� in effect, and where�s, this acuncil an the
lOth day of September 1503, passed an Ordinanee (N'o. 6S8) furthE�r amending
suid Ordl.nr�nce No. 484, mhieh was apprc�ved on said lOth day of 3eptember
1903, apecifying how granitoid and oth�r sldewalks shall be constructed,
and where�.s the Counc3l inc conformity With said Ordinance No. 494, and
ordinances amendatory thereto �'os. 660 and 658, did by resolution on the
5th dr�y of October 1903, instruct �he City Clerk to notify certain owners
of property to con$truct sldewalks and curbing �rhere necessAry, in front
of their property with the material and in accordr�nce with the specificat-
ions as providsd in said ordinances, �ithin 30 days from th� dat� of the
service of s�:id notice, otherwise in the event of the aeglec.t, reBusal
or failure of said property holders to comply with the said order withia
the time named, that the Council arould proceed and construct said
sidew�alk, and curbing Where nec�osary, aad
Whereas, The City Clerk in compliance with seid resolution did
on October 14, 1903, notify said owners of progerty dn certaiu streets,
to cans�ruct sidewalks in Pront oP their property in accordence �ith sQid
resolution, aad
Where�s, c�rtr�in pro��erty holders so notifi�d, have f�iled,
neglected �nd refused to comply With s�id order of th� Council to eonstruct

Council dee�ing it a public necessity, that said sidewalka should bo
cons�.rueted, �do�v Therefore

Soction One (1) . The sid�walk portion8 �there necessary, of the

thereof fron Broad�ay to Independence street and Broadway street on the
north rand south sides thereof from Water streit to Paclfic street and
Fountain street on the east and �est Aides thereof from Bellvue street to
Independence atreet, shall be graded to the established grade thereoP anQ

and wh�.rf cor�rnittee, then sai8 sidewalks With curbing uhere necessary,
shall be constructed �ith the material, an.d the �ridth and in the maruler
as provided by ordinanae, provided however, if for good cause shc�►n, the
counc3l, or said street and wharf committee aating for the council,
may perr.lit the construetion of a side��alk of less width than. that provid-
�d by ordinance.
Seotion TWo (2) . The City Engineer is herebJ required to make
an estimate oP the cost of the work herein provided for, separa�ol�t
by atreets, and specifications of sdid work and of the necessary cut, or
Pill, �nd other work th�t w�1.1 be required of the contractor to conplete
the work and file said estimate and specifications with the city elerk
and upon receipt thereof, the city cl�rk shall advertise for proposals
or bids, sep�rately by streets, in accordance vith said estimate and
spec3fications, for the grading and construction of s€�id sidex�lks and
cu..�bing, in the ne�spaper doing the city printing for seven consecutive
days. Said advertisement to be in the usur3l form, the last insertion
to be at least ten d�zys before the tine advertised for receiving bids.
If any bid shall be �.ccepted, the eity shall enter into
contract with the euccessH�. l bidder for the work, sub�eat to all the
conditions, limitations, stipulations and bond now required by this mnd
exlsting ordinanceg, and if no bid is accepted the council may by resolut-
ion instruct the city clerk to rer�dvertise as in the first �nstance; or
3.f in its �udgment it is to the interest of the city and property holders
to do so, instruct the street and �harf com.�nittee, by resolution to
procced and do s�iid work or any part thereof without advertising for
proposals or bids; provided, ho:vevor, that said committee shall keep
an. aceurate account oP the cost of sAid Work �and make re�ort thereof to

the City Council on the cor��:letion thereof.
If the work ��aty�_or�zed he-rei� or any part thereo�, snall
be constructed by contract or otherwise, the cost of said grading snd
con.s�ruc�ing said sidewalks and curbing, shall be apport3on�d, assessed,
taxed �nd collected as now provided by ordii�.an.ce. Provided however
that said cost maybe paid in five (6) r�nnual p�ynents, and five special
tax bills, each for one Pifth of saidcost, bearin� interest aPter 30
days at 6�°b per r�nnlun� issued against each pro�ertjt o3mer so assessad

and taxed and in f'�vor oP the eontractor doing the work. And the
dut�.es of the Street and W"narf Committee, City E�igiiiaer, City ClerkTl
an.d Street Commissioner in relation thereto shall be as now provided
by ordinance.
&"ection Three (3) This ordinance shall take eff'ect and be
�n foi�ce from 'and aPter its pass�ge.
