AN ORDIIVANCE ACCEI'TING AND ADOPTIIVG THE CITY ENGINEER'S REPORT OF THE
COST OF REPAIRING AND RESURFACING OF MASON STR�ET FROM THE EAST LINE
OF FOUNT9IAT STR��T TO THE CONCRrTF PAVEMENT AT THE G�ST SIDE OF CHEST-
NUT STRE�T AND PROVIDING FOR THE ISSUANCE OF SF'�CIAL T_AX BILI,S IN THE
PAYN�NT OF THE COST OF SAME.
WI�REAS, by Commission Form Ordinance No. 1516, pa.ssed and approved
by the City Council of the City of Cape Girardeau, Missouri, on the 15th day
of June, 1954, the City Council ordered repaired, and resurfaced that part oP
Mason Street in the City of Cape Girardeau, Missouri, described as follows:
Mason Strset from the Fast line of Fountain Street to the
concrste pavement at the West side of Chestnut Street.
the same being within District No. 1 of the City of Cape Girardeau, Missouri as
laid out and designated by Commission Form Ordinance No. 800, passed and approved
on the 23rd day of July, 193'7 and Co�nmission Form Ordinance No. 1253, psssed and
approged on the 29th da.y of May, 1950, by shaping the existing roadway and adding
aggregate where found necessary and constructing thereon a "Mixed in place
asphalt surface" 2 inches in thickness and 20 feet in width with a seal coat
if found necessary, and
WI�REAS, John R. �talther, consulting Engineer has heretofore filed
his report showing the total cost of repQiring and improving said portion of
said street to be �586.26; the total number of linear feet fronting and abutt-
ing thereon to bs, 977.1 feet, and the cost per front to be sixtq (60) cents
and showing the proportionate share of such total cost chargeable against each
lot, tract, and parcel of land fronting and abutting on said portion of said
street, and
WHEREAS, said Commission rorm Ordinance No. 1516 authorizing and
direeting said improvement to b� done, provided that the City of Cape Girardeau,
Missouri, may contract with any person, firm or corporation for the construction
of said improvement, and
WHEREAS, the said City of Cape Girardeau, did pe.rform the work with
the forces of the Department of Public Works with certain portions of the work
being performed under eontract with the Misaouri Petroleum Products Compsz�y of
Overland, Missouri,

NOW THEREFORE, � IT ORDAIATr,D BY THE CITY COUNCIL OF THE CITY OF CAPE
GI3ARI7EAU, MISSOURI AS FOLLOWS:
SECTION 1: That the report of John R. Walther, City Consulting Engineer,
covering the repairing, resurfacing and the improvement of the afore-described
Mason Street be, and the same is hereby, ordered filed, and is hereby accepted
and approved.
SECTION 2: That the City Couneil finds said report to be correct and
further finds t}�.t the total cost to the City of Cape Girardean for repairing,
and resurfaeing said street does not exceed 60¢ per Pront foot on the property
fronting and abutting on the portions of said s�reet so improved.
SECTION 3: A special tax is he.reby levied and asssssed against all
o£ the property fronting and abutting on said portion of said atreet in a sum
equal to 60¢ per front foot; tl2at the names of the owners, the description of
the property, the number of front feet thereof, the amount of special tax against
each particular lot, tract or parcel of land fronting and abutting on said portion
of said street is as follows:

SECTION 4: Special tax bills in the amounts set forth in the preceding
section shall be issued by the City Clerk against said lots, traets or Farcels
of land respectively, which said special tag bills shall bear interest at the
rate of six per eent (6%) per annum from their date, and shall constitute a first
lien upon the property therein described, and shall continue in £orce for a period
of five years after their date einless sooner paid, and in the enent suit is
brought to enforee sueh lien then said tax bills shall continue in force until
the expiration of such litigation. Said tax bills sha.11 be issued in favor of
the City of Ca.pe Girardeau, Missouri, and any owner or holder by as�ignment of
such tax bills may enforce the collection thereof in anp court of compete�t
jurisdiction.
SECTION 5: This ordinance shall take effect and be in force after the
expiration of ten (10) days from the day of its passage or adoption .
