SECTION li That the portion of West II�d Boulevard
in the City of Cap� Gira,�deau, Niissouri, from the end of the sxi.sting
concrete pavement north of Rose Street to the south line of Bertling
St�eet,
the �ame being in District No. 2 _, in the City of Cape Girardeau, Niissouri,
as laid ot�t and desi�;nated by Conmzission Form Ordinance Ivo. 800, pa.ssed and
approved on t�ce 23rd day of July, 1937, and Comtnission Form Ordinance No. 1253,
passed and apnroved on the 29th day of Ntay, 195�, shall be repai.red and
resurfaeed in accordance with said Conur.ission Form Ordinance Nos. 800 and
1253, as Pra�ect No. z'S5 __�, in said District No. 2 .
S�CTiON 2. The following work shall be done: Remove and replace the
base where found necessary, remove and replace the existing asphalt surfacing
or bring existing low places in the surface to the nroper grade and contour
with new asphaltic concrete or asphalt penetration course, where found
necessary, and place a seal coat consisting of eraulsified or cut-back
asphalt and crushed stone or other suitable aggregate, said seal coat to
be in one or more applications and of a quantity and quality as specified
by the City Engineer.
SF�CTION 3. Said repairi.ng and resurfacing said street sha11 be done by
the Department of Public Works of the City of Cape Girardeau, Niissouri,
under the direction and supervision of the City Engineer, so that the cost
of such repairing and resurfacing shall not exceed an �nount equal to
sixty (60} cents per front foot of property fronting and abutting on said
portion of said street so improved.
SECTION 4. An accurate account shall be kept by the City Engineer of the
cost of sa.id work, including pa;�men;t at contract prices for any portions
thereof done by contract, and such cost shall be defrayed by a special tax
to be assessed in favor of the City of Cape Girardeau, Ni�ssmuri, against
the property fronting and abutting on said �ortion of said street i.n the
proportion that the linear feet of each lot or tract fronting and abutting
on said portion of said street bears to the total number of }.inear feet of
all the property fronting and abutting on that portion of said street so
repaired and resurfaced.
SECTION 5. Upon the completion of said work the said City Er�gineer shall
report to the council the total cost of said repairing and resurfacing of
saa.d portion of said street, the total number of linear feet of property
fronting and abutting thereon, and the propartionate share of such total
cost chargeable against each lot, tract, and parcel of land fronting and
abutting on said portion of said street, in accordance with the provisions
of this ordinance.
SECTION 6. Upon the filing of such report by the City Engineer, the City
Council sha11 examine the same, �:zid if said report be found correct, and the
total cast of said repairing and resurfacing does not exceed 60 cents per
front foot on ail of the property frontin� and abutting upon the said portion
of said street, the Council shall levy a.nd assess a special tax against sai!�
property in accordance with said repart. Said tax bills shall be sold for
not less than their face value, and assigned by the City Clerk to any
purchaser or purchasers thereof�.

SECTION 7. All ordinances arid parts of ordin�.nces in conflict with the
provisions hereof are hereby repealed.
SECTION 6. This ordinance shall take effect and be in force from and
after ten days after its passage and approval.
