SF,CTTON 1. That the portion of Olive Street fro:�l the e�sting concrete
pavement at the east side of rountain Street to the existing concrete pave-
r�ent on Chestnut S'treet, in the City of Cape Girardeau, I".issouri, the saine
being in District No. l, in the Cit�* of Cape Girardeau, Missouriy, as laid
out and designated by Commission Form Ordinance No. �00, passed and approved
on the 23rd da,y of July, 1937, and Comini.ssion Form Ordinance I��o. 1253, passed
and approved on the 29th day of i�1ay, 1950, shall be repa.ired and resurfaced
in accordance with said Commission Form Ordinance iVos. g00 and 1253, as
Project No. 3-55, in said District No. 1.
SECTIOT�r 2. The followin� work shall be done: Shape the existing gravel
surface to the proper grade and contour and add additional gravel or crushed
stone if found necessary, and construct a Bituminous Nat or Penetration
�lsphalt wearing course from 16 to 20 feet in width and having a thiclmess of
approximately 2 inches.
S��TIOid 3. Saia repairing and resurfacin� of said street shall be done
by the Depa,rtment of Public Worlcs of the :;itv of Cape Cirardeau, I�iissouri,
under the direetion and supervision of the City �ngineer, so that the cost
ox such repairing and resurfacin� shall not exceed an amount equal to �
si�y (60) cents per front foot of property fronting and abutting on said
portion of said street so improved. .
SLCTIOid 1�. i-in accurate account shall be kept bsT the Cit�T En�ineer of
the cost of said w�ork, including nayment at contract �rices for an�r portions
t hereof done b� contrac�L, and such cost shall be defrayed bv a special tax
to be assessed in favor of the Cit,y of Cape Girardeau, P�iissouri, a�ainst
the pronertzf frontin� and abuttin�; on said portion of said street in the
nrobortion tha� the linear feet of eaciz 1.oL and tract fron��in�. and abutting
on said nortion of said street bears to the total rnunber of linear fee�� of
ali the pronerty frontin� and abutti.n�; or_. that portion oi said street so
re:�aired and resurfaced.
SLCTIUI�: 5. U?�on the completion oi said work :.he said Git-r c�n�;ineer shall
re�ort �o the couneil the total cost of said repairinr and resurfacing of
said portion of said stre:>t, the total nLunber of linear feet of nro�ert.y
frontinM and. abuttin� thereon, and the proportionate share of such total
cost chargeable ar•ainst each lot, tract, and parcel of land frontin� and
abuttin�; on said portion of said street, in accordance wi.th �he �rovisions
of this ordinance.
SLi;TIO�v 6. Lnon the filin� of such renos•t by� the City �n�ineer, the Cit,y
�ouncil shall examine the same, and if said re�ort be four.d correct, and the
total cost of said repairin� and resurfacin� does not exceed 60 cents per
front foot on all the propertv fronting and abutting ux�on said portion
of said street, the �oancil shall levy and assess a s�ecial tax ar:ainst said
property in accordance with said report. Said ta..� bills shall he sold for
not less than their face value, and assi�ned by the City Cler�� to any
r�urchaser or �urchasers thereoF.
SECTIOiv 7. t.11 ordinances and part� of ordinances ir� conilict witl� the
provisions hereof are hereby repealed.
��CTIUIu 8. This ordinance shall tar:e effect and be in force from and
after ten days after its vassa�e and approval.
