Section l . That Section 2 of Co�nmission Form Ordinance Tdo. 566, passed
and approved on the 25th day of April, 1929, shall be and tne same is
hereby amended to chan¢e frorn 'tA" One-Family District to the "J" Heavy
Industry District, the followin� described property, to-wit :
All of Lots l, 2, 3, !�, 5, 6, 7, 8, 9 and 10 of Notndurft � s
Partition of the Soutn part of Lot 4 of the Southwest �,uarter
of Outlot f30, the East Part of Lot l, and the Northeast part of
Lot 2, o�' Robert Sturdivant � s Subdivision of' Outlot 81, U. S . P .
Survey 2199, T. 30 and 31 N. , R. 13 E. , of tne City and County
of Cape Girardeau, I�Zissouri .
Secti.on 2 . The City Council hereby finds and declares that tne property
in the precedin�; Section described is suitable to the uses authorized
in Heavy Industr,y Districts , and the Council further finds tnat tne
chan�es authorized by this a.mendment are reasonable and in reasonable
conformity with the existinm use and the value of surroundin�; property.
Section 3 . The Council further finds that public notice has been �iven
of' the cYian�;es and amendments contairied in this Ordinance for fifteen
(15) days in the "Southeast ��issourian." , a newspa.per of neneral circu-
lation published in the ��itjr of rape Cxirardeau, Missouri, and that a
public hearing has been held thereon, and that no protests signed and
acknowledged by the owners of ten percent or more in either of tne areas
of the land included in such proposed chan�es, or within an area deter-
mined b,y lines drawn parallel to and 185 feet distant f'rom the bo�_zndaries
of such lands , has been presented, and that the City Council has sub-
mitted such proposed chan�es to the members of tn.e City Planriin� and
Zonin� Commission f'or its recommendation and report, and that it has
thereby acquired authority and jurisdiction to enact the amendment and
chan�;es contained herein.
Section 1.�. All Ordinances and parts of Ordinances in conflict with the
provisions hereof are hereby repealed, but the provisions of Corrunission
Forrn Ordinance No. 566 above referred to, wnich are not amended or
chan�ed hereby, shall remain in full force and effect.
Section 5 . This Ordinance shall take effect and be in force f rom and
after ten (10} da�s after its passa�e and approval .
