SEGTION 1. That the pbrtion of �nerald Street
in the City of Cape Girardeau� Niissouri, frtim � the e�.sting asphalt
ba.vement on Spri�a Street to the center line of T�Iiddle Street,
the s�me being in District No. 2 , in the City of Cape Girard�au, l�iissouri,
as laid out and desi�;nated by Co:�urzssion Form Ordinance No. $00, passed and
approved on the 23rd day of July, 1937, and Commission Form Ordinance No. 1253b
passed and approved on the 29th day of Niay, 1950, shall be repai.red �nd
resurfaced in aecordance with said Comm.ission Form Ordinance Nos. $00 and
1253, as Project No. 7�55 , in said District No. 2 .
SECTION 2. The followin� work shall be done: Remove and replace the
base where found necessary, remove and repl�.ce the existing asphalt surfacing
or bring existing low places in the surface to the �roper grade and contour
with new asphaltic concrete or asphalt penetration course, where found
necessary, and place a seal coat consisting of er:�ulsified or cut-back
asphalt and crushed stone or other suitable aggregate, said seal coat to
be in one or more ap;�lications and of a quantity �zd quality as specified
by the Ci�y Engineer.
SECTION 3. Said repairing and resur�acing said atreet shall be done by
the Department of Public Works of the City of Cape Girardeau, riissouri,
under the direction and supervision of the City Fhgineer, so that the cost
of sueh repairing and resurfacing sha11 not exceed an vnount eaual to
sixty (60} cents per front foot of property fronting and abutting on said
portion of said street so improved.
SECTION /�. An accurate account shall be kept by the City Engineer of the
cost of said work, including pa;Jment at contract prices for a.ny portions
thereof done by contract, and sueh cost shall be defrayed by a special tax
to be assessed in favor of the City of Cape Girardeau, Niissouri, agaiizst
the property fronting and abutting on said portion of said street in the
propvrtion that the linear feet of each lot or tract fronting and abuttin�
on said portion of said street bears to the total number of linear feet of
all the property fronting and abutting on that portion of said street so
repaired and resurfaced.
SECTION 5. Upon the compietion of said work the said Cit y Engineer sha11
report to the council the total cost of said repairing and resurfacing of
said portion of said street, the total number of linear feet of property
fronting and abutting thereon, and the pro?�or^tionate share of such total
cost chargeable against each lot, tract, a.nd parcel of land fronting and
abutting on said portion of said street, in accordance with the provisions
of this ordinance.
S�CTION 6. Upon the filing of such renort by the City �,ngineer, the City
Council shall examine the same, �nd if said report be found correct, and the
total cost of said repairing and resurfacing does not exceed 60 cents per
front foot on all of the property frontin� and abutting upon the said portion
of said street, the Council shall levy and assess a special tax against saic?
property in accordance with said report. Said tax bills shall be sold for
not less than their face value, and assigned by the City Clerk to any
purchaser or purchasers thereof.

SECTION 7. A13: orclinances and parts of ordinances in conflict with the
pravi.sions her�of are hereby repealed.
SECTION 8, This ordirYance shall take effect and be in force from and
after ten days after its pa.ssage and approval.
