AN ORDINANCE ACCEPTING AND ADOPTING THE CITY ENGINEERtS REPORT OF 'THE
COST OF REPAIRING AND RESURFACING OF SECOND AND TH1RD STRE�TS, FROM
THE EXISTING ASPHALT PAV�MENT AT THE WEST SIDE OF MAIN STR.EET TO THE
EXISTING CONCRETE PAVEMENT AT THE EAST SIDE OF BIG �ND ROAD, AND
SPANISH STREET FROM THE C�NTER LINE OF SECOND STREET TO THE CENTER
LINE OF FOURTH SZ'R.EET, IN THE CITY OF CAPE GIRARDEAII, MISSOURI, AND
PROVIDING FOR THE ISSUANCE OF SPLCIAL TAX BILLS IN PAYI�NT OF THE
COST OF SAME.
WHEREAS, by Commission Form Ordinance No. 1531, passed and approeed
by the City Council of the City of Cape Girardeau, Missouri, on the 23rd day
of August, 1954, the City Couneil ordered repaired and resurfacad that part of
Second and Third Streets in the City of Cape Girardeau, MissoUri, described as
follows:
Second and Third atreets, from the exiating Asphalt
pe.vement at the west side of Main street to the existing
concrete pavernent at the east side of Big Bend Road, and
Spaniah street from the center line of Second street to
the center line of Fourth street.
the sa� being within District No. 1 of the city of Cape Girardeau, Missouri as
laid out and designated by Com,mission Form Ordinance No. 800, passed and approved
on the 23rd day of July, 1937, and Com�ission Form Ordinance ATo. 1253, passed
and approned on the 29th da� of May, 1950, by shaping the existing gravel road-
way, with additional gravel or crusted stone where found necessary, and placing
a penetrating asphalt surfacin�, 20 feet in width, having a thickness of approx-
imately one (1) inch, and compacting same by rolling, and
WHEREAS, John R. Walther, Consultin� Engineer has heretofore filed
his report showing the total cost of repa.iring and resurfacing said portion
of said street to be �2196.00; the total number of linear feet fronting and
abutting thereon to be, 3660.0 feet, and the cost per front to be sixty (60)
cents and showing the proportionate share of such total cost chargeable against
each lot, tract, and parcel of land fronting and abutting on said portion of
said street, and
WHERE�S, said Commission rorm Ordinance No. 1531 authorizing and
directing said improvement to be done, �rovided tha.t the City of' Ca.pe Girardeau,
Missouri, may contract with any person, firm, or corroration for the construction
of said improvement, and
WHEREAS, the said Citp of Cape Girardeau, did perform the work with
the forces of the Department of Public Works with certain portions of the work
being performed under contract with the Missouri Petroleum Froducts Company of
Overland, Missouri,

NOW THEREFORE, E� IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CAPE GIR.ARDEAU, MISSOURI AS FOLLOWS:
SECTION l: That the report of. John R. Walther, City Consulting Engineer,
covering the repa.iring and resurfacin� of the afore-described Second and Third
streets be, and the same is hereby, ordered filed, and is hereby accepted and
approved.
SECTION 2: That the City Col�ncil finds said report to be correct
and further finds that the total cost to the City of Cape Girardeau for re-
pairing and resurfacing said streets does not exceed sixty (60) cents per front
foot on the property fronting and abutting on the portions of said streets so
improved.
SECTION 3: A special taz is hereby levied and asaessed against all
of the property fronting and abutting on said portion of said street in a sum
equal to sixty (60¢) cents per front foot; that the name of the owners, the
descri�;tion of the property, the number of front feet thereof, the amount of
special tax a�ainst eaeh narticular lot, tract or parcel of land fronting and
�butting on said portion of said street is as follows:

SECTION 4: 5pecial tax bills in the amounts set forth in the preceding
seetion sha.11 be issued by the City Clerk against said lots, tracts or parcels
of land respectively, which said special tax bills shall bear interest at the
rate of six per cent (6%) per annum from their date, and shall constitute a first
lien upon the property therein described, and shall continue in force for a period
of five years after their date unl.ess sooner p�id, and in the event suit is
brought to enforee such lien then said tax bills shall continue in force until
the expiration of such litigation. Said tax bills shall be issued in favor of
the City of Cape Girardeau, Missouri, and any owner or holder by assignment of
suc� tax bills m�,y enforce the collection thereof in ang eourt of competent
�urisdiction.
SECTION 5: This ordinance shall take effect and be in force after the
expiration of ten (10) days from the day nf its passage or adoption.
