�N ORDINANCE AMENDING COMMISSION F�RM ORDIN�NCE
N0. 566, PASSED �ND APPRQVED ON THE �5th D�Y OF
APRIL� 19�9, BY CHA.NfING THE �ONING OF A PART
OF LOT N0. 18 IN RANGE �'G�' IN TAE CITY OF CAPE
GIRARDEAU, MISSOURI� FRffM A TWO-FAMILY RESIDENTIAL
DISTRICT TO A COMMERCIAL DISTRICT.
WHEREAS, the Gity Council of the City o� Cape Girardeau,
Missour3, has received an application from the o�ner of the herein-
after described property requesting that the zoning of the same
be changed from a txo-famil� r�siaential d3strict ta a commercial
district in an area described as f'ollotirs:
All that part of �ot No. 18, in Range �G,� in the
C�ty of Cape Girardeau, Missouri� described as follows:
Beginning at the northeast corner of said Lot 18, and run
west parallel ��th Good Hope Street, 11+0 feet, to a
eorner, thence south, parallel with Spanish Street,
7/�4 fe�t to a point in the north Iine of Good Hope Stre�t�
thence �ast �rith the north line of Good Hope Street 1�.0
feet, to the southeast corner of said Lot lg� �hich is
also the point of intersection of Spanish Street and
Good Hope Street, thence north, with the west line of
Spanish Street� 71�4 feet, to the po3.nt of beginning;
and
TdIiEREASi public notice of such application and such change
�ras given as provided by Commission Form Ordin�nce PTo. 566 and a
public hearing was held by the C3ty Council on January 31, 1955;
and
�THEREAS, said application has been submitted to the City
Planning and �oning Commission for its recommendation and report�
and said City Planning and Zoning Commission reported and recom-
mended that said property be rezoned in accordance �rith said
application; and
WHEREAS, one property ofrner o�rn3.ng property ad3acent ar near
to the property included wi�hin such proposed change has protested
such change; and

WHEREAS� the Citg Council fir_ds that said property has been
operated in the past as a gasoline service station and the present
owner has announced his intention of operating the same aga.3n as
a gasoline service station if the area is rezoned, the City Council
finds that it kould be to the best 3nterests of alI property
o�rners concerned for said property to be rezoned from a tNo-family
residential district to a cammerc3al district, NON TAERFF�RE,
BE IT �RDAINED BY THE CI�Y COUNCIL OF C�PE GIR�RDEAU,
MISSOURI� AS FOLLOWS:
SECTION 1: That Section 2 of Commission Form Ordinance No. 566,
passed and approved on the 25th day of �pril� 19�9, shall be, and
the same is hereby, amended to change the boundary of the present
commercial district so as to incl�zde therein the hereinafter
described property, which said propertp is hereby rezoned from a
t�ro-family residentia.l district to a commercial distr3ct� to-wit:
All that part of Lot l�o. Ig, in Range *G,� in the
City of Gape Girardeau, Missouri� d�scribed as follo�*ss
Beginning at the nor�heast corner of sa3d Lot 18, and rv.n
west parallel with Good Hope Street, I�.O feet, to a
corner, thence south, parallel with Spanish Street,
7l�4 feet to a point in the north Ii.ne of Good Hope Street,
thence east with the north line of Good Hope Street 1l�0
feet, �o the southeast eorner of said Lot 18, �rhich is
also the po�nt of intersection of Spanish Street and
Good Hope Street, thence north, with the west Iine of
Spanish Street, 7k4 feet, to the point of beginning.
SECTION �: The �ity Council hereby finds and declares that the
property described in Section 1 above is at the present particularly
suited for the uses and purposes of a commercial district, and thgt
the changes authorized hereby are reasonable and in reasonable
conformity with the existing use and value of the immediately sur-
rounding property.
SECTION 3: All ordinances and parts of ordinances in confliet
�ith the provisions hereof are hereby repealed, but all other
provis3ons of Cammiasion Form Qrd3nance No. 566 not amended or
repea.Ied hereby� shall remain 3.n full force and effect.

SECTION �: Th�s ordinance shall take effect and be in force
from and after ten (10) days after its passage and approval.
