AN ORDINANCE AT�NDING COT��SSION FOR1�7 ORDINANCE N0.
566 PASSED AND APPROVED UN THE 25th DAY OF APRTL,
1929

WHE�;LAS, the Cit;T Coun.cil of the City of Cape Girardeau,
a���-A-: : . Missouri, was duly petitioned to chan�e the zoning of the
` pro�erty 1.ocated at the southeast corner of the intersection of
Broa�rs►y and Sunset in the City �f Cape Girardeau, Nlissouri, and
WHEREAS,. pu�Iic no�ice of 5uch petition for suclz change
was given and a hearing was held by the City Planning and Zoning
Commission and the� reported to the City Council their recom-
mendation that such propeity be rezoned for TMF" Commercial
Purposes, subject to certain res�rictions, and the City Council
held a public hearing on June 15, 1953;
NOW, TIiEREr,ORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF C1�PE GIRARDEAU, MISSOURI AS FOLLOWS:
Section l. That Section 2 of Commission Form Ordinance '
No. 566, passed and approved on t;h� 2�th day of Apri1, 1929
shall be, and the same is, hereby amended to change the boundary
of the present "An One Family District, so as to exclude ther�-
from the hereinafter described pr. operty, such property to be
included in what is known as nF�' Commercial District, and is
hereby rezoned from "An One Family District to nF" Corr�mercial
Di.strict, such nroperty being described as follo�,rs:
- That part o_f Lot 1 Block 2 Sunset Terrace Sub-
division, City of Cape Girardeau, Missouri,
described as being the p��operty located at the
southeast corner of the intersection of Broadway
and Sunset Boulevard fronting 127.5 feet on
Broadway and 7�..5 feet on Sunset, the east property
line runnin; a distance of 90 feet south from
Broadway.
Section 2. That the r�zonin�; change from the ttAn One
Family District to the nF" Commercial District shall be limited
and restricted to the extent that such property shall never be
used for any of the following pur.poses and they shall be pro-
hibited:
(a) Gasoline or oil filling stations.
(b) Retail or wholesal� sale of new or used automo-
biles or automobile accessories.
(c) Automobile sales or display lots.
(d) Retail or wholesale sale of liquor either by the
drink or in the package.
Such property as rezoned shall be used for the purpose of the
construction and operation and maintenance of inedical offices
with all of the usual, customary, pert�nent and related uses
and purposes in connection therewith.
Section 3. The Cit� Council hereby finds and declares
that the property in Section 1 above described is particularly
suited for the gses and purposes �roposed by the petitioners;
that a substanti_al part of the property located in the im-
mediate vicinity and particularly on the north side of Broadway
is and has been for some time devoted to commercial uses and
purposes; and the council further finds that �he changes author-
ized hereby are reasonable and in �easonable conformity with the
existing use and the value of the immediately surrounding property.
Section �. City Council further finds that public no�ice
has been given of the changes and amendments contained in this
ordinance by due notice published in the Southeast Missourian,
a dail�y �ewspaper of general circulation published in the City
of Cape Girardeau, �Iissouri, and that a public hearing was held
thereon on the l�th day of June, 1953, pursuant to such notice;
that previous to such public hearing the City Coun�il submitted
and �eferred the petition �or 5uch change to the City Planning
and Zoning Commission and that such commission has heretofore
reported in writing to the council and the city council has
thereby acquired authority and jurisdiction to enact this ordinance
and the amendment herein contained.
Section 5. All ordinance and parts of ordinances in con-
f1ic� with the provisions hereof ar°e hereby repealed but all o�her
provisions of Commission Form Ordinan_ce No. 56b not amended,
changed or repealed hereby, shall remain in full force and effect
and are hereby ratified and confirmed.
Seetion 6. This ordinance shall take effect and be in
full force and effect �rom and after ten days after its gassage
and approval.
