WHEREAS, animals and dog control have been serious problems
within the City of Cape Girardeau for many years; and
WHEREAS, various methods and means of solving said problems and
protecting the health, welfare and property of the public have been
employed at different times in the past without any substantial de-
gree of success; and
WHEREAS, it is the desire and intent of the City Council of the
City of Cape Girardeau, Nlissouri, to protect and preserve the health,
safety and property of the citizens of this city;
NOW, THEREFORE, BE IT ORD�,INED BY THE CITY COUNCIL 0� THE CITY
OF C�PE GIR.�R.DEt�U, AS rULLOWS:
SECTION l. Commission Form Ordinance No. 1366, passed and ap-
proved March 27, 1952, and all amendments thereto and ordinances
amending the same, are hereby repealed.
SECTION 2. Ei full time quarantine is hereby declared on all dogs
beginning the effective date of this ordinance. It is hereby declared
a misdemeanor for any person or persons owning, controllin�;, possessing
or having the mana�ement or care, in whole or in part, o�' any dog to
permit the same to run at large or go off the premises of the owner
or keeper thereof, unless such dog is securely tied or led by a line
or leash, not to exceed ten � �'eet in length, so as to effectively
prevent such dog from biting, molest�ng, being with or approaching
any person or animal. Any person violating this section or any
provisions herein contained shall, u��on conviction, be punished by a
fine of not less than Five Dollars (�;>5.00) nor more than One Hundred
Dollars ( `�;p100.00) , or imprisonment not to exceed thirty (30) days, or
b� both such fine and imprisonment.
SECTION 3 . It shall be the duty of any person or persons otvning,
controlling, possessing or having the management or care, in whole or �
in part, of any dog to apply to the City Clerk and obtain a dog
_ license tag ori or before April 1 of each and every year, for which
license the City ClErk is hereby authorized to charge the sum of One
Dollar (.�-j; It is hereby declared a misdemeanor for any such
person to neglect, fail or refuse to pay said license fee and secure
the metal tag of suitable design inscribed with words "Cape Girardeau
D. L. T.'T with the year of issuance and to keep the same securely
attached to the animal by means of a collar or harness of substantial

make and condition, �aid metal tag to be numbered from ONGr ���
upwards, provided that no metal tag shall be issued unless the
applicant therefor presents a certificate of inoculation of such
dog against rabies from a licensed veterinarian showing inoculation
during the previous twelve ( 12) months'� period; provided further
that such inoculation requirement shall not apply to any dog less
than six ( 6) months of age. _
SECTION �. Al1 doss found within the city limits of the City
of Cape Gir•ardeau without a license tag marked as herein provided
shall be considered as strays and immediately disposed of.
SECTIO�T 5 • All dogs found within said city which may be found
runnin� at large, not tied or led b� a line or leash, contrary to
�he provisions of this ordinance, shall be taken up and impounded
in a suitable place, the location o_� which shall be published by
posting a notice in the office of the City Clerk. Any such dog so
taken up or impounded shall be held for three �j days and may be
claimed at any time during said three �-�) days by the owner by
paying an impounding fee of Two Dollars (�-:fl4} to cover the costs
of such impounding and the feeding of such animal. If the owner,
or some person for him, does not claim said animal within three ���)
days after it is impounded, then the animal shall be immediately
disposed of following the expiration of said three (�) day period.
SECTION 6. The �nforcement of the provisions of this ordinance
is hereby delegated to the Police Department of the City of Cape
Girar•deau with full power and authority in the members of said
Police Department to carry out and perform and execute the pro-
visions herein contained. The Health Depdrtment of said city shall
assist the Police Department and cooperate wherever health problems
or the question oi rabies shall be i.nvolved.
SECTION 7. If any section or part of this ordinance shall be
or become invalid, the City Council hereby declares it would have
enacted the remainder of this ordinance regardless of any part or
parts that may be declared invalid and, therefore, the invalidity
of any part or parte hereof shall not in any way affect the remainder
of this ordinance .
SECTION $. �ny person violating the provisions of this ordinance,
or interfering in any way with its full enforcement in any way, shall
be guilty of a misdemeanor and upon conviction shall be punished by
a f'i_ne of not less than Five Dollars (�;>5.00) nor more than Gne Hundred
Do11a�s( `�100.00) or by imprisonment not to exceed thirty ( 30) days
or by both such fine and imprisonment.
SECTION 9. Because the public health, safety and welfare is
directly involved and affected by the provisions and purposes of this
ordinance, this ordinance and its passage is deemed to be a matter of
emergency and, therefore, thi� ordinance shall take effect and be in
full force from and after April l, 1953 •
